I will gladly
respond. Let me first say that this has dragged on for months and a time of
over three months whereby the contractor disappeared for over three months and
sent me email (I have a copy if need be) of him being out to sea.   In addition, he spray painted many of the
items instead of powder-coating and told me that they needed to be given a few
weeks to ‘cure.’  Unfortunately, both of
these statements are un-true and, honestly, is a important quality for me in
dealing with an individual.  Integrity is
everything.  He has not displayed this
during our relationship on this job gone wrong.
The reason I
mention this, is if it is not in writing, then the contractor’s assertions are
hearsay at best and honesty comes into question.  For this reason, he has attached a few of the
letters I have sent to him – but this is not the complete set for sure. 
In order to
not get into bickering about the details of integrity, I will only list the
legal facts here, in relation to his note below.
1.    Adjustments:  Small adjustments were made, but the gates
were continually not working and would not function as gates.  The reason he had to make them over is a lack
of quality and detail.  A gate needs to
be able to latch shut and many of them could not do this.  In addition, one of the gates was in
violation of the building code as he made it exceed the legal height limit. As
a contractor, he is responsible for knowing codes.
 
2.    Contractor Liability:
During installation, he performed neglectful work, specially: damage to the
concrete when he broke the new concrete driveway; damage to the stucco as he
broke the stucco on the new home; damage the block wall when he neglectfully
drilled into the block and cracked it; and damage to the garage door when he
scratch calculations in the paint.  The
reason I was asking for a copper overlay was to hide the damage that he created
to the wall. I have initial estimates of over $2000 to rebuild the wall her
broke and this solution is fine with me. 
I was simply trying to save him money.
 
3.    Return of Gates and
$870.  It is true that he returned the
gates after I asked him to and I am in possession of the unfinished work. I
have no idea if they work.  Installation
was part of the written contract and he did not do this.  Power-coating was part of the contact and he
did not do this either.  He has abandoned
the work in an incomplete manner. I have no functioning gates, the metal is
rusting, and I have a security problem at my home.
 
4.    Letters and Factual
Information:  I can submit all the
letters I have sent to him as they have been professional,  factual, and very specific.  At no times has any information being
anything other than factual. 
 
The reasonable
solution that I have asked for over-and-over in my letters is for him to
fulfill his written contact.  He has
failed to fulfill the contract and repair the damage.  Unfortunately, it is the damage that was
created by negligent contracting that is really the root cause here.  He has been challenged to accept
responsibility and to repair these things. I was told he had estimates on these
repairs, asked for the estimates in writing, but never heard anything back.
 
Some other
facts you need to know as the Revdex.com, that will be helpful in other potential
victims here of unprofessional contractor conduct are as follows (as relayed to
me by the California State Contractors Board):
1.    He illegally performed
work, in the beginning, as an unlicensed contractor as he exceeded the amount
of money that he could legally demand. He is under investigation for this.
2.    He illegally asked for,
and received, too large of a deposit.  He
is currently under investigation for this practice as well.
I am hopeful
that we can come to a resolution.  At
this time as he has proven unprofessional as a contractor, neglectful in his
work, and dishonest in many dealings (out to sea for two months and spray
painting versus powder-coating), I can no longer allow him to finish the
work.  The two acceptable decisions at
this time are: (1) a cash settlement to pay the amount of completion and repair
by another licensed contractor; or (2) him paying the contractor on his own of
forfeiting his bond required through the State Contractors Board to pay the
amount. 
 
Please let me
know what additional details you need as I have kept very accurate notes,
pictures, videos, etc. of this entire process that are documented and
un-disputable.

Review: This person is actively running and advertising a business and then abandoning work. Her billed $3000 for steel gates to be made, collected them from my home after they never worked, and then kept my personal property that I already paid for. In addition, several damages were caused the the house. He has a contract that has been unfulfilled.Desired Settlement: I want him to complete the work, return my metal fabrication that I have already paid for, and fulfill his contractual obligation. In addition, he needs to repair the damage to my home.
