*** ***This is in response to *** *** *** follow up complaint about the termination of our property management agreement, ** *** *** *** has my email and my phone number. *** *** is always welcome to ask me whatever she likes. I have always answered her questions. Unfortunately, she does not always listen to the responses. First, regarding the funds that she is inquiring about. I have a $owner reserve to cover expenses of the property. By the property management agreement, I have days to return this after termination. Since I believe no further expenses will be due on the property, my intent is to send the funds out this week, well within the day requirement. This is in Paragraph 11A of the management agreement. Further, I would like to point out that by the management agreement, I could charge her a 3% termination fee of the outstanding rent through the end of the lease. Since she is generally unhappy, it is my intent not to charge this fee as a gesture of good will. Finally, regarding her allegation of a lapse in property management services, this is baseless. *** *** had days to either hire another company or decide to manage it on her own. She could instruct me to turn everything over to another company if she hired another one. She confirmed on Octexactly where I was to send everything (which was to her personally), and she was informed it would be sent out "next week". This was covered in my previous response. In my previous response, I stated exactly what is going to happen, and it will happen as scheduled. That's the best that I can do. I'm sorry that *** *** is not happy with our agreement. This letter is in response to a complaint, ID * *** you received about my business from *** *** *** concerning the termination of our property management agreementThis baseless claim has already been resolved.The main issue in this complaint seems to be receiving information
from meAt the end of an agreement, I have a procedure in placeUnless otherwise instructed to provide information earlier or in a different manner (Which was not instructed to do), I send a package with all pertinent information to the owner of the property at the end of the agreement, and notify the tenant at the same time that I am no longer managing the property, *** *** was informed on Oct26, that I would be sending all information to her "next week", which was Octto NovI mailed the information on Nov2, 2016, the last day of our agreement, via certified mailIt was available for her pickup at the post office on Nov3, and she signed for it on NovThe tenant was also notified via email and mail on Nov2, The tenant responded to me on Novthat *** *** had already been in contact with her.One clarification I would like to make regarding *** *** statement that I terminated the agreementThe tenant had a gas leak in the property on Octduring the eveningThe gas company shut off gas to her housewas able to get a plumber out immediately on Octand restore gas to her houseDuring the discussions with *** *** on Octabout repairs, she stated that when this is over, we will discuss the termination of our agreementWhen one says that, they want to end an agreementI sent her an email on Octand told her that I would give her two choices for her termination: Terminate it immediately, and I would not even charge her management fees for Oct., or Follow the management agreement terminationShe did not accept my proposal to terminate immediately for free, so I have proceeded according to the management agreement.Other than finalizing monthly statements for Novand Dec., the year end statement, IRS 1099's and following the procedures for closing out an account spelled out in the management agreement, this account is closed and all parties have the information they are supposed to have.If you have any questions, please contact me at *** Thank you.Sincerely,?- ????) ??????Tom C***President

I am rejecting this response because: the management company provided a lapse in the property management.  They have not returned funds in an account in their possession used to make repairs to the property.  My complaint is that they have not responded to communications in a timely manner.  I as a property owner responded on October 27 that I did not wish to terminate the property management ageeement.  I am requesting that the property management funds be returned in their possession.
