Ms. [redacted] had a medical condition which hindered her from properly respresenting me, and failed to disclose this until after my case was lost.
I hired Ms. [redacted] in July 2012 to represent me in a child support modification case. This should have been a simple case to properly represent. At the time of hiring Ms. [redacted], I told her that I would expect my ex-husband to go for custody change in order to no longer have to pay me any monies. She assured me that he could not change child support or custody of my son without my ex-husband filing a motion to modify custody to the courts. As expected, at the time of court, my son was temporarily staying at my ex-husband's, and instead of fighting to keep my child support based on the current custody order, she failed to speak up as I requested and the courts ordered child support to be modified in favor of my ex-husband, as if he had full custody. I requested Ms. [redacted] Appeal ASAP the judges order. Ms. [redacted] not only failed to properly respresent my case in her Appeal, you failed to file the Appeal on time and later filed a Motion to Reconsider based on her "Gross Negligence" due to the fact that she had a medical condition during the time of my hearing and through the time of the Appeal Motion Process. I am now struggling to keep my home and a roof over my head and one for my son, I am having to file bankrupcy due to her lack of Due Diligenceand Gross Negligence to properly represent me. Ms. [redacted] should have let me know that she had a medical condition that would cause her to properly represent me. Had I been aware of this, I could have hired another attorney or represented myself, as she did more harm than good for my case. She admitted having complications with a hip surgery, and started Physical Therapy and was on pain medication and bed rest starting October 9, 2012, but had complications ever since the surgery in January 2012. Ms. [redacted] admits that she was in extreme pain, on pain medication, and was on bedrest most of the time until approximately 1 week after the doctor had changed her medication on October 26, 2012. So during my primary time of my case, Ms. [redacted] was unable to properly represent me due to her medical issues, but failed to disclose this information to me until after my case was lost and she admitted to the Court of Appeal her medical condition on November 6, 2012 on a Motion to Reconsider. At this point, the damage had been done. Dad went out, got a big new house and bought my son a truck with the child support he no longer pays to me and with child support I was ordered to pay him. Had Ms. [redacted] represented me properly and professional with a sound mind and body, I would still be recieving my child support and my ex-husband would not have the means to bribe my son to live with him. This also left me in a finacial situation which now I cannot provide a place for my son at this time. Had the courts addressed the only motion before it, emancipating my daughter, and Ms. [redacted] stood up and opposed Child Support Enforcement using Schedule A for dad, I would have at least had time to prepare for such outcome at a later date. And yet, I still have full custody should my son get in trouble, it is my responsibility.
