To whom it may concern,
 
First of all no one at my company discriminated against this couple based on assuming they're college students. This example of college student pranks was used as one of many examples we have when enforcing parking for assigned/permit...

parking.
 
Other issues include but are not limited to:
1. Residence thinking another vehicle is in their spot but they're looking at the wrong space number.
2. Roommates of the resident tells a visiting friend to use the space.
3. Of coarse the college pranks as this is a major college town.
4. Neighbors mad at another Neighbor requesting the tow.
And many more.
 
Bottom line, as we stated when this gentleman's fiancé called about the violation, is we have a incentive to tow violations when they're called in and that's compensation from the violator in the form of $150 plus storage. We wanted to provide this service we just needed his fiancé to provide proof that she had the authority to call in the violation. We only used the student prank scenario as one of many scenarios we encounter after she repeatedly refused to provide the proof we requested. More importantly we only ended the call with her after realizing we where not going to get what we needed to tow the violation and she made this clear by saying "I'm telling you this is my space and my word is all you're going to get as proof".
 
As this gentleman clearly points out we do have a contract to tow from the property in question. This contract gives us the written authority to tow from this Private Property for common parking violations like Fire Lanes, Parking on Landscape, Handicap Violations, Double Parking, and Snow Removal Interference and act on the management's behalf before, during, and after office hours for said violations. 
 
But just like the lease agreement for the apartment does not allow the landlord to enter said apartment "at will", "without notice", and "without permission" from the tenant our tow contract does not allow us to tow from Assigned/Permit Parking spaces of the tenant without the tenant's consent. For this we need proof the actual tenant has the said space assign to them. This proof could have been provided in the form of a letter from the management, apartment lease agreement with the parking space assignment, parking permit issued by the apartment management with the space number on it, or a call made directly from the apartment management stating that the tenant has the rights to said parking space. Simply put this gentleman's fiancé's word for it just does not hold up in the eye's of the law and the law was what we where concerned with but she made it very clear she was not interest in hearing this when she proceeded to tell us we had better come down because she had groceries melting in the car. This is when we ended the call, she was not cursing as he indicated, but she was not cooperating and she was starting to raise her voice.
 
Now we do have the right to refuse service to anyone and the reason we refused to do so here is her and his refusal to provide what we needed to perform the service they where requesting. There are laws we have to comply with bottom line.
 
We ended the call when this Gentleman called because when he called we had another call for service waiting on hold and when he stated he was calling for the same violation and we proceeded to ask for proof and he went strait for wanting names to complain about rather than stating he had the proof we needed to help him. It was pointless and disruptive to my business and services we where attempting to provide to other clients.
 
As for the claim that we where Rude. We where polite and calm with the situation and attempted to explain, to the best of our abilities, when we where interrupted and told to come do the job because of melting groceries and her word was good enough. We politely stated we where sorry we could not help out and ended the call. Same thing when this gentleman called. We handled this to the best of our abilities with the information we where being provided and that's the best we can do.
