The state of Texas set the movers maximum liability at .60 per pound per article.  Although the item was moved as a courtesy, and contracts were signed releasing us from any liability,due to the condition and not be packaged and no additional coverage purchased, We agree to pay .60 per pound x 100lbs (weight is based on claim forms submitted by Mr. [redacted])  for at total of 60.00.

Complaint: I was not informed by the movers before loading my marble coffee table that insurance would not cover the marble table top if not packed or crated. Response: On July 7, 2016 I personally visited Mr. [redacted]’s home to do an assessment of the items to be moved. We walked through each room...

and he pointed out what needed to be moved. The coffee table was not one of the pieces to be moved. However, there were 17 pieces that needed specialty packaging. I explained to Mr. [redacted] we could not transport fragile items without proper packaging. Mr. [redacted] paid $780.00 to have those items packed to be sure that we would insure them if anything happened to them.Mr. [redacted] appeared to be intoxicated, he came to the door with a beer in his hand and went as far as to offer me one. I had to explain things to him several times.  The day of the move Mr. [redacted] was drinking beer upon our 9am arrival. We had sent 2 packers to pack the 17 pieces before the movers’ arrival. One of the packers stayed behind to help Mr. [redacted] at no charge because she felt compassion for him. She said he was not ready to move and that the movers would have a difficult time without her assistance to prepare. Complaint: The moving truck was stationary at the home I was moving from when I was informed by the movers that they had broken the marble table top. I had a buyer for the marble coffee table come buy the home on [redacted] while the movers were still packing the moving truck on 7-13-16 wishing to purchase the table for 300. Dollars. This is when the movers stated the marble top had been broken. They did not disclose this until after the person wanted to purchase the table. The truck was still stationary. Response: The Movers reported that Mr. [redacted] was indecisive about the items to be moved. That he was highly intoxicated by this time. They had a particular list of items to be moved based on my visit to his home on July 7th, 2016 and several telephone conversations after. However, he was not sure if he wanted to take this or that. The movers were instructed to give him leniency due to his mental state and situation. Katy Movers often provides charity to the community and the crew seemed to think Mr. [redacted] would be a good candidate. He seemed unable to make decisions and was upset to have to move from his home of 50 years.Mr. [redacted] seemed nervous and antsy to the very last minute, expecting people to come and purchase items he was hoping to sell. The coffee table was one of those items; he confided to the movers he had a buyer for $100.00 and was worried she was not coming. Finally, he instructed the movers to load the marble top table. The crew leader told Mr. [redacted] we could not accept liability for the marble top as it was very dry and already had a couple cracks, at this point we did not have the materials to build a crate. Below is a copy taken from the move contract where Mr. [redacted] agrees to move the piece at his own risk. The movers were just about ready to leave when Mr. [redacted]’s client arrived to purchase the table for $100.00. When the movers lifted it in the truck to unload it, it broke at the crack.  Complaint: I filed a complaint with the company which they refused to compensate me for the 300. dollar loss by a letter I received from them August 13,2016. stating my claim was denied because of a moving guide they claim I received before the move date which I did not receive. Response:  Upon my visit to Mr. [redacted] in his home on July 7th, 2016, I reviewed a number of documents with him one being our moving guide. I left a copy with him that day. I also emailed him a copy on July 08,2016.Complaint: After the move was completed I did sign papers which included marble tables must be wrapped or crated after the move was completed on 7-13-16 at approx.900pm . I feel I did not receive receive proper notice before the move as they claim.Response: This is absolutely not true. All paperwork was signed prior to loading. There was one signature after the move was completed, which states that all items were received.Mr. [redacted] stated no other moving company would come out to give him an in home estimate, no doubt, due to his incoherent telephone conversation. Why  Mr. [redacted] would state these untruths after we made many concessions in price and labor for him, I don’t know. He and I spoke in depth about the importance of specialty packaging for these treasures. He even called me several times to add on other items to be packaged.  We gave him more than a fair price. Specialty packaging of 17 pieces for $780.00 and a 3 man crew until 9 pm to move a one bedroom apartment.  I feel that Katy Movers Inc. and its employee’s handled this move with the upmost professionalism despite the unprepared nature and conditions of our customer Mr. [redacted]. l us why here...

[redacted] entered into a contract with [redacted] on July 03, 2014.  It was a bad storming day at which point the shipper has the option to move forward or reschedule without penalty. [redacted] decided to move in the rain  and signed an agreement holding [redacted]....

harmless from damaged caused by the weather.[redacted] honors the [redacted] laws which declares the [redacted] maximum liability at .60 per pound per article. We understand this coverage is not always sufficient therefore we officer additional coverage which [redacted] declined.  Yes , there was a leak in the  front right hand side of the attic, the [redacted] plugged the whole from the inside and were careful not to place upholstery or boxes in that area. There is no excuse for the damaged truck however,  the attic is 3' deep and water was leaking not pouring in, so this was not the the source of the items being wet.  As [redacted] mentioned they loaded the small stool in the side door which is 3'from the attic. This shipment was packed by the owner, the expensive small stool should have been  wrapped and packed into a box prior tho the [redacted] arrival.[redacted] submitted a claim requesting 750.00 dollars to reupholster the small stool. The estimates indicates material at 700.00 a yard, the stool did not need near a yard to reupholster. [redacted] offered to have the stool clean but were declined. Therefore the claim was settled based on the [redacted] maximum liability of .60 per pound per article. I would also like to mention, the [redacted] had moving blankets to transport the items to storage however our blankets can not be left in a shippers personal mini storage, therefore we sell 3 ply paper pads on an as needed basis, and yes the ramp is unsafe in rainy conditions however we honor the shippers decision to move in the rain in lieu of rescheduling.Aurora B[redacted]Owner /Operator[redacted].
