Customer executed a written contract with specific language that refers to what happens if they decide to terminate after we begin to incur expenses.We communicated via email in the weeks immediately proceeding the execution of the contract regarding HOA approval (this is something we do at least once per week Very commonplace) Home owner is contractually obligated to provide HOA approval We are not responsible to "fetch" it, nor is the contract contingent upon it Customer assured us via email that HOA had approved the job We replied letting them know, again in writing, that a verbal approval was acceptable to us, but that if the approval falls through that they are responsible.Customer responded to this email and gave us the go ahead I have all the emails saved.We ordered special order materials, contracted a production manager to supervise the procurement of materials, permits, design work product and begin the planning/scheduling Bottom line, we incurred hard cash expenses that are the customer's responsibility.Customer subsequently canceled the contract When reminded of their obligation, they had the HOA dis-approve the work HOA is not a party to our contract and has no bearing on the customers obligation to make Kwhole I don't need to make a penny on a customer that does not want to work with us, but I am not going to take a loss in this situation either Our contract clearly provides for this situation and in fact is "only needed" when a customer puts us in this spot I spoke to my lawyer and my team My instructions are to provide the customer with a full refund of the amount due per the contract This sum will be remitted asap.Also worth noting is that fact that a Revdex.com complaint was issued prior to Kbeing given an opportunity to resolve It should be noted that Ownership at Kheard about this issue from the Revdex.com not the customer Very sneaky
