Complaint: [redacted] I am rejecting this response because: I never received any warning or flyer from KBS or [redacted] about the change in parking policy KBS says they hung flyers on cars without parking permits before booting them Well, not all of permit-less cars, apparently Several of us tenants never had warnings put on our cars Neither did we receive notifications from [redacted] When I moved into the apartment complex in August 2015, I specifically asked about the parking permit situation [redacted] told me not to worry about it because they were not enforcing the parking permit policy I blame [redacted] more than KBS for this situation and I realize KBS was just doing their job I've also filed a complaint on [redacted] But it takes two to tango KBS did not give me any warnings like they said they did [redacted] did not properly notify me like KBS says they did A reasonable person would not notice small changes to the few, small warning signs about the parking permit requirements after living in the complex for months A reasonable person would expect a direct form of communication regarding changes in parking policies that could result in their car being booted, thus incurring a $fee Sincerely, [redacted]

Revdex.com:Thank you KBS for your response.I have re-posted the only documentation I received from KBS.Could you show me in this document where it states "ADA's policies" This document has no information of ADA's Policies I walked around the facility after the phone conversation I had with KBS before filing this complaint There is nothing posted around the facility informing residence of ADA's policies I do not have any information of ADA's policies unless I look them up There was nothing sent to me stating that this facility complies with ADA's policies.I followed the rules listed in the letter posted My vehicle was not violating any of the policies listed in the letter I received I got reprimanded for a violation that I had no idea was in existence This is a residence facility, not a city street or parking lot Tenants must be informed of all possible violations from the facility If a tenant violates the rules, a tenant is warned in writing, then disciplinary measures are taken if warnings are not heeded.In private lots, where people pay to park, the company has all terms posted, I understand that when you park at these facilities you agree to the terms posted as a "contract" Would KBS please show me where the ADA policies are posted at the *** *** Because I do not see these policies posted anywhere at *** *** or the fact that KBS complies with ADA's policies.If I had known that the facility and KBS complied with ADA's policies, I could have pulled up the documentation and educated myself of the terms and conditions ADA requires me to follow.There fore, my dispute would be that I was not properly informed of all possible violations that would inflict a fine, boot, and tow on my vehicle.I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. KBS Parking Enforcement received a phone call on March 27, stating that a vehicle was parked illegally (double parked) on private property by another tenant at Edgewater apartment complex. When our enforcement officer arrived at the location, the vehicle was in fact in multiple parking
spaces - a violation of the complex’s parking policy. We placed an immobilization boot on the vehicle and a bright orange sticker on the vehicle explaining the reason the vehicle was immobilized with a phone number for release at10:pmMr*** never called for a release. On Friday April 1st, the company sent another officer out to check on the vehicle and to his surprise, the initial immobilization device and the notification sticker were no longer there. Subsequently, a new immobilization boot was placed on the vehicle, not because of being a “target” but because the vehicle in question was still in violation of the parking policy by being double parked. During the process of placing the new boot on the vehicle,Mr*** arrived on scene in an irate state and started kicking at the officer’s hands while he was placing the boot on the tire. He was upset about the situation even after our officer explained the reasoning behind both the first and the second boot. Mr*** told the officer he would trade a boot for a boot (meaning if we would remove the boot from the vehicle he would give us our other boot back) and admitted to having stolen KBS’s property. We stand by our policies and adhere to a strict code of conduct and ethics and we do not make deals that comprise those values so our officer declined his offer to “trade a boot for a boot” and the told him that we would not be inclined to take any other deals or negotiations. He told Mr*** he needed to pay his fines and return the stolen property. At that point, Mr***’s anger escalated once more and told our officer that he was going to remove the second immobilization device that was on the vehicle and refused to give the first one back.When a person refuses to give property back that does not belong to them it is a crime, enforceable by the proper law enforcement authorities. Although we did have every right to call the call the police at this point, we understand that sometimes people become upset in these situations and only need a bit of time to cool down and realize it is not worth a permanent mark on their criminal record. We strive to solve all disputes, frustrations, and situations like these on our own before involving law enforcement agencies. We gave him a chance to cool down and call us on the second boot but he did not. He took it off in the same manner as the first and kept the second boot as well. At this time, we decided to call the Boise police department for assistance (not to criminally press charges). In order to do so, KBS contacted the Edgewater office manager to retrieve Mr***’s apartment number and name to pass along to the police officer. Even after the initial contact with law enforcement, he still refused to call us. On4/7/KBS put a notice on his vehicle to be towed unless he called the number on the tow sticker and spoke with the manager. Mr*** removed the sticker from his vehicle and parked it out on the street.At this point KBS had exhausted all efforts to retrieve the immobilization boots or collect payment and decided to speak with the police officer once more. We told him that if Mr*** did not contact KBS Parking Enforcement by Monday 4/11/(now two weeks after the first incident) we would have no other choice than to press charges for theft. Mr*** contacted KBS, as requested, on Monday 4/11/2016. He stated that he was sorry that he removed the boots off his car. He also stated that he didn’t have time to call us in the two week span. While we accepted his apology, all it takes to remove a boot is a very short phone call (or even a text) and for the fee to be paid. The incident would have been over in less than a few minutes if he had called us the first day. But instead he possessed stolen property for over two weeks. In this industry, we provide a service that those in violation do not appreciate. We do our best to make this process as painless as possible and understand the frustrations that can come from being embarrassed and/or the financial burden of breaking polices and rules that the residents are well aware of. We acted within our scope of practice - with honesty and integrity. We also know we went above and beyond by refraining from pressing criminal charges and hope that Mr*** can see the great lengths KBS goes to in working with violators to the best of our ability while still providing the immobilization services that we are contracted to do.Tell us why here

So your calling me a liar? Your "officers" were not wearing anything telling me who they were. They did not introduce themselves didn't even say one word to me unless I talked to them (which was about why they didn't have any form of Identification! ). All I know the one guy who took my payment was wearing a green shirt, jeans, and a sweater (not a black KBS shirts or anything saying KBS) the other young man never came over really only to take the boot off. Your telling me if this happened to you or your loved one you wouldn't have thought the situation was a little sketchy? I'm a young girl and it's thing like this that I need to watch out for. These days IDENTIFICATION is extremely IMPORTANT.
I understand that the registration was expired but for good reason. My dog fell off the stairs at the complex and broke his leg and had to have surgery costing me nearly $2000 (if you don't believe me your more than welcome to come over and take a look) then on top of that rent of almost $600 was due. You tell me was my registration more important than either one of those things? However I don't think I should have to explain my financial situation (to you or the apartment complex) this never should have even happened. My registration was not that expired. You think you could have just posted a warning on the car rather than just resulting to putting a boot on it.  Yesterday the company redoing the parking lot could have just towed my car away they didn't have to go door to door to find the owner but they did. I find it amazing how your the only two companies that I have come across that treat people the way you do.

In response to the complaint you received from [redacted], he was blocking the entire side walk that obstructed a handicap individual at [redacted].There is nothing to dispute, this is an ADA violation.  You can not block the entire sidewalk with your vehicle.Thank you,-KBS...

Parking Enforcement

I am the owner and operator of Kbs parking enforcement.  The vehicle was parked at Garrett st apartments which is part of Ada county and not Boise city.  Ada county does not have any restrictions or code on imobalization.  Which means we do not have to have any licensing  needed...

to boot in Ada county my officers wear a Kbs uniform at all times black shirt with Kbs lettering but they are not required to by Ada county as there is no code on imobalization.  We are an independently contracted business by the property owner to enforce all parking rules stated in the lease that you have signed and are contractually obligated to.  If you are not a tenant it is the tenants responsibility to inform you of all rules required to park on that lot.  Unfortunately you got booted for having expired registration.  The moment the front tire of the vehicle touched the private property you were violating your lease.  There will be no refund given to this tenant or guest at Garrett st apartments.

KBS has been doing the parking enforcement at the [redacted] apartment complex since late 2015 we were told by the complex manager that we were to start enforcing the permits on March 23, 2016.  We have a warning on the signs that we have put up there are about seven in total.  these signs...

have been at the entrance and the y's at the complex also since late 2015 following Boise city code.  There have been tenant mailers sent out to all tenants from the apartment complex manager.  and we have also hung flyers on the vehicles that didn't have the proper permits.  We have made every attempt to properly warn tenants that we were going to start enforcing for permits by March 23, 2016.  In response to the immobilization device keeping the vehicle held captive.  our signs also indicate the immobilization device will be placed on the vehicle until the $95 dollar fee is paid for parking irresponsibly on private property.
