I believe that the fencing operator should be the party responsible for the damages." I was contracted by *** *** *** to build a concrete slab that would hold a dumpster and fence. The slab was to be 14' x 10'. The fence contractor, Steve *** at *** ***, would be drilling his own holes. I complied. The problem that resulted is the fence
holes were not drilled deep enough below the frost line. During the winter, the ground caused the poles for the fence to move resulting the concrete breaking. The repair that needs to be done should be completed the by the project manager, *** ***, for not making sure the posts for the fence were below the frost line and the fencing contractor. The complaint states that the slab was undermined by ice. The slab wasn't undermined by the ice If it were, the soil around the concrete slab and ashpalt would be eroded. From the pictures, you can see that this is not the case. The fence was installed improperly resulting in the concrete being broken.I have attached documents from job in question.
