This client hired our company to design and install landscape to his rear yard in In we returned to install trees on his property line to screen the neighboring propertyAt the time we installed the plant material, he specifically
instructed the crew as to placement, which is not as designedThe client was fully aware that the Spruce was going to be in a swayle between he and his neighboring property and the many issues caused by the hillside to the west of his propertyHis neighbors turf was less than 3' from the tree and its irrigation, this client even adjusted his neighbors heads trying to stop the over watering and called my attention to this on several occasions with several witnessesI told them during this dispute with his neighbor if the trees died, they would need to take it up with their neighborsIn the complaint he mentions a berm, please see the attached invoice, where he did not pay for such a service, and in fact our company provided nursery stock product for the client to plant himself at wholesale prices believing him to be a good clientThe tree was planted 6"-8" above grade, but settled to 6" below grade with all the neighboring waterMuch of the plant material replace by our company from the original design suffered the fridged winter and spring frost, "ACTS OF GOD" were not covered in his agreement, but in good faith we replaced over $$worth of plant material trying to satisfy this clientThis complaint is another attempt to strong arm a small business into accepting responsibility for the client's dispute with his neighbor

The response from the business has outright inaccurate and untruthful informationThe two spruces planted by KC Land Design were at the recommendation of KC the business owner for that specific location, so I do not understand the comment "which is not as designed"The tree was not planted in a swayleMoreover, neither my wife or I was not home the day the trees were planted
KC the business owner seems to believe that our neighbors and us had a "dispute" over waterThis is falseI called KC the business owners attention to the fact the tree was struggling and asked her for suggestions given that it was my belief she might want to protect her investment, i.enot have to replace a dead tree
The tree did not settleIf it did then it was not planted well in the first placeNeither tree was planted 6-inches above gradeThe fact that she believes it settled inches below grade is an admission on her part that the tree was not planted correctly in my opinion since that would mean the tree settled over inchesNot a very good planting job by any standard
She mentions I did not pay for a bermWe had cubic yards of top soil onsite for another project and I made it clear to her that her team could use as much of that soil as needed to plant the trees above ground level and amend the existing soilThat is my reference to "berm the trees up"
The other spruce tree she planted feet away is still alive by the waySeems strange that if it is also in a swayle getting too much water from my neighbor that this tree would not also die
Regarding the landscaping and the replaced plant materialThree of four Austrian Pines she planted died and she replaced them and of the three replacements two of them diedThat means of pines she planted diedWe consulted a nursery and it was their opinion these tress were planted poorlyAlso, non-fruit bearing deciduous trees she planted died and she replaced them with fruit bearing deciduous treesIt remains to be seen if they will survive
I simply want this small business to stand by their product and commitmentsIt is my belief that this was the small business attempt to strong arm a consumer since the small business believes that we would not sue them over a $tree

Design *** KC which there is no mention or recommendation to a berm or plant material in the area due to drainage
Plot Plan *** in which the client was made aware of the grade to his property and the potential water coming from his neighboring property

*** *** was even offered other solutions so not to loose the tree by the designerIncluding speaking with their neighbor to limit the amount of watering to their adjoining turf
We will not contribute anything toward this claim unless ordered by a judge

Clearly this business has no interest in resolving this matter when making these types of statements: "we will not contribute anything toward this claim unless ordered by a judge." Again we reiterate our point made in our prior rebuttal that the business is not fulfilling their obligation to warranty a tree they plantedFurthermore, the business is attempting to obfuscate the facts in this matter by introducing non relevant informationThe "*** *** Request 8-29-14" was solely directed at our backyard and not the front yard and the "Design *** KC" was also solely directed at our backyardOur home builder as part of our home purchase landscaped the front yardMoreover, any attempt to suggest that we moved the placement of the trees in this original request is a complete and outright liePlease find attached the complete original rendering "*** Rendoring X-XXX" that the business gave to usNote that the design presented here is not ultimately how the back yard was landscaped and the two trees the business is suggesting were moved were indeed planted elsewhere in the back yard via their suggestion during an onsite meeting once work on our property commencedThe tree in question was subsequent work requested and performed in the April/May There was no design plan as we met with the business onsite and discussed options for additional trees/shrubs in the front yard, subsequent to the home builder landscapingThe business suggested the two spruces, including specific types, for the location where they were plantedFinally, as was discussed at this onsite meeting the business agreed to use some of the cubic yards of top soil sitting in front of the house to amend and raise the treesFinally, we reiterate the fact that one of the two trees remains alive and if our neighbors water was such an issue why then did this tree not also die from "supposed overwatering"?
We have no interest in an ongoing back and forth with this businessWe strongly urge the Revdex.com to give this business a negative ratingClearly, we are not getting my money back or the tree replaced unless we take this business to court
