I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolveis as yet. Nathan, you are aware that when I pointed this out to your partner Dave *** he called you from his cell phone and talked to you, the exact words for this oral agreement were that your company would replace the soffit with similar kindI'm not in the construction business like you are but I expect and trusted you and took you and Dave at your word that you would do what you said you would doNow if you and Dave are not men of integrity and don't keep your word, I will be sure that my friends and business associates know what kind of person the owners are The $dollars is not a problem for me to pay, the problem is you said and agreed to do something and now you want to back out and threaten me.I've asked many times and have sent a certified letter to address this issue.I have tried according to what your contract states to resolve this, it's not my fault that you agreed to repair the soffit, but failed to put it writingPlease let me knowwhen you can schedule a time to complete what you agreed to

I have attached the executed agreement which does not include soffit vent repair or replacement as part of the scope of work I have explained to this homeowner that the type of vented soffit installed on her home is no longer available, so we cannot replace what is on the home
Regardless, we are not obligated to repair or replace soffit as it is not part of our agreement The roof has been replaced, and the scope of work has been performed in full There is an outstanding balance due of $1, This homeowner is just trying to keep her money and not pay us We will lien the property and sue the owner if the balance due is not paid in full

The soffit in question is not manufactured anymore.  We cannot replace it with the same material.  In the event we COULD replace it, the cost would not be $1,400.00.  So, withholding $1,400.00 for this scope of work is excessive, not to mention the fact that it is not part of the contract.  We have tried to resolve this matter by making multiple trips to the property at our cost and without benefit.  At the end of the day, the soffit repair/replacement in question is not our contractual obligation or responsibility.  We have a contract in place which has been completed in full, and we expect full payment.  In summary:We cannot replace the soffit with the same materialThe soffit replacement is not our contractual responsibilityThe contract we have in place has been completed in fullWithholding payment in full will result in legal action against the property owner
