I have given advance $6000 to this contractor with proof of transaction. He did not even start work at all. Giving me false promises to start work.

I have some issues with my basement development contractor. It is regarding Contractor *** I got in touch with him as he was customer in my *** Convenience store, ***, Regina.

On September 5, 2019 a contractor named *** ( ***) visited my house *** street, Regina for quote of basement development and after discussing all requirements we finalized the deal with written agreement (of which I have original copy if required ) signed by me and Contractor on September 17, 2019. This written agreement I have attached here for your reference. It clearly mentions that the work will be finished for $12,000 with possibility of 10 to 15 % variation in pricing.

As he asked for advance amount for confirmation, he asked me to send $ 6000 I have sent him email transfer in 3 installments.

September 9, 2019- $ 3000
September 9, 2019- $ 2000
September 19, 2019- $ 1000

I have all proofs of email transfer with me for confirmation. ***

As the time proceed, he delayed to apply for city permit for basement development and whenever I followed up with him, he always used to say it will be available soon. This happened multiple times. I have all text message from him with date.

So I contacted City of Regina directly and then permit department employee contacted me to confirm that there was no premit under process for my house basement development. Then I asked them if they can send me this confirmation in wtitten. So the permit department personnel sent me e-mail clearly stating that as of that date November 5, 2019 no permit was in process at all. I have that official email as well from City of Regina permit department as a proof. ***

So now to double check I asked my contractor again that what is the status of permit. Again he said it we will get it soon as it is under process. So now I contradicted him with proof that he was playing around with me.
So then he again came to my house to take measurements fory basemt and then he filed permit in City of Regina on November 19, 2019.

As of this moment, permit is approved and ready to pick up.

Now the contractor is saying that he would charge me $ 20,000 minimum amount to finish my basement development. As I clarified to him that I can't afford to pay $ 20,000 as I can only pay $12,000 according to original contract.

So he offered me option for using the used stuff in basement development and costing $17,000. So I declined that option as I do not want to use used stuff for my basement development and also I can't afford more than $12,000.

So now he is saying that he can't give me back my money as he already paid to plumber and electrician in advance so he can't return the money if I cancel the contract.

At the moment, we have not started work at all.

He is not answering my call properly and whenever I call him he says he is busy and will call later and never got back to me. Also for last 6 weeks he is not picking up my calls and not responding to my text messages.

This experience is very frustrating and want to get back my money asap. I used my Personal line of credit and still paying interest for that and it is almost 4 months and we have done nothing at all in this basement at all.
