MrR***, left a $deposit for the LX on August On Tuesday evening, September 8, MrR*** decided to cancel the sale for the Lexus via emailI was out of the office the following day and did
not speak with him until Thursday September 10thI read his email and he explained his feelings to me over the phoneI understand the issues with the vehicle, however we are talking about a SUV that is nearly years old with 123,miles on itOf course it is going to have rust and of course it will not be perfect and brand newI explained that deposits are non-refundable especially when we have held a vehicle for over a weekMrR*** asked if we would refund half of his depositI told him that I would speak with the owner and see if there is anything we could doWe agreed to refund half of his depositAttached is a copy of the refund

Initial Business Response /* (1000, 8, 2015/07/20) */
*** vehicle was picked up a couple days after it was dropped offThe wrong key was being used to start the vehicleThere was nothing wrong with it
Thank you,
RJ

*** *** purchased a nearly eleven year old truck It will not be perfect and brand-new and will have issues in its lifetime KDK replaced the AC Compressor and fan at no charge to Ms*** prior to delivery I'm not sure why Sunnyside would have charged for new balljoint
being that we had installed new ones when we purchased the vehicle That being said we did bring the Ram back to the dealership to replace the front drive shaft at no cost When the vehicle was here the AC blew cold and had no issues If there is something wrong with the AC of the vehicle; I would be more than happy to take care of it Keep in mind that the pickup was purchased in April We did try and fix the power seat after the sale for Ms *** but were unable to get the parts needed to do so The truck is over ten years old at this point and every used seat we could find had the same problem Please note that the seat nor the driveshaft were conditions of the sale The service plan that Ms*** purchased covers the powertrain of the vehicle Which like *** stated would be your major components Not your AC If Ms *** has tried to use her service plan and actually called in a claim that was denied; I would be more than happy to cancel the plan and refund her for the extended warranty I have attached a signed purchase order, FTC Guide, and extended service plan listing coverage Please note that the vehicle was sold AS IS, is over ten years old, and has over 100,miles on it Thank you, ** *** General Manager KDK Auto Brokers, Inc

Initial Consumer Rebuttal /* (3000, 7, 2016/04/20) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I did contact youI left a voicemail and never received a call-backI had to have the fuel line repaired which was over $because the leak was under the gas tankAlso, the car needs a brand new converter assembly which is more than I expectedMost quotes are around $for the assemblyThat's $in repairs and I just bought the car at the end of February
I understand that the car is years old but these were existing issues that were essentially given a "band aid" in order to sell the car more quickly
If you can replace the converter assembly, I will take the hit on the fuel line repair and we can call it even$just isn't going to satisfy me for a car I just paid almost $6,for including tax
Final Consumer Response /* (2000, 15, 2016/05/09) */

Initial Consumer Rebuttal /* (3000, 7, 2016/04/24) */
(The consumer...

indicated he/she DID NOT accept the response from the business.)
There is no dollar amount stated in KDK's response. The additional amount to be refunded needs to be put in writing as well as the date the check will be mailed. If the amount to be refunded is $452.50 and the check will be mailed immediately,we will accept their offer. Otherwise, we do not accept their offer. They lied to us about not receiving a check from PWI when in fact they did receive a check. It also took numerous phone calls to receive the first check which was not the correct amount. This Complaint was filed because they did not return our phone calls about the amount in dispute despite being told we would take this to the Revdex.com. We do not trust that we will be compensated for the full amount in a timely manner.

Please see attached copy of check. I mailed it the following day after speaking to the Revdex.com.

Initial Business Response /* (1000, 5, 2015/12/26) */
This would be the first time that KDK has been contacted by Mr. [redacted] regarding his down payment. Mr. [redacted] was refunded his deposit the same evening that he came into the dealership. I find it hard to believe that he would be turned down...

elsewhere for high credit card limits especially since the credit card in question is a pre-paid debit card. (which doesn't report to the credit bureau)
Please understand that Mr [redacted] was given the option to pay cash for the vehicle and was unable to come up with the total balance. KDK gave him the option of financing the vehicle. Keep in mind financing terms will be based on credit. There will always be additional fees and interest when arranging financing. In addition to any insurances or service plans. Which Mr. [redacted] wanted to purchase.
I'm sorry for any confusion but we did stayed open two hours after close to try to put a deal together. I would have much rather gone home for the evening. Before I would refund a penny to Mr. [redacted], I would want to a bank statement showing the refund never processed and also a contact from the credit card company verifying this. I know that if I had $2,500 missing in my account that I would have no problem contacting the proper authorities at a dealership or any place of business. Please call my personal cell phone. RJ [redacted]
Initial Consumer Rebuttal /* (3000, 7, 2015/12/29) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I will respond to their response in the same order that they responded.

If I must I will pull up phone records that I had tried to call multiple times just to be put on hold and hung up on (this can be seen with the duration of the call).
I was not refunded my deposit the same day. That can be seen in the documents that I have provided and from my bank Usaa. And, yes, my card is a secured card, but it DOES report to the credit bureaus as unsecured because it is also a revolving CD.
The second paragraph is null to this situation. It seems as if they are speaking down upon me, like I do not underatand fees, interest and such. I'm well aware of the fact of extra fees, rates, mark ups, etc. I already own two vehicles and a business myself.
I was helping a friend with a down payment on a vehicle. Staying open two hours later is a bit unbelievable; because, I remember vividly when I had to come pick him up from the dealership due to a a very different final purchase number then what we had agreed upon;Brokers t really tiny fine print, with plenty of white-out (to cover up up changes) on the purchasing documentation. Why because it was a 45 minute drive there and back.
In RJ's first paragraph he said that he refunded me the money. In the last paragraph he said that I would not receive a penny without a bank statement. I'm sure it is pretty easy to go over his paperwork if he remembers that night so vividly of staying "two hours later than after closing" and see that there was never a refund processed even in their financial records. And not just the $2,500 from my credit card (at this point does it matter if it secured or not its still 2500 dollars) but also the $2,000 from Mychal-the person that was going to purchase the vehicle- so a total of $4,500 that has not been returned. Mychal is taking care of his end also.
And my bank USAA has attempted to contact KDK auto Brokers regarding this matter. I pulled up information from my account and attached four documents showing no return and a dispute still in progress.
All this extra time I spent trying to resolve this issue and RJ from KDK Auto Brokers is seemingly belittling my sense of information on the subject and purchasing standards/regulations etc. after trying to reach out multiple times, not just by phone but on their website via email.
I know its not just some feeling I have but pure logic that I have been wronged and belittled and would like to be properly compensated not just for money that has never been returned; but also, all of this extra time invested in this matter. None of that time I can get back and I'm not getting paid for this.
I would like to receive Justice in this matter. I hope that's not to much to ask.
Final Business Response /* (4000, 14, 2016/03/08) */
Again, there have been zero attempts to contact us aside from this complaint. If there is some charge that has not been reimbursed; a simple phone call is all that is need to clear things up. Please call me directly with proof of such an error.
Thank you,
RJ [redacted]

Minh, we have worked on your vehicle multiple times for free.  KDK has given you free vehicles to use while your Cadillac was serviced.  We went as far to use a third party to repair your Escalde; again at no cost to you.  Our drivers, technicians, and third party service center drove...

your vehicle without incident.  You purchased a three year warranty.  You are welcome to file a service claim with your local Cadillac or GM Dealer.  That is what the warranty is for.  KDK has never filed a warranty claim or charged you for any service work.  You yourself mentioned that you had a “ friend “ work on the Cadillac.  Please take your Escalade to an authorized dealer for any repairs in the future.     In regards to trading your Cadillac in.  A vehicle is a depreciating asset and will never be worth the same or more than what you paid for it.  Of course you will loose money by trading if you purchased the vehicle 7 months ago.     Thank you,    RJ E[redacted]  General Manager

Bart, I'm sorry it took so long to receive you title.  We issue a 45 day temporary tag with every purchase.  Our average turn around time for most titles is about three weeks.  Some titles may be quicker some may take a bit longer.  Your title work was processed on June 15th....

I have attached a copy proving this from the Ohio BMV.  This would have given you seven days to purchase plates at the local license bureau.  I'm sorry if there was any confusion; but there was no reason for you to rent a vehicle.  Please contact me personally if you would like to discuss the issue. Thank you,  RJ Elser [redacted]

I am rejecting this response because: The truck is unsafe an should not have been sold to anyone in the first place.  The vibration is so bad that the battery cables will not stay connected, they vibrate right off and I have had to have service calls to jump it and I can prove this. The vibration loosened the dental implant screw tops in my mouth and the surgeon had to put new caps on my implants. Not only have the service call people claimed this so did Auto Details  who had to reattach the step and the brush guard I bought from them and had them professionally install.  They claim they have never seen this happen before.  The vibration was never corrected which was brought to [redacted]'s attention before I bought the truck and he claimed it would be fixed before I purchased the truck.  When I picked up the truck he once again claimed it was corrected.  The truck was not picked up at SunnySide Chevy it was picked up at [redacted] in Amherst because [redacted] said I had to take the truck to a [redacted] dealer for the service contract.  They were the ones who called the service contract provider who claimed the drive shaft would not be covered  because the KDK sold me the truck knowing it had a problem in the drive shaft.  $2000.00 I paid for a service contract that did not cover what I was told it would cover.  The service contract company called me and told me they would not cover the truck.  [redacted] also told me the AC was covered and that was before I bought the truck.  The reason KDK had to pick the truck up at [redacted] was because the mechanics at [redacted] said it was unsafe for me to drive from Amherst to Brunswick.  Both [redacted] and Sunny Side and Auto Details are all willing to back me in court.  I was lied to from the beginning by KDK.  [redacted] told me the truck had not plowed,  both Sunny Side and [redacted] said it had been used to plow.  I have text messages that will prove I was told the seat was replaced as was the drive shaft but when I picked the truck up from KDK a second time the seat was the same seat and did not work.  Added to that a huge glob of grease on the seat belt which ruined my white blouse I had on.  I went into the service bay and got [redacted] who is the one who said it was replaced and had just worked for him, this was another lie.  I am willing to return the truck to KDK for the amount of money I paid for it which was $17899.43 plus the $1063.37 I paid Sunny Side, plus the [redacted] repairs of $852.48 which equals $19815.28.  Auto Details said they will take the Brush guard, the door visor and the pipe step off for me but I cannot return them to get my money back, another words I'm stuck with them.  Shame on you KDK.  I needed a truck for work and you took my money and now I have a [redacted]gerous truck.  Buy the truck back from me.  If you back your product you would buy it back.   You sold me a truck knowing it had problems and was not safe to drive.   I would like my money back so I can buy another truck that runs and is safe.  You have tied my money and work for long enough.  Obviously  I wanted the truck, why else would I have had all this work done and added accessories to it.  KDK knowingly ripped me off.  By saying the truck is nearly 11 years old when its 10 years old does not change a thing.  I have a [redacted] that is 21 years old and still runs great, but an honest dealership sold me that one.  Just back your product that you sell, buy it back from me.  Even if KDK states I bought as is [redacted] still claimed they would fix it before I purchased it and even the service contract would not cover the truck.  I have all the receipts, texts, and proof [redacted] new what  he was doing when he purposely sold me the lemon. I am more than willing to go to court with the professionals from the other dealerships to get my money back.  This truck has not been driven because it is too dangerous to drive.
