I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below I disagree with Brian Kellys response to my complaintAfter KAK construction was paid and we began to have problems Brian did not return calls or messagesWe had no choice but to file a case against himThe court date on 6-28-was for KAK construction / Brian Kelly to plead guilty or innocent and go to trialThe hearing on 8-16-was "dismissed" because neither of us had council, the judge strongly encouraged us to appealIt was not thrown out, the judge was giving us another opportunity to recover our losses or for Brian Kelly to prove he wasn't in the wrongWe have agreed to allow Brian to have another contractor make repairs and drop this case against himOur proposal to Brian isYou hire another contractor to come remove and replace the wooden base cabinet cookwear drawers you made and used dollar sliders on that have crashed once and are to hard to pull out or are now stuck and useless, with rev a shelf wire shelving that was requested originally Replace the laminate skins around the counter top you installed that are coming offRepair the foyer floors grout that is crumbling daily or completely came outAnd to give us a year written guarantee on those item.Brian did send fellows here last week 9-7-to look at the floor, laminate and cookwear drawersBrian texted us the same evening after talking to the guys that he would have them replace the cookwear drawers, laminate skins and dig out all the grout on the floor and replace with a epoxy grout that would be flexible and move with the floorHe texted me that the crumbling grout in foyer floor was due to the floor moving and not his faultI've contacted several contractors and spoke to a professional at [redacted] and [redacted] that stated that it's the installers responsibility to make sure the underlying flooring is stable before installing tile I am hopeful that the repairs will be done properly this time and there are no further issuesSince the roof was only a verbal contract we have no choice but to hire someone else to finish the repairThe other issues are cosmetic and I suppose we can redo those our selfThis whole kitchen nightmare ordeal has been very stressful and going on since 3-12-16, we would like nothing more than to have it over and behind usWe are trying to have the house in good order before retirement next year.Regards, [redacted]

I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below That's great, but the tile has started to pop up that [redacted] fixed a few weeks back....something will have to be done about this issueKAK SOUOLD HAVE PUT DOWN SUBFLOORING UNDER THERE BEFORE HE PUT TILE DOWNHAD WE KNOWN THAT HAD TO BE DONE BEFORE WE PAID FOR THE WORK WE WOULD HAVE MADE SURE IT WAS DONE PROPERLY...THATS WHY WE HIRED A PROFESSIONALTHIS IS RIDICULES!

I Brian Kelly the owner of KAK construction finished the job for Mrs [redacted] and she has few things she wanted fixed before she paid, so I went back to the job and did a final walk through with her fixed what she has a problem with and she paid me the final balance on thw jobI never heard anything from her or her husband until I got court papers that she was suing me for the whole $6,it costed to do her whole jobThe first time in court the case was continued to August 26,On August 16, the case was heard and after thw judge heard both sides he threw the case out due to insufficient evidenceI have agreed to send a contractor over to fix the problems she has but I DO NOT see where I owe her more then thatHad she have made contact with me before going to file court papers that there was a problem I would have taken care of it

On September 7th Brian Kelly sent two contractors over to look at the three items that need redone the most and agreed to repair them(As stated a earlier response) he said he would let me know when he'd be moving forwardI texted him a question about the foyer process on September the 9th no responseOn September 16, days later I texted Brian again asking if he had any idea of when the work was going to beganHe answered right away and stated that he would contact the contractor in the morning (17th) and let me knowMy next message was today September saying "just wanted to let you know they are covered up, going to let me know when they can get over there" Keeping in mind that this job was started in early MarchThis photo is the current condition of a section of the tile, it has to be vacuumed daily as the grout continues to crumble

On September 29th I told Brian that we were going to have out of town company October 18th through the 23rd and didn't want work done during that timeI was told that everything would be done by thenBrian did say he would have to order the rev-a-Shelf as it wasn't in stock at Home Depot, but he was able to order it online and have it shipped overnight. KAK construction (Brian) sent a guy over to patch up the foyer floor tiles on Oct5th and 6th. While talking to the fellow doing the job he said he didn't know why there were issues with the floor at all since it had subflooring under itI told him they didn't put subflooring under there, that KAK put cement backer board over asbestos tileHis reply was "I'm only going by what Brian told me" my reply was "well Brian told you a lie he didn't put any plywood down" I'm thinking now that the new tile is popping because it was put down over loose tile to start withI guess we will see if it holds. He has yet to get the kitchen cookware drawers installed or the laminate edges replaced. October the 6th I asked if he would email me the new agreement he was drawing up so that We could have it looked over before we signed anything, I've gotten no response to that request yet. We are going into our 8th month with KAK on these issuesSo frustrating. Regards,

I disagree with Brian Kellys response to my complaint. After KAK construction was paid and we began to have  problems Brian did not return calls or messages. KAK construction (Brian Kelly) had [redacted] here yesterday installing the cook wear inserts. So far I'm happy with them, they look nice and are easy to pull out, they've been installed less than 24 hours and I haven't had time put any items in them yet. He didn't stain the boards that he used to frame it out but after I contacted Brian Kelly he had the stain here and that was taken care of right away.He ([redacted]) also removed the laminate skins around the appliance edges, and glued them back on, they look much neater/straighter and seem to be adhered much much better than they were.                       ---THE FOYER IS ANOTHER STORY--- The foyer floor that [redacted] ([redacted] [redacted])  repaired on Oct. 5th and 6th didn't work and the grout is crumbling again and tiles are moving. When I showed the floor to [redacted] yesterday when he came in with [redacted] he said that he told Brian he didn't think it was going to hold when he repaired it, but did what Brian told him to do. He contacted Brian and told him what was going on. Brian contacted me shortly after I told him I would be open to other options such as matching carpet that we just had installed in our downstairs or other flooring. After more discussion I learned he planned to put whatever product we agreed upon over top of this tile. I am totally against that. I will not allow them to put anything over this tile and I can't believe he's even suggesting it. There was already old tile down and he put the new tile over that. Brian continues to say, the floor is moving and it's not his fault, but I disagree since he is a licensed contractor and should have made sure the under flooring was stable before he tiled it. This tile needs to come up and be put back down properly. "I WILL NOT AGREE TO PUTTING ANY TYPE OF FLOORING OR CARPET OVER THIS TILE" when I told Brian that he huffed off and said "we are back to removing the existing grout and putting in epoxy grout"!!! and how "it's costing me more to fix the floor than what You paid me for the job"  My opinion, if it had been done right the first time we wouldn't be going through all this stress and aggravation for the last 8 months. I need this settled, we are going into the holidays and I sure like to be done with this mess.[redacted]
