Review: ON 2/8/16 WE SIGNED A CONTRACT TO HAVE A RAILROAD TIE WALL BUILT. HE SAID IT SHOULD TAKE ABOUT TWO WEEKS TO COMPLETE ONCE STARTED. TODAY IS 5/24/16 & THE JOB ISN'T DONE. HIS WORKERS DUG UNDER OUR DRIVEWAY & IT IS IN DANGER OF CAUSING A MAJOR PROBLEM BECAUSE I MUST BACKOUT OVER IT TO GET OUT OF OUR GARAGE. HE RAISED THE PRICE BY $3500 FROM $8860 BECAUSE HE NEEDED TO BUY MORE SUPPLIES. NOW HE ISN'T DOING THE JOB BECAUSE HE AGAIN WANTS MORE MONEY TO FINISH THE JOB. ALL OUR STORM DRAINS ARE DISCONNECTED. THE JOB IS NOT NEAR DONE. ALL THE DIRT THAT IS IN MY NEIGHBORS DRIVEWAY IS ALSO TO BE TAKEN TO THE BACK OF OUR HOUSE TO FILL A HOLE. THIS IS ALL IN THE CONTRACT. HE NEEDS, I WOULD THINK ,ABOUT SEVEN CUBIC YARDS OF 2B LIMESTONE TO BACKFILL THE TIE WALL HE LEFT EMPTY. I THINK WE HAVE BEEN TAKEN ADVANAGE OF & HE'S JUST WALKING AWAY FROM EVER DOING AS THE AGREEMENT STATES.Desired Settlement: FINISH ALL THAT HE SAID HE WOULD DO IN A TIMELY MATTER.

Response:

June 16, 2016Revdex.com[redacted]RE: [redacted]ID# [redacted]Dear Ms. [redacted]:This letter is in response to your letter dated June 9, 2016 regarding above mentioned consumer complaint that was filed against us by Mr. [redacted].The weather in February 2016 was a factor in the length of time for the job, Keith K[redacted] Construction was only contracted to build one wall for Mr. [redacted]. After dealing with [redacted] Township and our engineering firm, they requested that a second tier be placed below the top of the wall for added upper wall strength. This was decided because they did not want one wall to be too high and unstable.Naturally, to add a second wall that was twice the size of the upper wall, additional costs were going to be incurred. The additional wall is three times the size of the upper wall. Mr. [redacted] wanted this done for the original wall price. Actual job price should have been $23,000. Original contract price was $12,360 and so far we have only been paid $11,160. He advised he had no more money to give us, but yet they had a very large tree removed. We will go back out for the cost of $4,200.With regards to the driveway, the three concrete pads were split in half due to the faulty wall. We jacked up the pads in order to repair them. We also attached a split wall fence on the top wall. All of Mr. [redacted]'s storm drains are connected. His old ones were bad.In conclusion, there was no mention of two walls in the original contract. The job changed. Nothing about a fence on top and no mention of machinery time to fill in his two ponds with dirt up in the back. So you see, the contract changed. There were many extras. When trying to reason with Mr. [redacted], his ' voice overpowered you because he was still trying to squeeze us for the original price. People say go ahead and do it for the extras, sometimes they pay and sometimes they don't. It is not always the contractors fault.Keith K[redacted] Construction has been in business since 1972. We are reputable, insured and PA licensed. We also pay our crew, I have no idea where Mr. [redacted] came up with That. Our crew will not work for free and neither will we.Sincerely,Keith K[redacted], Project Manager
