Keller Construction

Review: We entered into a contract with Keller construction in May and the project started in May. The contract is for a kitchen remodel, carport. shed , laundry room, and a front and back patio patio with wrought iron railings. We paid the deposit and they started out great.All this was suppose to have been done within 30 days. As we got to know [redacted] better my partner decided to pay him in full for the job. We paid him over $20,000.00 to do these projects. They started the construction and things were going great he had a crew of people coming and doing what they were suppose to do. Shortly after paying [redacted] in full his wife left him and he needed some time to deal with it and we were ok with that. After that he started sending one guy a day to work on our projects. Shortly after that he started having money problems and asked if he could take a week to get some money together to complete our projects we said that was cool. Then he sent one guy a day and some days no one would show but [redacted] would call us and let us know when this was going to happen. Shortly after that [redacted] stopped communicating with us altogether so I sent him a letter that stated since we have not heard from you for over a week now we are feeling like we are being ripped off and I gave him 2 options since we were beyond the contract date and told him that he 2 choices to either come and finish the work within 2 weeks or compensate us $5000.00 so we could hire some one to finish the job that we paid him for. I emailed this letter to him on 7/20/14 and his response was that he would show up next Thursday or give us $500.00 to get out of the contract. We told him to show next Thursday. Since then he has texted us over and now is telling us we owe him over 3000.00 for extra work that he has done. first off we wouldn't have had to do extra work if the job had been done right. I now have not one project complete but the carport and a a lot of bad work from his crew. I want this corrected and completed but cant deal with him. Pls help.Desired Settlement: I now want $5000.00 to get the work done. I will not pay him any extra money for the so called extras that he has done. I invite you over to see the concrete that he has laid for us in the front yard and tell me if you would accept this kind of work. I want things done professionally since I hired a contractor to have this done professionally. I want the kitchen fixed and completed, my railings installed,shed completed and my laundry room built. He has completed nothing but carport.

I had a feeling this was going to be said I have copies from a facebook conversation where [redacted] claims at that time that we owe him money and the whole time he was at my home he never once gave us an invoice or mentioned anything about being charged more than what we paid him which was over 20,000.00 to do a job that he never completed. [redacted] was asked if the contract that we have was all the money that we would need to give him and he replied that it would be no more than what was on the contract. The only time that [redacted] brought up us owing him anymore money was after He didn't communicate with us as to what was going on and I sent him a letter giving him two options that he either complete the job or give us 5000.00 to complete the job and then that's when all of a sudden we owed him money and since then I have amended that amount to the full 20125.00 due to the fact that the work that he did do is not complete and is wrong he didn't get the permits required to do the job correctly and if you could see the work that he has done to the front of my home you would want your money back also. He is correct this is gong to the cslb and to whomever will help me get my money back or the job done correctly. I would never recommend to anyone to use this company ant all . I don't and will not pay this man or his company another dime to mess things up. the things that he is claiming that we owe him for is his fault He says one is for plumbing in my kitchen well let me say this he is the contractor so why didn't he measure correctly so the pipes wouldn't have had to be moved???Why didn't he get a permit also for the kitchen remodel? I went to the city of tracy and found that this man has done a lot of illaegal things to my home and has devalued my home instead of making it worth more in fact we never agreed to have him do anything more than what was on the contract. If he did more than what he was paid for its on him. He never not once asked or told that we would owe him anything for anything. In fact how could we owe him money when none of the jobs that are on the contract are not done but 1. Let me tell you why cause he took our money and spent it before so he had no way to buy materials to finish the job. I don't understand how we can owe him any money when there was never an agrrement between us and him for any money in fact if he would have said that it would cost us more we would have told him not to do it due to the fact that the money that was paid to him in full came from us refinancing our home and we have no other money to give him and he knew that.. In my opion this man is not a contractor he is a conman.

I am rejecting this response because: He has been paid in full and he could have avoided all of this if he had just communicated with us like the letter states instead he now says that we owe him more money which we don't I have the cancelled checks that he has cashed and spent and did not complete the job that was contracted to do. I do have pictures of his work and the mess that he has left behind. He still to this day has not responded to the cslb or to us. I did send him a certified letter which was returned to us due to the place of business being vacant with no forwarding address. I do think that this man needs to be investigated to the fullest due to the fact that in my opinon he has done this before I can read between the lines if you look at [redacted] the major portion of his comments are from when you first meet the man not when the job is completed and the comlpaints or comments that are on there he has an excuse just like he is telling us. So yes n my opion this man is a con artist and a liar. And yes in my opion he did steal our money. If he thinks he will be paid more for any work that he has done he is wrong the work that he has done is horrible like I said I have pictures to prove it and once again I invite any representative to my home to see what he has done and what he has not done.
