I knew there was a monthly HOA fee and that was never in contention, it was the initial $1,HOA time fee that Janique knew about and because of her ethical standing, did not provide this to me. Her sellers even had to pay a $fee to move and they also paid a similar feeto my point exactly with the document she sent there is NO mention of the one-time 1,fee from the HOA. That is what I am contesting, no the monthly. I found out about this AFTER I paid the home inspectors and gave notice for my apartment lease and could not retract. I never received this from her or KW either, it came from the HOA when they sent over the paperwork, but by then I was already too invested into this process. I can't tell you how disgusted I am with how she does business and if I could I would try to have her license suspended. Below is what I had sent to someone at Keller WIlliams and now I got the correct name at Keller Williams to go to as well, but Janique has not done this transaction ethically and I will do everything I can to make sure she does not "knee" cap another poor buyer or seller. "This is the serious issue and the one that I need to take action onJanique has supposedly been doing this for years and is "one of the best under 40," or at least she received enough votes from family and friends to give that senseThis best "under 40" decided not to put the $1,initial HOA fee that is needed to be paid on trendActually I did not know about it until AFTER my home inspection and spent money, which was non-refundable, and the HOA sent the resell papersI would NOT have purchased the house, I am renting and had extra time to keep searching or at least I would have negotiated more on the back end from the sellersI am a first time home buyer and from what I was told ALL financial expenses need to be presented upfront without being witheld and this was not the case and has put me in a not so good situationI was completely mislead and honestly I wouldn't of even gone to see the house if there was a $1,initial condo/townhome fee (I actaully passed on a few houses because of those fees, which were much less)There are damages here and I plan and pursing it to the best of my ability"

Please confirm receipt of this email.Thank you, Janique C***To Whom It May Concern: I received a notice from the Revdex.com that *** *** *** entered a complaint regarding his recent experience purchasing his first home at ** ***, Chalfont, Pa. The complaint states that *** *** was not aware of the of the one time capital contribution fee from the Home Owners Association and therefore requesting $which is one half of the total amount. During this transaction, I represented ONLY the sellers which included listing, marketing, and selling their home. My fiduciary responsibility as a realtor is to represent the seller and disclose all information that I am given or any information that I may know about the property which I did. During every real estate transaction, the seller is required to submit a document called the "seller's disclosure" (see attached document signed by *** ***). The sellers were not aware of any capital contribution fee for the association and marked it "unknown" on the sellers disclosure document. After receiving the signed sellers disclosure agreement, I then forwarded via email to the buyer's agent prior to the buyer's offer. Since *** *** states in his complaint that he had already refused several properties due to this type of fee, I find it surprising that he would not have questioned his agent regarding home owner association fees. Furthermore, since I never had any contact whatsoever with *** ***, why wasn't his agent doing her due diligence and checking with the Home Owner's Association regarding ALL Fees before submitting an offer. As a listing agent, who represents the seller, my job is to order the Home Owner Association docs for the buyer once the home is under contract. These HOA docs discloses all information regarding the associations rules and budgets. The buyer is supposed to review these documents. The buyer has a right to terminate (or negotiate) the agreement due to the rules of the association, capital contribution, etcFor example, if a buyer has a lbdog and received the HOA docs during the transaction that says he can only have a lbdog or less in the community, he would have to terminate the agreement or find a home for his dog. This is why these documents are given before the purchase of the property due to the rules and budgets changing all the time in a Home Owner's Association. The Buyer's agent or the buyer NEVER indicated during this transaction that there was any dissatisfaction regarding a capital contribution and NEVER asked to negotiate with the seller or tried to terminate the contract. Even though I can sympathize with *** ***'s inexperience with his real estate dealings, I can take exception to his unsubstantiated remarks regarding my ability and reputation as an ethical real estate agent. I did my job correctly. It was both he and his agent who did not read the Sellers Disclosure and Home Owner's Association document they are required to read which inadvertently cost *** *** the capital contribution fee. My suggestion to *** *** is simple: Contact your agent and express your frustration to her, not me! Furthermore, if *** *** continues to slander my name and reputation, I will seek legal counsel to remediate for damages.
