June 26, 2017Dear Sir,I am in receipt of the complaint filed by the buyer of the home that Keller Williams had listed and the buyer purchased,There are several issues here to discussWe are the Seller representative, not the Buyer representative.No decisions are the result of Keller Williams Realty Group agents; all terms of the agreement are negotiated between both buyer and seller and are in writing.Carol was beside herself that the seller was not going to be ready to vacate the property and notified all involved as soon as she was made aware, she of course told the seller that they signed a contract with those terms and the seller told her there was nothing they could do and requested Carol notify the Buyer's agent to see how the buyer wanted to proceedCarol at no point in time told her sellers they did not need to be out of the property on day of closing, and the Agreement of Sale signed by all partiesclarifies just that.The Buyer had options at the time, to work something out with the seller that they were comfortable with, or terminate the contract if they could notThe buyer and their agent agreed to the post Settlement possession addendum which is signed by all parties agreeing to the termsAs far as the key that was between the buyer and seller, as the seller was at that point a tenant of the buyers, Their agent was responsible to make sure that the buyer understood the terms of the agreement that they were signing.Keller Williams was not a property manager and not responsible for disbursement of keys.The buyer had a home inspection and the buyer himself stated in his complaint that there was a patch that was noticeable, the buyers home inspector would have noticed that and questioned it at that point, we are not aware of any such patching, the drain he is referencing sounds to me like the drain installed on any washing machine to get rid of the water produced during the washing cycle.As far as contacting the mortgage company, Carol was speaking with the lender to see what options are available so the deal did not fall through, and make sure the buyers rate would not expireShe in no way made any demands and was gathering information to protect her client.As far as new construction across the street, would again refer the buyer to their agent who is responsible to inform the buyer about the property and any surrounding propertiesWe are responsible to represent the property as the seller presents it to us, and any blatant or noticeable defects in or on the propertyThe property land across the street has been sold for quite some time and was just sitting thereHowever as a buyer agent would have investigated what is going on a large vacant parcel; our agents are trained to always check on surrounding vacant properties and to represent the best interest of their clientsAgain we are the seller agent in this transaction, believe the buyers complaints here as represented are focused in the wrong direction, and should be focused to their agent.Thank you and trust this explains the course of events and displays that Keller Williams did the job that they were contracted to perform.Thank you, Terese BBroker Owner,
