***In response to the above complaint, *** *** purchased a Ford Explorer on August 21, 2016. The vehicle was sold 100% AS IS and without a warranty. I have attached a copy of the Buyers Guide, Acknowledgement of AS IS Sale and the We Owe document, each of which
was signed by Ms***. Please note Ms***’s initials on the Buyers Guide next to the statement that reads:“YOU WILL PAY ALL COSTS FOR ANY REPAIRS. The dealer assumes no responsibility for any repairs regardless of any oral statements about the vehicle.”Ms*** contacted us on August 28, 2016, and let us know that she had a mechanical issue with the vehicle while out of town. She had it repaired but brought it to us on September to check a light that was coming on after her repair was done. As a goodwill gesture, we repaired the wheel speed sensor free of charge. This fixed the problem. While doing this repair, our technician noticed a slight coolant leak. We replaced the water pump, thermostat housing and bled the coolant system, again free of charge to the customer. We were under no contractual obligation to assist with any repairs but did so in the interest of good customer relations. When Ms*** picked up the vehicle it was in good mechanical condition. We were never contacted again by Ms*** about any repair issues and we do not believe that she experienced any further mechanical issues. I checked with Midwestern Auto Finance, the lien holder for this vehicle, and they confirmed that Ms*** never mentioned any additional problems with the vehicle. I was told that she stated the vehicle was purchased for her niece and that her niece was supposed to make the payments. She called Midwestern Auto Finance on multiple occasions to see if her niece was making payments and she was advised that the account was delinquent. Ms*** indicated that her niece went to Tennessee and was supposed to return to Ohio but decided to stay. After continued delinquency, the vehicle was repossessed on October 6, 2016. Ms***’s niece called MAF on the date of repossession and inquired about redeeming the vehicle. She said she was working in Tennessee and didn’t think the vehicle would be repossessed out of state. It was clear that she was driving the vehicle and wanted it back. She was advised that the account holder would have to inquire about redeeming the vehicle. When Ms*** called in, she was clear that she no longer wanted to be responsible for the vehicle. Instructions were sent to her via certified mail in case she decided to redeem.Ms***’s niece put 5,miles on the vehicle is just over six weeks. The vehicle was being driven in Tennessee and was not broke down. We performed goodwill repairs for the customer and the vehicle was in good operating condition. The finance company repossessed the vehicle only after many attempts to work with the customer. Repossession was the last resort after Ms*** failed to honor the contract.Please feel free to contact me if you require additional information. Ms*** purchased her vehicle on March 15, 2017. The vehicle was sold 100% AS IS and without a warranty. She was given as much time as needed to check out the vehicle to her satisfaction and it was clearly explained to her that the vehicle was sold AS IS and without a warranty. I
have attached a copy of the following documents, all which were signed by Ms*** and which clearly explain that the purchaser is responsible for any repairs: Buyers Guide, We Owe and Acknowledgment of AS IS Sale.Ms*** provided us with a receipt on 4/24/for $for a battery she purchased from ***. Even though the vehicle was sold AS IS, she was given a goodwill discount for this amount. It was explained to her that the discount was a courtesy and she would be responsible for any future repairs. Ms*** purchased her vehicle almost seven months ago and is responsible for maintenance and repairsThis vehicle is financed with *** Auto Finance. I spoke with the manager and he stated that Ms***’s account is $past due but they’ve continued to work with her. He also added that they received a notice from ESURANCE that her insurance policy has cancelled which is a serious violation of her contract and needs to be updated immediatelyPlease contact me if you require additional information. [redacted] purchased a 2007 Jeep Cherokee on October 31, 2016.  Before signing any of the sales documents he was asked if he test drove the vehicle and if everything was satisfactory.  He confirmed that he did drive it and everything was okay except that he was told we would set up a...

service appointment to check the serpentine belt.  He was asked if he wanted to go ahead with the paperwork and he responded yes.  It was clearly explained that the vehicle was sold 100% AS IS and without a warranty.  I am attaching the Buyers Guide and Acknowledgement of AS-IS Sale, both signed by Mr. [redacted], which clearly explain that the purchaser will pay for any repairs. Since we promised to check the serpentine belt, we wrote on the WE OWE document that a service request would be made for this account.  We kept our promise and replaced the serpentine belt on November 15, 2016. Mr. [redacted]’s complaint states that we knew the truck had issues and he had to replace the battery, starter and ignition switch.  There would be no way for us to predict that these repairs would be required.  He stated that the truck wouldn’t go over 35 mph but he test drove the vehicle and clearly wouldn’t have bought it if that was case.  Additionally, he put over 3,000 miles on the vehicle which makes it unlikely that the vehicle wouldn’t drive over 35 mph.  He also claimed that the dash was taken apart and the bulb removed from the instrument lighting which isn’t something we would have done.  Mr. [redacted] dropped his vehicle off to our lot on February 18, 2017, and stopped making his payments.  As per the contract, he was responsible for the maintenance and repairs.  He defaulted on the contract and advised the finance company that he wasn’t going to pay on a vehicle that he wasn’t driving. Mr. [redacted] was given an option of trading to another vehicle which would have required that he pay the tax, title and fees at the time of the sale but he declined.  He was sent a notification of repossession and instructions to redeem the vehicle by Certified Mail on March 6, 2017.  He never redeemed the vehicle. Mr. [redacted] defaulted on the contract.  We are still willing to trade him into another vehicle and would give him a trade allowance of what he invested in the Jeep minus the sales tax that was paid.  He would still need to pay the tax, title and fees on the new vehicle at the time of purchase. 1 hour ago[redacted]Raymond from Kellie's Auto Sales called and said that they would fix my 2010 Ford Expedition for free since I had not had it that long. I agreed. Then they said that I owe $1000 dollars after someone from there named Chris called and said he would reconstruct my payments for the next 3 months for the vehicle not working properly. Now today 11/07/2017 I have talked with a woman named Johana and she said that not only do I owe the past payment amount to get my vehicle back but I also owe for the repairs that Raymond said were free. He consequently is unvailable to talk. These people are scam artists. Please I just want to be out of this loan!!! These people are scamming and charging without consent to fix my vehicle.

I am rejecting this response because: This is completely NOT true!!! Plus they didn't even mention when the gentlemen came outside and promised to fix the GPS camera system! This business should be ashamed of their self and everyone should know they don't abide by their words!! My complaint was not resolved due to they did say tires and they did say GPS and back up camera...

[redacted] purchased a 2004 Dodge Durango on February 17, 2018.  She was given the opportunity to test drive and check out the vehicle to her satisfaction and at all times it was explained to her that the vehicle was being sold 100% AS IS and without a warranty.  I have attached a copy of...

the Buyers Guide, WE OWE and the Acknowledgement of AS-IS Sale.  Please note Ms. [redacted]’s signature on each document and her initials on the Buyers Guide next to the statement that reads: “AS IS-NO WARRANTY.  YOU WILL PAY ALL COSTS FOR ANY REPAIRS.  The dealer assumes no responsibility for any repairs regardless of any oral statements about the vehicle.” Each document reiterates in very clear language that the vehicle is being sold without a warranty and that the buyer will be responsible for any repairs.  Ms. [redacted] signed each document freely, indicating her understanding and agreement. At no time did we tamper with the vehicle’s computer as stated in the complaint.  Also, please note that we were never advised by Ms. [redacted] of any transmission issue until March 21st, over a month later and the same date she filed her complaint, not two days after her purchase as the complaint implies.  Please feel free to contact me with any questions.  Thank you for your assistance with this matter.

In reference to the above complaint, the vehicle Ms. [redacted] purchased was sold 100% AS IS and without a warranty.  She wrote in her complaint that she “stated the issues that caught my attention before signing my contract”.  Please note that before she signed anything it was clearly...

explained to her that the vehicle was sold AS IS and nothing was promised to be repaired and she went on to sign the following documents: Buyers Guide, WE OWE and Acknowledge of AS IS Sale.  Each of these documents reiterates that she is responsible for any repairs.  A few weeks after purchasing the vehicle, Ms. [redacted] brought several receipts for a battery she had to replace.  She was given a good will credit for the amount she spent.  It was explained that the credit would come off the account balance but that she would have to make the regular scheduled payments.  The vehicle is financed with [redacted] Auto Finance.  I reviewed this account with the manager and he did not agree that there was a payment arrangement.  Ms. [redacted] stated that in the end of June she made an arrangement to start paying $150 biweekly instead of $125.  She did make a payment of $150 on 7/5/17 but did not make another payment until 8/4/17.  If she did have an arrangement then she clearly breached it by waiting a month to make another payment instead of two weeks as per her agreement.  In regards to her receiving reminder calls for her payment, please understand that these are courtesy calls and are intended to help the customer.  The only other option for delinquent accounts is repossession and the finance company makes every effort to avoid this option. In an effort to assist Ms. [redacted], the manager has agreed to allow her to pay $125 biweekly as scheduled on her contract.  The account is past due but as long as Ms. [redacted] sticks to the schedule they will continue to work with her.  She will need to make a payment within 5 days.  Her account has been noted and any questions can be directed to her account manager, Angelica.

This complaint was resolved and the transaction was rescinded on February 17, 2016.  Please contact me if you have any questions.  Thank you!

The lien holder on Ms. [redacted] vehicle is Midwestern Auto Finance.  I spoke with the Manager and he confirmed that her vehicle was repossessed because the account was delinquent.  She made a commitment to pay on 2/15/17 and didn’t keep the arrangement and then missed multiple payments....

 She was called on eight different days and did not return any of the messages.  The purpose of the calls was to work with her to avoid repossession but her failure to communicate left no other option.  She was provided with instructions to redeem the vehicle and Midwestern Auto Finance was more than willing to work with her to get her vehicle back.In regards to the repossession, the vehicle has minor body damage and a claim was filed with Ms. [redacted] insurance by the finance company.  They are named on the policy and have a right to have the vehicle repaired.  Ms. [redacted] states that the vehicle was damaged by the repossession company but that is in dispute.  The insurance adjuster is investigating and will make a determination soon.In summary, Ms. [redacted] defaulted on the contract.  Many good faith attempts were made to contact her but she wouldn’t respond.  She is welcome to make contact if she would like to redeem the vehicle or needs more time to redeem.Please feel free to contact me if you require additional information.  Thank you for your assistance with this matter.Sincerely,Anne P[redacted]Office Manager

The title, with the lien cancelled, was mailed  today via US Postal Service Certified Mail.  It was mailed to Mr. [redacted] at [redacted], Fredericktown, Ohio 43019.  The tracking number is [redacted].  I anticipate he should receive it by the weekend. ...

promise to replace a wheel bearing and detail the vehicle, which was documented on the “We Owe” sheet.  The We Owe also clearly states that “customer will take care of anything else”.  I have attached the following documents for your review: The Buyers Guide, We Owe Sheet and Acknowledgement of AS IS Sale, all which were signed by Mr. [redacted] and which explain in very clear terms that the vehicle is sold AS IS, without a warranty, and that the buyer is responsible for any repairs.   I have also attached a copy of the receipt showing that we purchased the wheel bearing on August 3, 2016.  The repair and detail was completed on that day.Please review the attachments and let me know if you would like any additional information.  I believe you will find the documents to be very clear and that we completed the repair we promised.  Thank you for your assistance with this matter. Sincerely,Anne P[redacted]Office Manager
