The lien holder on Ms [redacted] vehicle is Midwestern Auto Finance I spoke with the Manager and he confirmed that her vehicle was repossessed because the account was delinquent She made a commitment to pay on 2/15/and didn’t keep the arrangement and then missed multiple payments She was called on eight different days and did not return any of the messages The purpose of the calls was to work with her to avoid repossession but her failure to communicate left no other option She was provided with instructions to redeem the vehicle and Midwestern Auto Finance was more than willing to work with her to get her vehicle back.In regards to the repossession, the vehicle has minor body damage and a claim was filed with Ms [redacted] insurance by the finance company They are named on the policy and have a right to have the vehicle repaired Ms [redacted] states that the vehicle was damaged by the repossession company but that is in dispute The insurance adjuster is investigating and will make a determination soon.In summary, Ms [redacted] defaulted on the contract Many good faith attempts were made to contact her but she wouldn’t respond She is welcome to make contact if she would like to redeem the vehicle or needs more time to redeem.Please feel free to contact me if you require additional information Thank you for your assistance with this matter.Sincerely,Anne P***Office Manager

I reviewed the response made by the business in reference to complaint ID [redacted] , and find the resolution is satisfactory to me

[redacted] purchased a Dodge Durango on February 17, She was given the opportunity to test drive and check out the vehicle to her satisfaction and at all times it was explained to her that the vehicle was being sold 100% AS IS and without a warranty I have attached a copy of the Buyers Guide, WE OWE and the Acknowledgement of Sale Please note Ms***’s signature on each document and her initials on the Buyers Guide next to the statement that reads: “AS WARRANTY YOU WILL PAY ALL COSTS FOR ANY REPAIRS The dealer assumes no responsibility for any repairs regardless of any oral statements about the vehicle.” Each document reiterates in very clear language that the vehicle is being sold without a warranty and that the buyer will be responsible for any repairs Ms [redacted] signed each document freely, indicating her understanding and agreementAt no time did we tamper with the vehicle’s computer as stated in the complaint Also, please note that we were never advised by Ms [redacted] of any transmission issue until March 21st, over a month later and the same date she filed her complaint, not two days after her purchase as the complaint implies Please feel free to contact me with any questions Thank you for your assistance with this matter

[redacted] - [redacted] purchased a Cadillac STS on July 30, He was given the opportunity to check the vehicle out to his satisfaction and was provided with a Carfax report It was clearly explained to Mr [redacted] that the vehicle was being sold 100% AS-IS We did promise to replace a wheel bearing and detail the vehicle, which was documented on the “We Owe” sheet The We Owe also clearly states that “customer will take care of anything else” I have attached the following documents for your review: The Buyers Guide, We Owe Sheet and Acknowledgement of AS IS Sale, all which were signed by Mr [redacted] - [redacted] and which explain in very clear terms that the vehicle is sold AS IS, without a warranty, and that the buyer is responsible for any repairs I have also attached a copy of the receipt showing that we purchased the wheel bearing on August 3, The repair and detail was completed on that day.Please review the attachments and let me know if you would like any additional information I believe you will find the documents to be very clear and that we completed the repair we promised Thank you for your assistance with this matterSincerely,Anne P***Office Manager

hour ago [redacted] ***Raymond from Kellie's Auto Sales called and said that they would fix my Ford Expedition for free since I had not had it that longI agreedThen they said that I owe $dollars after someone from there named Chris called and said he would reconstruct my payments for the next months for the vehicle not working properlyNow today 11/07/I have talked with a woman named Johana and she said that not only do I owe the past payment amount to get my vehicle back but I also owe for the repairs that Raymond said were freeHe consequently is unvailable to talkThese people are scam artistsPlease I just want to be out of this loan!!! These people are scamming and charging without consent to fix my vehicle

The title, with the lien cancelled, was mailed today via US Postal Service Certified Mail It was mailed to Mr [redacted] at [redacted] **, Fredericktown, Ohio The tracking number is [redacted] *** I anticipate he should receive it by the weekend Please don't hesitate to contact me with any questions I can be reached [redacted] x Thank you!

In reference to the above complaint, the vehicle Ms [redacted] purchased was sold 100% AS IS and without a warranty She wrote in her complaint that she “stated the issues that caught my attention before signing my contract” Please note that before she signed anything it was clearly explained to her that the vehicle was sold AS IS and nothing was promised to be repaired and she went on to sign the following documents: Buyers Guide, WE OWE and Acknowledge of AS IS Sale Each of these documents reiterates that she is responsible for any repairs A few weeks after purchasing the vehicle, Ms [redacted] brought several receipts for a battery she had to replace She was given a good will credit for the amount she spent It was explained that the credit would come off the account balance but that she would have to make the regular scheduled payments The vehicle is financed with [redacted] Auto Finance I reviewed this account with the manager and he did not agree that there was a payment arrangement Ms [redacted] stated that in the end of June she made an arrangement to start paying $biweekly instead of $ She did make a payment of $on 7/5/but did not make another payment until 8/4/ If she did have an arrangement then she clearly breached it by waiting a month to make another payment instead of two weeks as per her agreement In regards to her receiving reminder calls for her payment, please understand that these are courtesy calls and are intended to help the customer The only other option for delinquent accounts is repossession and the finance company makes every effort to avoid this optionIn an effort to assist Ms [redacted] , the manager has agreed to allow her to pay $biweekly as scheduled on her contract The account is past due but as long as Ms [redacted] sticks to the schedule they will continue to work with her She will need to make a payment within days Her account has been noted and any questions can be directed to her account manager, Angelica
