This project was wrongly stated from the beginningi email the contract to the customer [redacted] made changes to the contract with out my consentHe wrote in the contract that the soil under the deck was to be remove leave head room of feet I signed the contract not realizing the changes that he made He expect me to clear feet wide and feet of dirti do not agreed to do thatmy job was to demolition the existing deck and build a new deck, clear the cement under the deck and install pavers this cause a serious dilemma with the job and the cost to complete cost for the initial removal of soil under the deck as well as removal of all the large rocks to start the preparation for digging the holes for the deck replacement: cost of labor: $ cost to rent Backow machine: $ initial cost to start demolition: $4250customer was not satisfied and made request to remove soil even more The contractual agreement state: “ clear and level the dirt/gravel on the right side underneath the deck the same as the left side The problem is that the left side of the deck is inches lower than the right side So although the dirt/gravel was leveled the usable space on the left side was approximately ½ feet The customer insisted that I dig further down to create an feet over head room The additional cost for all this work was not in the budget and has incurredI was paid a total of $47, The expenses that incurred as follows: A portion of my estimated profit of the job being done $Initial demo and removal of concrete and debris $4250The second excavating, removal of soil, redistributing the surface ground Area of the deck: Rental of Beckow machine for one week: $ Labor cost for additional excavating: $6700Additional payment for labor spreading the soil by the garage in the back $ The cost for inspection permit: $ The cost for digging footing and framing of deck(pass inspection) $8500The cost to purchase the AZec decking $9800The cost to install Decking $2800Running electrical wire to the garage (not connected) $450The cost of retained wall $The cost of Blue stone stairs $ The total expenditures to date: $45, Less total amount given to date: ( $47,400) Balance remaining: $1,510The additional cost that incurred and was not paid for is $8, This amount is due In order to pay for the railings for completing the deck when I first gave my quote to replace the deckThey insisted that I dig down further to create that space I told them that will cost them much more and they argued with me that this work was included in priceThe reluctantly remove the soil which was very costly other problems : Problem I had more disagreements with the customer After the plan where approved by the town pertaining to how many post will be installed, the customer decided they want to change it to allow more view while under the deckThey were very difficult people that are use to getting what they want I told them several time that this project has gone over budget, they basically said that is not m their problem and I have to do the job because its under contract I ask for $more and they grant it with condition that is must finish the job in two week and if I don’t it will be $per day for every day late I reluctantly signed because I needed the money and truly believe that the could do the job Unfortunately my framer disappeared for two weeks and I had to get and other framer to complete the job additional delays: part of the deck design has a curveA special machine to bend the planks to make them fit The Machine at Huston Lumber was not working which further delayed the job In my frustration and realization of this project I realize that I greatly under estimated ll us why here

Complaint: [redacted] I am rejecting this response because: Mr [redacted] response is full of lies, omissions and untruths consistent with his behavior during and after he walked off the project Attached is a copy of both contracts which Mr [redacted] and I walked thru line by line I had to document most of it to ensure we had something documented as Mr [redacted] often would say /agree to something only to change afterwards None of the items on the contract were completed and many not even started (ie fascade around kitchen and foyer entries to the deck and replacement of the bathroom window, waterproofing under the deck) The original contract specifies excavating underneath the existing deck to create a usable area that people could gather and sit During the initial dig Mr [redacted] miscalculated and did not account for the additional depth needed to install the pavers Taking that into account even I at 5'would not be able to walk underneath the deck which was the purpose in the first place He charged us another 5,which we agreed and paid him forAs part of that contract we asked him to specify a date that he would finish He specified Sept (weeks from when he signed)and he assured us he would likely be finished before thenThe financial cost numbers Mr [redacted] provided are meaningless One of his subs contacted us directly to say that he had not been paid During the project Mr [redacted] also claimed that the railing were being delayed When we contacted the lumber yard directly they told us that they had the railing and were waiting for payment In addition we learned what he had ordered was a different brand than what was in our contract as it cost lessAnother example of him make unilateral decisions to save cost despite being different than what we had agreed For the decking we had agreed and he had assured us he only installs the planks using side brackets He then proceeds to install them with screws on the facing which we explicitly did not want When we confronted him he first claimed they didnt make it for that style Only when we challenged him did he admit he made the decision by himself As further examples of Mr [redacted] character he on multiple occasions agreed to repay a portion (28,000) of the funds I paid him (47,400) as reparation only to repeatedly back outThere are endless other issues with the work, his behavior and the workers he used on the job Unfortunately we were not able to reach a resolution We are now pursuing legal action Mr [redacted] can contact me directly for reparations or my lawyer Tim Tuttle Esq My intent for coming to Revdex.com is to provide warning to potential new clients Regards, [redacted]
