I am in receipt of Mr***'s complaint and attempted to attach the contract files however they were too large and would not go throughI will be happy to mail them to you if you need themMr [redacted] is correct in that the contracts did not specifically state that either contract was contingent on them selling their homeHowever, section of both contracts were specific to the buyer being able to secure financing to purchase the home and provide a loan commitment from a lender acknowledging that the buyer could obtain finacing to close on the homeAfter roughly months of working with multiple lenders it became apparent that due to qualifying ratio issues and insufficient down payment to support a loan that financing was not going to be possibleRockford refunded all of their deposit money and cancelled the contractsRockford is in the business to build and sell new homes and we make every attempt to make that happen for our customersWe cannot however build a home when we know the buyer cannot close on the propertyIf the ***'s situation changes we would very much enjoy the opportunity to work with them Sincerely, [redacted]

Our service department was first notified of the problem on August 26, Since this is a condominium and it was purchased nine years ago, the service request had to go through the *** Condo HOA The HOA will have someone address the problem

However, section 3 of both contracts were specific to the buyer being able to secure financing to purchase the home and provide a loan commitment from a lender acknowledging that the buyer could obtain finacing to close on the home. After roughly 9 months of working with multiple lenders it became apparent that due to qualifying ratio issues and insufficient down payment to support a loan that financing was not going to be possible. Rockford refunded all of their deposit money and cancelled the contracts. Rockford is in the business to build and sell new homes and we make every attempt to make that happen for our customers. We cannot however build a home when we know the buyer cannot close on the property. If the [redacted]'s situation changes we would very much enjoy the opportunity to work with them.

Rockford disagrees with the consumer. The terms of the Purchase Agreement are clear. Rockford will take no further action in this matter.

As you can see from the attachment it has nothing to do with the financing or selling our home. the bottom line is they wanted us to switch lots and we did not want to.
We decided to go with a different lender and a builder.
