Review: John CR Kelly Realty has withheld my security deposit more than 30 days after I vacated the unit. This is in violation of Pennsylvania's Landlord and Tenant Act of 1951 Section 250.512.Desired Settlement: Return my deposit of $525 or I will be suing for 2x the amount allowable under law.

Review: I rented an apartment from Kelly Realty at [redacted] I had vacated the apartment on October 26 2013 as my lease ended and I handed over the possession of the apartment accordingly before 26th October. I paid them $ 620 as a security deposit when I moved in the apartment. I got a letter from them stating I owe them 2200$ for serious damages that they claim. I have in my possession pictures taken at the time I was vacating the apartment and I cleaned the apartment before I vacated. I made sure all the applances are in a working condition. They said in the letter that they had to replace the stove , fridge , carpet and charged me a lot of money for this. I checked with a colleague of mine who also rented an apartment with Kelly realty and they gave him a similar letter that I received. So I am sure this is some kind of a scam that is being run by this company. When I called the office they started speaking nice to me and talked about striking a deal with me if I pay them 900$. Had there been any mistake on my end they wouldn't have come down on the price. They are surely trying to make money out of the tenants. I have checked with couple of other reviews and they are all having similar issues with this company which sends them similar letters asking them to pay for replacing stove and other appliances. They have done the same to many people please find the citisearch reviews on them [redacted]Desired Settlement: Though I have cleaned the house, I am willing to pay just for the cleaning costs of the house like kitchen, bathroom cleaning and carpet cleaning, also I am ok to pay for Fumigation as they claim $ 75 for it which would be a total of around 475 $ since they have my security deposit with them I expect them to return $ 145 asap.

In regards to the complaint filed by [redacted]. Tenant only lived in unit for one year.

Tenant shut electric off on October 14, 2013 prior to lease expiration on October 26,2013. Tenant

left food in the refrigerator that spoiled, rotted and leaked into the refrigerators insulation. The putrid smell

from the refrigerator had engulfed the entire apartment.

Two bug bombs had to be set off to exterminate the apartment. The stove was so dirty it could not

be cleaned. Carpet was stained.

Unit smelled so bad and was left in such poor condition we could not show it to prospective

tenants. We are holding the tenant responsible for lost rent in November.

We received a threatening letter from tenant stating that we cheated him and have a history of

“Scam” and accusations of a “Scheme”. These accusations are totally untrue. Fortunately we have total

documentation and photos to back up our claim.

Attached is the security deposit disposition sent in accordance with the lease. We attempted to

settle with the tenant but he has not done so.

If monies are not paid by December 14, 2013 we will file suit to collect amounts due. We will not

respond to any future correspondence from the Revdex.com as this will be a legal issue.

If suit is filed we will apply all legal costs against security deposit.

Review: [redacted] C.R. Kelly Realty, Inc. violated Section 250.512(a)of the LANDLORD AND TENANT ACT OF 1951, 68 P.S. 250.101-250.602. Section 250.512(a) states; Every landlord shall within thirty days of termination of a lease or upon surrender and acceptance of the leasehold premises, whichever first occurs, provide a tenant with a written list of any damages to the leasehold premises for which the landlord claims the tenant is liable. I surrendered the keys to [redacted] on August 9, 2013. [redacted] C.R. Kelly Realty, Inc. had until September 8, 2013 to return my deposit and failed to do so. After several calls spanning two weeks I was assured my deposit would be returned on time, it was not. These cases are documented.Desired Settlement: I plan on suing [redacted] C.R. Kelly Realty, Inc. under Section 250.521 (b) and (c) of the LANDLORD AND TENANT ACT OF 1951 if my deposit of $585 is not returned to me in full. These sections allow me to sue for twice my security deposit, which is equal to $1,170 + related court costs. It also forfeits [redacted] C.R. Kelly Realty, Inc.'s right to deduct for damages.

Concerning the above complaint, copy attached, please be advised we did send the security deposit disposition. The lease expired on August 15, 2013, the disposition was sent September 13, 2013. As you read the disposition, you will find the tenant subletted the unit, the sublet caused damage and Mr. [redacted] is being held responsible for the damages as leaseholder. We have enclosed a copy o f the security deposit disposition and copies o f the photos. The last paragraph o f our letter states we will waive the balance he owes us.
