Dear Revdex.com:I completely agree with this homeowner, this is unacceptable service and not up to our standards. It is our intention to respond to our residents within hours of receiving their inquiries, and in this case, we failed and I sincerely apologize. I have discussed this
timeline delay with the compliance inspector, and find the following facts:Notification to previous homeowner regarding the trampoline installed without approval of the ACCC as follows:January 26, 2015-Courtesy Letter sent requesting ACC application be submittedFebruary 23, 2015-Compliance Letter sent requesting ACC application be submittedMarch 31, 2015-Compliance Letter sent requesting ACC application be submitted, and offering opportunity to homeowner for a hearing before the BoardApril 28, 2015-Compliance Letter sent requesting ACC application be submitted, advising account would be referred to attorney if no responseMay 28, 2015-Compliance Letter sent advising account was being sent to attorneyJune 2, 2015-Received notification from title company of sale to AndersonJune 30, 2015-Restarted process and sent Courtesy Letter sent to new owner requesting ACC application be submittedJuly 27, 2015-Compliance letter sent requesting ACC application be submitted July 27, 2015-Courtesy Letter sent requesting storage of wood be removed from public viewThe Texas Real Estates Commission (TREC) provides for any buyer of a property in a mandatory deed restricted community to be provided with a Resale Certificate disclosing certain information about the property including the status of deed restriction and collection matters. This document is not mandatory and requires the buyer to request this information in writing as part of the earnest money contract. The resale certificate was not requested as part of this sale, so apparently, the disclosure of actions being taken by the association were not disclosed to the buyer by the seller. Upon notification of the sale, the association began the compliance requirements from the beginning, to allow the new buyer the opportunity to bring the property into compliance. A letter and the required ACC form was provided as part of the June 30, and July 27, letter to the new homeowner.I understand this may have resulted in questions, and I apologize that phone calls and emails were not returned timely. The community association manager, Valerie Overbeck, has been brought up to speed on this matter, and will be in contact with MrsAnderson to assist in resolution of this matter.Thank you for bringing this to my attention, as the owner of Chaparral Management Company, it is essential for me to know if we are not meeting our expectations with our residents. We are happy to work with our residents on resolution of problems they have in the deed restricted communities
