Just wanted to personally thank you for all your help in this matter. The Ken Geyer Auction Co of NJ LLC and I, mutually reached an agreement to resolve the issue.
 While the company admits no wrongdoing in our business relationship, they have reached a decision to send me a check in the amount of $1,000.00. They stated that this seems to be a method to mutually and satisfactorily end our business relationship. This resolution is also acceptable to me. Upon reception and the deposit of the check, Ken Geyer Auction Co. and all of its Principals, from all past, present and future claims are absolved.
Again, it has been my pleasure to meet you and get your guidance to resolve this matter. I thank you for all your efforts and help.

Review: To whom it may be concerned:

This complaint is lodged against Geyer Auctions, owner Mark A[redacted] and in particular his associates Russel R[redacted] and Joseph F[redacted].

On October 16,2013, I met with Mr. R[redacted] and Mr. F[redacted] at my home in [redacted], New Jersey. The purpose of the meeting was to hear a proposal on the benefits and advantages of using their auction services to sell my home. The meeting was very informative and I was impressed with the possibilities. I signed a document ( Real Estate Auction Listing Agreement) and gave Mr. R[redacted] a check for $1,000. The check was to cover the advertisement expenses associated with the arrangement as documented on the check memo line. Mr. F[redacted] stated that the $1,000 should cover the cost but may run over the $1,000 expense. If so it should not be more than $1,500 total and they would do an adjustment at settlement.

That afternoon around 3 PM I had a visitor to the house that had previously looked at the property a few months earlier. She indicated that they were interested and wanted to sign an agreement of sale. At that time, about three hours after our meeting I called both Mr. R[redacted] &v F[redacted] and left messages that indicated I did not want to go through with their proposal until I resolved the matter with Mrs W[redacted].

The following day (October 17) I wrote both Mr. R[redacted] and Mr F[redacted] an e-mail letter since I did not hear back from them and documented my request to hold off on the auction. Mr F[redacted] called me on the 17th while I was at the [redacted] airport and ask me what I was offered for the house. I told him that I reduced the price to $229,000 and agreed ed to an as is sale. He indicated that both him and Russ felt they could get me $250,000, but I told him I was tired and just wanted to make the sure sale for $229,000. I told him at that time that I would certainly come back to his company if the sale did not go through. I asked him about the check for $1,000 that I wrote for advertisements but he said I would have to talk to Russ about that.

On October 18, two days after our meeting, I finally heard back from Mr. R[redacted]. He offered to assist me with the sale of the house for a flat fee of $5,000. I wrote to Russ that the agents in [redacted] were offering to perform this service for about $1,000. I ask him to let me know if he would be interested in providing this service. I spoke with Mr. F[redacted] a couple of days later and he indicated that they would not be interested in providing theses services for me at $1,000. I thanked him for his help and again ask him about the check I wrote for $1,000. Joe indicated that if I didn't hear from them in a couple of days to call Russ to discuss. I again thanked him and told him if the sale didn't go through that I would first go to them to sell. After repeated attempts to get in touch with Joe or Russ, I called Mark A[redacted], President of Geyer Auctions. He told me he would get Russ to call me back. That same day I got a call from Russ. November 9, He wanted an update so I bought him up to speed on the sale. Russ told me that although he felt he had a valid agreement, he would not hold me to it. He asked me what I wanted him to do with the check and I said to hold it for a couple of week until I was sure everything was going to go through on the other sale. I told him I would call him and that I was going to visit my Mother in Florida for a couple of week over Thanksgiving.

This went on into December and we were suppose to have a settlement on December 20. This did not go through since the other party had problems with the Bank providing the mortgage. However, the bank indicated they felt the issue could be resolved in a couple of weeks. I continued to get a resolution of the check but could not get a return call so I again contacted Mr. A[redacted] to see if he could have Russ return my calls.

Then, On January 16, I received a letter from Mr. R[redacted] who suggested we end our agreement with him retaining the $1,000. I call Russ on the 16th and told him this was not agreeable. I reminded him that on November 9, he stated that although he felt we had a valid agreement, he would not hold me to it. He told me during this call that he changed his mind. I told him that I call him hours after our meeting and sent him and Joe an e-mail canceling our agreement the following day. I told him that all this was done before the three day period I had to consider the agreement. I offered him a amount to cover his expenses, he declined.

In January I again bought up the issue of the check. Russ wrote that he consulted with his attorney and our position is firm, we will not return the check. I again reminded him what he told me November 9,2013, about not holding me to the agreement and that I felt we never had a valid agreement.

When it became apparent that the sale was not going to go through, I contacted Mark A[redacted] President of Geyer Auction and told him I wanted to go forward with the auction. Mark told me he would have Russ call me. I did not hear back from Russ and again called 3-11-04. Then I got a letter from Russ about the auction that did not agree with anything that he originally told me October 16,2013. None of the figures agreed. I wrote Russ a response and am waiting for a response.

In summery: It is my opinion that no agreement was legally executed. I contacted both members of Geyers Auctions within three hours after our meeting and in writing less than 24 hours after the meeting to cancel. Pursuant to Federal and New Jersey Law, (cooling-off rules) which allows three days to cancel on a contract of a Company coming to your home for business..

Item #2 Mr. R[redacted] agreed to return the $1,000 check on November 9, 2013, stating that although he felt we had a legal agreement he would not hold me to it. (phone log of November 9, 2013 available)

Item #3, In the interest of resolving this issue, I contacted Mr Mark A[redacted], President of Geyer Auctions, on #-March 6, 2014, to go forward with the auction. No dates were ever put on the Listing agreement in question and the reserve price was $225,000. (copy of agreement available) However, Mr R[redacted] contacted me and stated that he felt the absolute price should be $190,000 and not $225,000. He then recommended I contact some Realtors he provided. I again wrote to Mr R[redacted] asking about the $1,000 check. I have not received a response
