We terminated the contract on August 20th, and at this point, the property has been sold to another buyer at more than $10,over listing price. The property has even officially closed and transferred--six weeks have transpired-- and still he does not respond to requests from our agent to release the earnest money.He is required to maintain confidential information and yet he provided the seller with my personal email address, as evidenced by an attached personal email from the Seller to me, a letter in which the Seller states they do not know why we terminated the contract. He did not convey our reasons for terminating the contract. Our reasons for terminated are document in attached emails to our buyer agent, as well as a more detailed sketch provided for the Seller. Thus our agent wonders if he has even conveyed at all to the sellers our reason for terminating or their responsibility to sign the mutual release. He has appeared before Ohio Courts before where it has been verified he has improperly withheld information (excerpt attached)

Release"document. As a Realtor I have no control over this process. The earnest moneyprovision is a part of the contract and I am not a signer of the contract.I am not responsible. It is the Seller's decision and they felt that theBuyers had not been honorable or forthcoming, and declined to even discussresolving their concerns but only after causing the Sellers to miss theopportunity to sell to a higher offer.As the Realtor I should not be held by the Revdex.com as the responsible party eventhough the Buyers think they benefit by lashing out at me.Since the property has now closed to another Buyer I would be happy toencourage the Sellers to sign and release the funds if this complaint wereremoved.Thank you for your assistance in resolving this inappropriate complaint.KenKen WightmanBerkshire Hathaway American Realty Centerphone - ###-###-####fax - ###-###-####
