I have looked into this matter and agree with the buyer. They had a referral and should get the $500.00. We will process this request in the next 1 to 2 weeks.

complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  I received a check on 07/16/2015 in the amount of $1K.  Reimbursement for upgrades $376.00 was not received as implied in Kendall Homes initial response.  I hope the Revdex.com takes a long hard look at this Corporations A+ rating; it is neither deserved or earned.  The integrity of this firm is lacking; they are a predatory builder more concerned with profit/lost statements than customer satisfaction.  I again must stress I did not want out of this contract.  Kendall Homes forced me out and I should be completely reimbursed.

I have received your Revdex.com complaint and would like to respond. I
understand your frustrations. I know that initially you contracted with Jim
F[redacted] and he is no longer with Kendall Homes. Often a change of hands during
this process can cause some uncertainty and uncover issues...

that were not dealt
with properly by the initial sales person.
I have spoken with Maria in regards and she will make sure you
have your pricing by today. I believe this should have been given to you in a
timely manner. Maria is in between 2 communities  and is doing her best to
communicate . Often if she receives a text and does not have an answer she will
wait to respond until she has had a chance to meet with your construction superintendent.
What should of happened is she should of reiterated that to you instead waiting
to respond. Some buyers these days prefer text, Maria should have discussed
with you your preference of communication.
Building home is often very stressful as there are  many
people involved in the process. Often at times Murphy’s law applies “Anything
that can go wrong will go wrong” We do our best to avoid problems during
construction and sometimes we have to go back and correct things. This is
construction that should have been communicated better to you. Building a home
is a team effort by all parties involved.
It is never our intention to have discontinued selections in our
model. We are notified by the vendor that a manufacturer has discontinued a
certain item and that item is pulled from our selection room. Because
selections are done in the very beginning of the building process often before
the item had been discontinued and we have no way to foresee that from
happening. Which is why we speak about that very thing in your contract.
Lastly, when you signed contract the feature sheet was included as
part of your contract and you signed off on it acknowledging the features to be
included in your home.  We do this for very specific reasons. 1st-
so we know that buyer has received the feature sheet and understands what will
be included in their home. 2nd  because the website is managed
by a third party person and not directly by us. The third party that managed
and developed our website is no longer in business and we have no way of
updating the site ourselves or we would of done so immediately. That is why the
feature sheet is included in your contract. We are currently in the process of
developing a new website that we hope to have online by Jan/Feb.
I will be following up with a phone call to you as well to see if
there is any issues we still need to resolve.

Revdex.comAs for the fence, if the other builder wants to violate the deed restrictions, that is their business. We will not. We are in the process of refunding the earnest money and upgrades.Ken

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  It's not that I'm actually rejecting the message completely, I just don't want to close out the complaint until I'm assured everything is taken care of. There is a plan in place to resolve the floor molding and the cracked tiles. The superintendent did acknowledge the cracked brick and the roof having bulges from the crossbeans pushing upwards. He wants to wait and watch these issues which I disagree with. I would like these issues addressed as well as the foundation checked. A roof should be smooth and bricks should not have cracks in it. Thank you for addressing the first two issues, but please follow through on the last two issues.

The complaint was about a leak in the ceiling that flooded the downstairs. No leak was ever found in the plumbing. It was the home owners washing machine that apparently overflowed.

The complaint was about a warranty issue with the ceiling. Our builder has made contact with the homeowner and scheduled the repair.   Please let me know if you require anything else. Thank you.
