Review: The president of Kendall Painting, Inc., [redacted] K. [redacted], verbally expressed and assured my domestic partner that he would provide a service that was not provided. The contract was to remove the acoustic ceiling in the master bedroom and closet, re-texture the ceilings in both areas with a skip trowel technique that was to match the work that was done in 2005. They were also contracted to texture the ceiling in the master bathroom to match the ceilings in the bedroom. They were to also make repairs to the drywall adjacent to the shower enclosure and bathroom window and re-texture those repairs to match the existing texture of the walls in the master bath. Also to remove the cabinet in the master bathroom so the wall behind it could be repaired, textured and painted to match the chosen wall color. It was understood that the cabinet would be re-hung by myself when the walls were finish painted. When asked about this [redacted] K. [redacted] stated that he never said he would remove the cabinet even though he told my girlfriend that he would do so and that it would be a "piece of cake". The removal required only the extraction of 4 screws but the employees of Kendall Painting, Inc. did not do this. My girlfriend had no reason to lie and in fact was insistant that we use Kendall Painting, Inc. because we were returning customers from an interior refresh that was done on this home in 2005. When the current job was finished and paid for, there were some problems with the finished product that came up when the paint dried. My girlfriend called [redacted] and asked why the texture of the ceilings didn't match that of the work that was done in 2005 and she was told that they were using a new "better" technique and that this finish was as good as the match was going to be. It looks to me that the only diffierence is that they used less drywall finishing compound and charged me for the "match" which is notably heavier in the older areas. She then asked why the cabinet was not removed and [redacted] said he never agreed to remove the cabinet. There were also cracks that developed in the corners where the walls met the ceiling and I asked [redacted] to send his employee back to repair these cracks. I also at that time asked [redacted] about the removal of the cabinet and he again stated he never said he would remove the cabinet. I decided to remove the cabinet myself and it took me less than 10 min. I then repaired the slight damage that occurred when I took the cabinet off the wall sealed it with primer and textured the wall and then sealed the texture. This process from start to finish took me approx. 2 hours which included drying time. I again contacted [redacted] and asked him when he was going to come back to repair the cracks in the ceiling and he told me he would be there the following Monday (June 2, 2014) @ about 8:00 AM. I waited on that Monday untill approx 8:10 AM and called [redacted] asking where they were and he then told me he had said he was only going to call me on Monday and not be there on Monday. This makes me believe he is not a man of his word and that all of the previous conversations with him were suspect and that he may have "selective memory" which always seems to come out in his favor. I was late to work on that Monday morning because he said he was going to be there and did not show up. I called him again on Monday eve. and he said that his employee would be at the house on Thursday morning @ 8:00 AM. That Thursday his employee did show up and made the required repairs to the cracks that developed when the paint dried and to the texture of the walls in the bathroom where the repairs were made adjacent to the window and the shower enclosure. [redacted]"s employee painted, with the finish color, the area on the wall where I had removed the cabinet that [redacted] refused to take down. I am satisfied with the finished product but am not satisfied with the length of time it took to get the problems resolved. This job was supposed to take a maximum of 2.5 days and it took near two weeks to complete.Desired Settlement: I would like a refund of the amount paid to Kendall Painting, Inc. equal to the time at my wage of $40.77 per hour, I spent making a repair that I believed that Kendall painting was contracted to perform. This would be in the amount of $81.54. I would also like compensation for the day I had to take off work ( Thursday June 5th, 2014) to be at home to approve repairs made to the cracks mentioned above and bathroom texture also mentioned above, because [redacted] told me he was afraid that his employees would be verbally and possibly physically accosted by my girlfriend if she was there instead of me. This would be in the amount of $326.16. I would also like [redacted] to apologize to me and my Girlfriend for implying that she was lying about what he said and that he should admit that he did in fact agree to remove the cabinet and that he would "match" the ceiling texture that was not matched. I am not asking that he repair the ceiling texture because it would be very inconvenient for me to move out of the bedroom again for his company to match the ceiling texture that was previously mentioned. Total refund would be $407.70.

In response to complaint ID# [redacted] I would like to state the following information;

I bid this interior job for $1,500.00 but adjusted the price down to $1,425.00. The terms of the contract were no money down and full payment due upon completion of the job. The customer also asked for a bid on some exterior work at the same property. I offered to add the hall bath ceiling texture at no extra charge if I was awarded the exterior work. The customer declined my exterior bid. My contract, signed by both the customer and myself, does not include the hall bath. The customer’s girlfriend insisted that I had agreed to texture the hall bath ceiling. I didn’t want to argue the point so I offered a $75.00 reduction to the original bid which resulted in the $1,425.00 mentioned above. The customer agreed and thanked me for this concession.

When I bid the job, the customer’s girlfriend stated that I had textured the living room and hall ceiling some 10 years ago. I have reviewed that contract referenced and there is no record of that work being done. The contract does confirm that I would paint the ceiling. The job which is referred to here was referred to me by a drywall contractor. It was the drywall contractor who actually bid the texture work. On the job currently in question, I stated that I would “approximate” the ceiling texture that was previously applied. Upon texturing the master bedroom and bath ceilings in a “subtle” skip trough finish, the customer was shown the work for his approval. The customer stated that it was “fine”. The ceilings were then painted.

Regarding the cabinet issues addressed in the complaint. It was not a cabinet but rather a small 2 or 3 level shelf. When I did the job, the customer’s girlfriend made the comment that it would be “a piece of cake” to remove the shelf and paint it. I agreed to paint the shelf. I made no offer to remove the shelf so as to eliminate any risk of damage that removing a shelf from the wall could cause. In fact, the customer himself stated that he damaged the wall while removing the shelf.

The customer’s request for a refund has no merit. I bid the job for 2.5 days. I helped move the job along the 1st day by working with my painters during the first 2 hours or so. I left the job around 9:30AM. My manager stated to me that the customer left soon after, not to return that day. On day 2, the customer left his house as soon as the 1st painter arrived at 7:30AM. The customer was again gone for the rest of the day. I would also like to state that the customer’s girlfriend was not present during the work. However, she did make a brief, loud and angry appearance at the job around noon on the 1st day. The painters didn’t understand the cause of the outburst as it was not in response to anything they had or had not done. The painters excused themselves and waited outside until the customer’s girlfriend left. Later, the customer apologized to the painters.

The customer did call me back to address some small cracks in some of the caulking. This was promptly corrected and once again the painter was left alone in the house.

I would like to point out that upon completion of the work agreed to in our contract, the customer stated his satisfaction with the finished product.

Thank you for your time in hearing both sides. I feel I acted fairly and in good faith when I reduced my original bid from $1,500.00 to $1,425.00 in order to satisfy the customer.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[Regardless of who did the original ceiling skip trowel, Kendall Painting, Inc. was asked to match the ceiling texture that was installed during the first remodel and it was agreed that he would do that. They did not match the texture they were asked to install and stated that they used a different process than the original which seems to me to indicate that they should have matched the original process which was to use more compound to make the skip trowel finish match. I disagree with Mr. [redacted] that the cabinet in the bathroom was a shelf as it has a top and bottom, a back and two sides and two doors in front. These sides and doors are glass framed in wood and in no way can be mistaken for shelves. It came off as a unit and went back on as a unit when I reinstalled it in a location that was approximately 10 inches above its original location. I did leave on day one and day two but had to stay the entire day from work when the painter came back to fix the texture in the bathroom and the cracks in the bedroom, because Mr. [redacted] had raised concerns that my girlfriend may verbally or physically assault his workers and I stated that I would be there to prevent this from happening. The job should not have required the return of the painting crew if it was done properly the first time. [redacted] did not address the fact that he on two times, mentioned in the original complaint, that he said one thing that I agreed to and did another. Which were, the day when he would come back to repair the bathroom texture and that he would actually remove the cabinet and repair the wall behind it so it could be textured and painted. The only repairs that were required were where, when removing the ledger upon which the cabinet was mounted stuck to the drywall and tore approximately 8 sq. inches total of drywall paper. I made those repairs myself and certainly with results that were actually better than his first attempt at finishing the bathroom walls. Mr. [redacted]'s original bid written by him on a note pad my girlfriend provided to him stated he would texture both bathroom ceilings, and he only did one for the agreed upon price of $1500.00. This is why the original estimate was reduced by 75 dollars to the alternate price of $1425.00 which was paid @ the end of the job on day two. I will not recommend Kendall Painting for work with anyone I know and will not use the services of Mr. [redacted] again. I believe he has not resolved the issue of my wage for the day I had to be there because he was uncomfortable leaving his employees there, given the possibility that my girlfriend might be there. I believe that he should pay for my wages to repair the drywall and texture damage that would have occured if he had removed the cabinet. Also, I want to point out that all he was asked to do was remove the cabinet and that I would reinstall it when the walls were finished. I still maintain that if he had done the job properly the first time I would not have had to complain and therefore would not have lost any wages for the one repair day that I took off, which Mr. [redacted] completely omitted from his response. I still wish to be compensated for my 2 hrs of wall repair and the day of wages lost during his company's repair day in the amount of $407.70 ]
