know this is an unusual circumstance, so I will attempt to walk Kenmark Homes through it
again. Also, let me thank you for confirming
in your response to the Revdex.com that you built my house. Let me start by saying, I nor the previous owner
has no idea how a house can last up to years without flashing constructed
around the base of chimney, and that is why I tried to involve you from the
beginning I thought at the very least,
you may have wanted to research how something like this could have been
overlooked during the punch out list process.
Furthermore, it matters not what contractual arrangement you had with
the previous owner or whether they had a warranty for day or years. This is safety issue on a house that was not
built to code. Kenmark Homes built it
and I own it now. Just like when
automobile manufacturers have safety recalls because of defective construction
of their product, they are obligated to make whole on their product to whoever
owns it at that point in time; and, so too these principles apply to home
builders. I have collected statements
from the previous owner and documented this issue both through pictures and correspondence
from the beginning, which includes Kenmark Home’s failure to communicate. My complaint is justified

response to your letter of complaint ID of [redacted]Kenmark
Homes, LP has advised the Clark's, the homeowner located at 429 Sagebrush,
Aledo, Texas, of their poor installation of guttering system they had
installed, causing settling at their home. Kenmark Homes recommendation was to
get the...

gutters installed correctly and we would repair the caulk and drying
out and the texture crack at the utility room. Kenmark Homes confirmed with
their gutter company that the homeowner did NOT do what the gutter company
recommended at installation.We
proceeded with the one year repairs and documented the one year items completed
on 4/ 12/ 17 by a third party individual whom was hired by Kenmark Homes to

I am rejecting this response because: The information provided by Kenmark Himes is inaccurate. There was only one gutter that I didn't agree with. To my knowledge [redacted] are not liscened engineers. I made the recommendations made by the engineer I hired by adding 3 foot gutter extensions. The warranty work is not complete to date. The work has taken no less than three months to complete.Also the cracks have been repaired, three times. Also [redacted] has never personally called me or made face to face contact regarding these issues. These issues are deeper than settling issues. I have yet to see or hear from Kenmark Homes engineer. As I stated earlier the liscened engineer I hired feels this is a foundation problem. This issue has not been resolved.
