RE: Complaint ID: [redacted]As Kennedy Construction has chosen to omit all of the facts, I am supplying the written communication we had on this matter, to be added to this file.  To substantiate their claim of not being notified of any issues with their sub-standard work, Kennedy Construction conveniently left off the email below outlining the issues identified by two independent contractors.FINAL EMAIL TO KENNEDY CONSTRUCTION:[redacted]Subject: Re: Kennedy Construction BathroomDate: Tue, 31 Mar 2015 09:14:10 -0400[redacted] I certainly appreciate your need to have some resolution to the work Kennedy Construction has been doing on our home.  I do however, take offense to your comment “your silence and un-cooperation cannot be overlook.”  As the homeowner, we are certainly within our right to stop work when it appears to be substandard and is detrimental to our home.  It is also within our right to have that work evaluated by someone licensed and experienced in this type of work who can provide an independent and in-depth analysis of the work done by Kennedy Construction to date.  The following items were noted by an independent licensed contractor regarding the work done by Kennedy Construction to date: 1.      The tile has not been laid properly causing the lines and tile squares not to match up properly in the brick pattern you were wanting.  The grout lines are not accurate and the tile floor set up is not proper.  It looks as if no attention was paid to how the pattern was to be laid on the floor and that the tile was just laid in whatever was easiest for the person who handled it.2.      The tile is also not laid flat causing trip edges near your shower.  The trip edges in the tile could become a hazard to your family or anyone who may be visiting your home.  The edges were noticed near the shower, but there may be others as well in the existing tile.3.      The tile will not be able to be re-used as it will break when it is pulled up to be replaced.  Unfortunately this will cause you to have to purchase additional materials.4.      The seams in the concrete board where not properly sealed.  Concrete boards need to be sealed to be waterproofed.  Without sealing these boards you can have water damage to these boards.5.      When the original sinks were removed the pipes were cut leaving the traps open.  With the traps open the methane gas is leaking into your home through these pipes.  This is hazardous for anyone living in your home.  It can make some very sick but can also be combustible causing serious damage to your home. Based on the findings above, we will not be continuing with Kennedy Construction to complete this work.  We will be seeking compensation from Kennedy Construction, LLC for the additional costs due to the substandard work and consequential damage to our property. Regards, [redacted]

[redacted] [redacted]On March 18th **...

[redacted] asked us to leave the job early because he had somewhere to be. In middle of the night that same night, I received an email from him stating your dissatisfaction with the pattern and a few other issues. I replied immediately. The following morning, March 19th, [redacted] did allow us into the home to discuss the issues but said we couldn't stay for scheduling reasons. He said the following day would be off limits as well, mentioning there would be painters in the way over the weekend. He did state that work should be able to resume on Monday 23rd.However, on Monday, March 23rd, we couldn't get any response from either of you as to when someone would let us in. On March 24th, [redacted] answered her cell phone and said the whole week would be too busy for you guys to allow us access. She did agree to let [redacted] in for a few minutes to look at finding an agreeable resolution to the problems you were having. On the 25th, [redacted] called [redacted] and they agreed on 12:30. He was allowed inside for 15 minutes where an agreement was made that we would make pattern changes at no additional charge. [redacted] said she would call on the 26th to let us know when work could resume. We did not hear from anyone on the 26th. On the 27th I sent emails to the both of you that remain unanswered.Tomorrow morning will make 12 days since our job was interrupted. We have diligently tried to obtain access back into the home to finish the job, and have likewise worked with you on negotiating a compromise to any discrepancy or issue. We consider ourselves to be fair, reasonable and flexible. However, we have reached a point where hearing back from you is imperative. We cannot allow this job to stay open and unresolved for this long of a period of time. It is important that you assist us in allowing us to complete this job to a mutual satisfaction. We welcome any feedback you may have, but your silence and uncooperation cannot continue to be overlooked. Please contact us Monday at [redacted] or [redacted] to get back on the schedule.Thank you,[redacted]Kennedy ConstructionOn Mar 27, 2015 10:00 AM, "[redacted] wrote:Good morning! Please let us know when is a good time for the HVAC guy to get in there and take a look at the issue.Thank youOn Mar 22, 2015 8:45 AM, "[redacted]" <[redacted]> wrote:Good morning![redacted] wanted me to check with the two of you and see when you will be ready for him to resume work. How soon are you looking to begin the project and I can go ahead and get you on the schedule? Also, you mentioned an interest in paying by credit card when we met. Is that still you're preferred method of payment? If so, I can email or fax you a contract with the revisions and you may sign and reply via email or fax since the down payment could be made over the phone. Or if you prefer, when is a good time for me to stop by with a hard copy and we can get it signed in person? We can also accept a check if that works better. You may prefer we come in person if you are wanting to look at some color samples of paint, or have other questions regarding decor.[redacted] has been tentatively holding a spot for you since he felt this was something you are ready to do fairly soon, so we can begin as soon as Thursday if you like, and have you finished by Monday.Or if you need a little more time we can shoot for next week maybe? We are definitely excited to begin your project. Kennedy Construction has responded to this complaint previously, and our podition has not changed. At this.point, we feel as if both parties are repeating ourselves. As explained in previous correspondence, there are many untruths to the allegations presented. It is unfortunate that the communication between the client and our firm has ceased at their request, because had it continued, we are confident we could have worked to a mutual agreement. Alternatively, however, it has ended in a manner in which we feel the customer owes us money, but we are willing to forego collection of those funds and just part ways amicably.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Kennedy Construction stated
that everything in their original submission is true and accurate, and that “we
changed our minds regarding the design.” We did not change our minds on the
design.  A more accurate statement would
be that due to the irregular appearance of the work which had been completed,
we believed there was a problem with the workmanship.  We discussed the
issues with Kennedy Construction and we were informed that due to the
dimensions and layout of the room, this was the only way they could get the
tiles laid in the pattern on which we had agreed.  As stated in their response Kennedy
Construction did not believe there were any problems with the workmanship.  We felt the best way to address the
workmanship issue was to get two independent evaluations of the work performed
by Kennedy Construction by their peers in the bathroom remodeling
business.  As the evaluations indicated the work performed was of a poor
standard and could have been completed with the design we originally requested,
so despite claims that the work was of a high quality, their peers believed
just the opposite.
