Upon further review, it was determined that Kennedy Elite Basketball could not issue Ms. [redacted] a refund based on the contractractual statement dated September 17, 2016 in which Ms. [redacted] acknowledges and consents to Kennedy Elite Basketball's no refund policy. basketball scholarship at a college that offered his majorAfter speaking with ***, he stated that he would love to still play college ball but that he was not going to be able to due to his major being aviationWe told him we would see what we could do and get back to himAt that point, we did some preliminary research to see what we could put togetherWe found several schools that would allow him to still play basketball and major in AviationWe contacted his mother to see if she wanted to sign upShe was reluctant as she thought that there were not schools that would meet all the qualificationsI tried to assure her but she was skepticalBecause of her skepticism, I offered her a "sneak preview" so to speak for $depositI told her if she paid $deposit I would reveal some colleges to her that fit all of their qualifications and that we're interested in ***She would then have the option to either continue or notIf she did not continue, nothing additional would be chargedShe agreed. We we charged her $and revealed the schoolsShe was pleased with the list and asked us to continue pursuit of the scholarshipWe were dealing primarily with ***, which is the best school in the country for her son's major, and was interested in recruiting her sonWe put them in contact and the process got startedCoach *** put a lot of time into the negotiations, sending footage, transcripts, applications, profiles, and countless hours of conversations back and forth with the coaching staffAt some point, we stopped receiving communication from the *** and the college gave us feedback that they did not follow up with phone calls when they were asked toThe college will not chase them if they quit communicating. Regardless of of what happened between the schools and the *** after we put them in contact, we did our job of getting the opportunity and the interest and the exposure which is what we offerWe do not guarantee scholarship offers and we do not only collect payment of you accept an offerOur payment is due of our service was provided and it wasAt the time his file was considered closed, was when we received notice that he was all the way committed to another collegeAt that time, she was charged $250, which was a partial payment of the balance owed. *** Elite Basketball was owed the amount due and worked diligently and efficiently for the money paid and fulfilled our end of the agreementWe are not interested in refunding in any money to Ms *** and are saddened that her son is no longer playing basketball when it didn't have to be that way and he loves to play, but we wish her son much success in his future endeavors. For your reference, details of the offer I reviewed appear below.There are a few major discrepancies in the response from *** EliteI was never told or received written documentation that I was responsible for any monies due after the initial $if my son did not accept a scholarshipI specifically was told by Ginny *** the opposite during our April conversationAt that time, they supposedly already had "interested schools" without me asking for their servicesI only agreed to the $with the understanding it was for the initial list information and to see if the schools was something *** was interested in He did agree he was interested in *** onlyAfter my son spoke to the coach and was advised their program had offers currently out to other players we were told we would hear back about what those players decided We heard nothing We also only heard from Ginny via text almost weeks laterI advised her that the coach said they had players with offers and we were waiting to hear but had not heard backAt that time, I did not hear back from Ginny or anyone at *** ElitePer their website, their fee of $(not $549) included a year of recruitment services which we didIt receiveIt also said their was one training session includedWe did not receive that eitherPlease see attached website) So, after nearly months of passing time, I was not expecting, nor should I have received any additional fees since that was not our agreementEven if they thought that was our agreement, they were negligent to produce the services their website spells out for the fee they claim I am responsible for. I was positively told I was liable for $100, and the additonal fees only if my son accepted an offerThis was the "special" offer I was given.

Pursuant to agreements signed by Mrs [redacted], Kennedy Elite Basketball followed proper procedure in both the charges that were billed to the [redacted]'s and in not refunding the money. Mr [redacted] had previously stated his son's temporary absence while he played in another league, but was definite about his intsnt to come back once it was over. This constitutes an absence and not a permanent withdrawal. His son participated in private sessions with Coach Kennedy. These sessions are very limited and coveted. The spot was held for Mr [redacted]'s son to be able to return, preventing another child from taking that spot. In the signed agreement, Mrs [redacted] agreed she was aware of this policy, aware of no refund policy, aware that written notifcation of permanent withdrawal was necessary to cease automatic billing, aware that text notification to my cell phone was not acceptable, and aware of many other of our policies and in agreement. Mr [redacted]'s son has since been officially permanently withdrawn from our program and no further charges will be accrued.
