I have not received my deposit back of $47,790 from Kennedy Development Partners. No one is getting back with me.
I signed a contract on 2-2-2019 for the purchase of Lot XXX XXXXX Tree Stand Terrace (Arden). The contract stated the home would be built by November 2019. Unfortunately, I was then told by Ms. *** in February 2020, Sales Associate, that they had no idea if and when the home would be built because they ran out of funds for materials. She told me to write an email requesting my deposit if I did not want to wait for the possibility of the home being built. Last week, Ms. stated she no longer works there and try calling *** and ***. I left messages with both brothers but only *** text me stating he would get back with me on Friday, May 1. Well, that was the last I heard from him. I called and left messages and text him several times. I really need some assistance in retrieving my deposit back.

Desired Outcome

I really only want to get my deposit back of $47,790.00 which is part of my LIFE SAVINGS!!!

The company has been deceptive about the construction process for my pre-construction townhome and officers of *** have been non responsive.
I purchased a pre-construction townhome on November 22, 2017. I have upheld my obligation of the contract and given deposit money in the amount of $***. In conversations last December with the staff of *** Homes, I was assured that the home would be complete by QX XXXX. But, here we are at end of August 2018 and the home has not even broken ground yet. I have emails that back up my concerns with my salesperson, ***, as she began telling me that the home would get underway in April which became May, May which became end of June or beginning of July and now I have no ETA. She referenced 'slight delays' but saw no issues with staying on track to be complete by December???? How is it possible to complete a quality home in 3 months if they even break ground in September and go through all the permitting requirements along the way? Additionally, I was rushed to pick out my options in February of this year and pay half the balance right away which I did ($*** - in March). I am sick about the entire situation and wrote a heartfelt letter to the Officers of *** Homes back in June. I have received absolutely no response at all!!!!!! Obviously they could care less about customers. I have all the emails from my salesperson if needed, all the cashed/deposited checks I gave to *** Homes. I am unable to get out of the purchase agreement without losing all my money which is making me ill. I am leasing a home right now and have no idea what to tell my landlord as far as extending my lease (Lease is up at end of October). I feel that *** Homes is being deceptive with me and I want to understand what is causing these 'delays' and get an idea of when they will honestly break ground. If they had been honest with me from the beginning, I never would have bought as I wanted to be a homeowner by November of this year. Additionally, as required by the contract, I went and got qualified for the loan in the time period required and now my interest rate has also gone up and will most likely increase further before the home is completed. I will never, ever deal with *** Homes ever again. Yesterday I also received a *** email where they are giving even better incentives than I was given to purchase one of their townhomes. That just doesn't seem fair to me.

Desired Outcome

Either *** Homes needs to start being honest about the delivery of the home to me and I want that reassurance from an officer of the company, or void the contract, give me my money back and let me move on with lesson learned about this builder. They have made my new home purchase an absolute nightmare.

First of all, my request was specifically directed at the Officers of *** Homes LLC. I wanted them to tell me exactly when my home would be breaking ground. *** is not an officer. I am not questioning being kept informed. That was not the issue. As emails were sent, I was continually promised that the home would be starting in 2 weeks ever since April 2018. As proof, I am attaching an email that was sent to me in June where you can clearly see that I was told the home was beginning in 2 weeks which would have been around July 2nd. As of today, there is only dirt, what looks to be form boards and rough plumbing. No foundation is poured as of yet and we are almost approaching October 1st in one week. Attached is a picture that was taken today when I actually parked and walked down to where my home is supposed to be. Additionally, finishing up the home in January may not be a big deal to ***, one month past QX XXXX, however, there is no guarantee that it will be complete and I have already had issues with renewing/extending my current lease for a shorter period of time. The interest rate for my mortgage has also gone up substantially and now I will need to put more money down in order to keep my payment at a manageable level as it was back in January of this year. I would only conclude my complaint with this request, once *** Homes LLC knew that they would have these substantial delays, it was their responsibility to be truthful with me and tell me that they might not be able to begin my home until year-end and that would have at least given me the ability to prepare accordingly. Telling me that the home will begin in two weeks, another two weeks, another two weeks was not in anyone's best interest.

Homes, LLC. regrets the delays that have occurred with Ms. townhome, however, the delays have not been the fault of *** Homes, LLC. There have been issues that came up with the city that were not set in place at the beginning of land development. It's been a trying experience for us as well. I can however let you know and confirm the slab for her home will be poured on October 2. I have just confirmed this with construction and we are on target for February, worse case March. We say worse case in the event of storms, starting up power in a new community etc. It was never our intent to mislead Ms., we are extremely frustrated with the unforeseen delays ourselves. We will continue to keep Ms. informed. Once the slab is poured and inspected she will see the progress pick up from there.
