Review: We hired [redacted] Renovation Company to replace the windows and repair the exterior trim in our brownstone (co-op) to rectify a Landmarks violation. He came by several times to show us the window brochures, give us estimates, and to measure the window openings. In a good faith effort, [redacted] even stated that he would file the paperwork with Landmarks to obtain the permit to replace the windows and took a 50% deposit to start the work. He was so confident that we would receive approval that he stated in the contract that "the deposit is refundable in the event of permit denial". He informed us that he sent the application with the drawings and other required information twice to Landmarks but they never received it as he was supposed to hand deliver it, not mail it. The 50% deposit was given to [redacted] on 7/**/13 with windows to be delivered/installed in early September 2013. Despite numerous update requests, he stopped responding in November 2013. We have requested him to hand-deliver the application or refund our deposit back numerous times without any response from him. Our neighbors' paid their deposit with AMEX, and they are currently disputing the charges. As we have not received any responses (nor are the new windows installed), we are extremely disappointed with this company.Desired Settlement: We would like to receive our 50% deposit of $972.42 so that we can proceed with the replacement of windows with another company.

Review: I had ordered windows from [redacted] for the reconstruction of my sandy ravaged home in sept. after placing the order I hadnt heard from him till I called him on oct [redacted],as we got closer to the delivery date. he had some story how it didnt take as long to get the windows & they werent ordered yet.although the check was cashed on 9/*/13 & the delivery date was for nov [redacted].feeling uneasy I asked for a full refund he said no problem. now he is saying im in breach of contract.he has yet to return the deposit he promised.Desired Settlement: full refund of my deposit

[redacted] signed an agreement with us for new windows on a new construction home being built. The Estimated Start Date was November *, 2013 and the Estimated Finish Date was November *, 2013. This is written in the signed Agreement as "Estimated" with the understanding that it could change, hence the word "Estimated". On October **, 2013 [redacted] called and asked if she could cancel the order. Upon review, we decided that she has that right to do so. She was concerned about whether or not the windows had been ordered. We explained to her they were not because her home was delayed by the General Contractor (not us) by at least 7 weeks. Throughout October we kept a close eye on the progress of her home and visited the site many times. On October **, 2013 only the foundation of the home was finished and no walls were even up. I'm not an architect but I do realize that windows cannot go into walls that are not t here. After carefully explaining this to [redacted] she, somehow, didn't understand this concept. There are other influences involved in this; her General Contractor's brothers company bounced over $21,000 in checks to us ([redacted]) and we had to put Liens on those homes. So [redacted] is being manipulated to believe stories by them just to try and cover for their crimes. Regardless, on October **, 2013 we sent [redacted] a Certified Letter (USPS [redacted]) which she signed for. Enclosed in that letter was a Waiver and Breach Of Contract Agreement in which, because she cancelled the written and legal agreement recognized by the State Of New York, she would be responsible for any restocking fees, loss of wages, and termination fees outlined. Once that Waiver is signed then we can submit for refund. She has not returned to us this Waiver. Therefore, we are moving forward to calculate all charges for cancelling this Contract and refun d her the balance, if any.

In her claim she says that she was not contacted throughout the building process and it was explained to her that the General Contractor and I have been in communication throughout. We want to resolve this as quickly as possible but if [redacted] doesn't understand the clear concept of not installing windows into walls that aren't there, then we are not sure what else we can do to make her understand this.

The resolution for [redacted] is that since SHE cancelled the agreement and is in Breach Of Contract then there are certain Waivers, Releases, and forms to sign. Once she does that then we can quickly refund her any deposits left over, after charges, that are due to her.
