I am rejecting this response because:We have had two different asphalt companies that came out and neither said the base failed. Both said the foundation may not have been pretreated prior to laying the asphalt. Both stated that the differences in asphalt depth within inches of each other is consistent with poor paving - the asphalt barely covers some areas and is over inches thick in other areas. As a consumer however, why would any reputable asphalt company lay asphalt on improper base which is now his allegation? Isn't it his duty to inform the customer that the base was inadequate prior to laying nearly $40K worth of asphalt? He is the professional. We hired him for his areas of expertise and for months now his story has changed. He clearly took 100% responsibility during the spring and discussed his intentions of coming back to fix this in front of the rv park manager and other tenants but kept putting off fixing this due to the rain. He said to wait until the ground dries up and he will be back to saw cut this out and repair. He chose to not to reply to me in any way and then my husband got involved and again, the same run around. Again, why would any reputable asphalt company lay asphalt on a base that would fail? This makes no sense. Also, there was foot high pile of base sitting at the park for his use and he never used this. He never graded/leveled the base before laying the asphalt. He came to my park with the understanding that I wanted asphalt roads that would last years as that is what he told me. They didn't even make months before grass/weeds were growing through it. He took two days to lay the roads - a two acre park with basically roads. The next door neighbor that he also paved - his company took a full day to do a parking lot of base chipseal. He graded this, he rolled this and he layed the asphalt and rolled it again and this was an all day process. For me, he came in and just started laying asphalt on one half of park and rolled after the asphalt was laid then the other side. Now prep to the base was done.

We took 2days to pave your parkThe job next door is a good example how a good foundation holds up asphalt.if you have other contractor looking at your job how are they suggesting fixing it? And how much ? If new base is not installed it will fail agin!!if you have another contractor get a price on fixing and I'll pay $sq ft on the asphalt that's what I charged you and you can pay the difference or I'll refund you $a sq ft on the bad areas which are approximately sq ft

The reason for asphalt failing is due to a bad foundation record rain fall caused  the foundation to fail . I only overlayed the existing base foundation so I can not warranty something I did do and foundation work was done by another contractor how ever I will warranty the asphalt I layed as...

soon as the foundation is repaired I'll repave the bad areas.
