It is clear that the parties cannot agree on the factual and/or legal nature of this matter.  However, there is no objective evidence that the Customer has provided either in her rejection or directly to Minuteman Seamless Gutters, Inc. ("Minuteman") that contradict the facts and/or law as was clearly laid out in Minuteman's original response.  Accordingly, Minuteman stands by the factual information and/or legal conclusions in its original response.While the Customer seems to reject the facts and/or legal conclusions in Minuteman's originally filed response, the bottom line is that the parties reached an agreement whereby Minuteman has agreed to completely refund the full amount that was paid over thirteen (13) years ago.   The Customer acknowledges in her rejection that she agreed to Minuteman's offer.  The parties are in the process of effectuating that agreement with a formal Release. The Customer has had her attorney assist with the language of the Release, and as of today, the lawyers for the parties have agreed to the final language of the Release.  Once the Release has been executed, Minuteman will honor this agreed as it has honored its other agreement with this Customer.  So, Minuteman considers this matter closed.

There are several statements that are not true from this business. Firstly- they have been coming out over the years to address problems of installation that were never fully corrected. They have replaced a gutter that fell off the house 3 years ago- this has fallen off again. They have been out in 2003, 2007, 2009 to address valleys overshooting that was never done properly ( they state they will install high volume gutters where this is happening but they did not do this). The finish that has discolored and peeled is still under warranty but they claim that it is from the roof valleys - but the discoloration and peeling are not at any valleys. I have been told by professionals in the field that it is from rust from nails that were used. I was accused of "spray painting" the gutters initially by this company (!) until the regional rep came out and said it was happening from our roof valley materials. The discoloration is not at the valleys as I stated, and it is along one side of the house mainly. They say they will send a check out for the initial cost we paid in 2002, but we have not heard back from them.This of course is not going to cover the cost of replacement now. They just have refused to replace them and I have family illness that I need to attend to and cannot fight with them any longer.  Everything was under warranty when I contacted them earlier this year - but they have made it impossible to get them to replace the gutters with the "right" gutters. Their own rep stated in an email to me that we should not have been sold the gutters we have in the first place for our type of roof (slate). But they do have the correct style gutters now ( high volume).
