The vehicle Nissan Pathfinder has been brought to our location for repairs and warranty on the motorI have told the customer, [redacted] , that we will work on the warranty, [redacted] ***, to resolve the issueI have mention to Ms [redacted] that the warranty company will be close for Easter Holiday but she got upset and says it was not fair and demanded to swap the vehicle or her money backI mention we have a warranty that we need to resolve first and then we will work a way to get her account goingOn Monday, the day after Easter Holiday, we called Ms [redacted] that the warranty company has returned the reply and said will cover the motor issue of an amount of $which the customer has to pay a deductible of $The repair cost totaled to $and when I mention that Ms [redacted] to pay a deductible the customer got mad and said she will not pay anything and demanded she will take us to courtI did mention if that is the way she wants to proceed then she has every right to do so but we are responding with the warranty and the customer was not satisfied with our answer and disconnected the conversationI was going to mention Orozco Auto Sales will cover the rest of the repair costAnd also we will work with her payments so she is able to get current with her account, which I have also mention we received the warranty confirmation that the motor will be warrantiedBefore we were able to work a deal she just disconnected our call and has not made her first monthly payment of her loanWe willing to work with Ms [redacted] that way she can get her Nissan Pathfinder back and get her account current where its suppose to beIf you have any further questions, please call the office [redacted] or email us at [redacted] , we look forward hearing from you

The customer was fully aware of how the deal structure was going to be and MsS [redacted] and her husband took a sheet called "The Four Square" of how the structure will beWe even said the vehicle just got in from the auction and needs to be serviced from maintenance before delivery; which we do to our entire inventory before we put them to saleThe customer agreed and to the structure and terms of the dealWe mention his price of the vehicle is $21,+ taxes and Doc Fee minus the down payment and what is left will get financedThe customer at first did thought it was $21,- $5,will be $16,400, but then we mention the price includes taxes and documentation and then the customer said okay to go on forward on explaining the dealThere was no contract in between or signature saying it’s a done sale but a secure deposit holds on the vehicle so it will not be soldWe did mention to the customer that this secure deposit of $1,000.00, which the customer said he can do $1,000.00, to hold the vehicle but we also did mention this means the deposit will not be refundable if the customer backs down from the offerIt is also written in his receipt deposit that the money is not refundable to the customerThe customer then came back and said he wanted his money back but then I, Jorge Orozco General Manager, stepped in the conversation because the customer was getting aggressive with the salesmanThe salesman, Jorge AM [redacted] , mentioned to the customer the money cannot be refunded because it’s a promise the customer will be back for the deal and us as the Dealer will not sell the vehicle to anyone other the customer that puts a secure deposit to holdWe also did mention the customer can use the secure deposit as credit to any other vehicle he wishes, yet denies that offerAn attachment of the deal structure will be provided of how the deal was promised to the customer

The deposit was told to Mr [redacted] that it will be towards the down payment and he agrees since we did wrote on the receipt that shows the amount owed and the amount that need to be given when delivery of the vehicleWhen Mr [redacted] towed the vehicle we mentioned that the repairs will cost him since it is not under warrantyMr [redacted] denied the service and we said he can pick up his vehicle since we are not working on itWe could have charged him storage fees for keeping the vehicle here for a while but we are humble enough not to do soInstead, we tried to get in contact with him about his payments and the vehicleAll he stated that he is not going to pay for a vehicle that is not working and not in his possessionDays later we sent a day notice of repossession and never got a response backMr [redacted] abandoned the vehicle here in our location and no communication of when he will come to recover the carInstead, we waited an extra days more to see if he will even come to recovery his personal belongings which he never did as wellThe vehicle was never worked on since he towed it to our location because we were not given authorization by the customer to begin the serviceOrozco Auto Sales will not refund the customer back his down payment due to miscommunication and abandoning the vehicle hereThank you.Orozco Auto Sales LLC

Mr [redacted] bought the vehicle Cadillac CTS VIN: [redacted] on January 31, Orozco Auto Sales LLC always has the customers test drive and inspect the vehicle before the purchaseThat way, the customer knows what he or she will purchaseMr [redacted] enjoyed the test drive and we talked about the numbers before the contract was madeCustomer did not say anything about any problems or anything wrong with the vehicleOrozco Auto Sales LLC always issues a WE-OWE statement in the contract before the customer has driven away with the vehicleThe previous manager even spoke with the customer before the vehicle was driven off the lotWe do give a day or mile warranty to all vehicles that cover powertrain onlyA week later by notes, the customer called March 15, stating he is having problems with the vehicleAs stated in the notes, customer s out of warranty and Mr [redacted] got madAfter warranty is done, we do help the customer fix the vehicles, if and only they pay the parts and labor to the repairSeven days later, the customer towed the vehicle in and the manager received the vehicle by the tow personAlso the manager called Mr [redacted] and asked why the vehicle is being sent and a response of we need to fix the vehicleWe were kind enough to accept the vehicle and diagnose the problem and gave Mr [redacted] a call to let him know the issueWe let Mr [redacted] aware of the amount of $and Mr [redacted] refused, yet the manager called him back to offer the repair without charging labor of $346: still Mr [redacted] refuse the offerThe Vehicle stayed here since the customer brought the vehicle in tow and on May08, we send a day letter notice to the address on the contract to let him know we will sell the vehicle without further noticeSince then, we have never heard from the customer againIf you have any further questions, please call [redacted] Thank youOrozco Auto Sales LLCJorge OrozcoManager

I'm not content with MrOrozcos the General Managers responseBecause he wouldn't know what was said to me and husband by the salesman Jorge AM*** since the day we set foot there.Because MrOrozco the General Manager was never present until the last day we went in to explain to his salesman why we wanted to step away and get my money back.The salesman informed us the day we went for the first time that was on a Saturday 04/22/17 after we took it for a test drive and liked the truck we went inside to talk about numbers.That is when the salesman said that the GMC Sierra 4xwas 21,and that we would have to give a 5,deposit and that my ending balance would be with taxesSo yes we agreed with that price range because it seemed like a reasonable price for that truckThen the salesman told us that the truck wasn't ready that it needed to pass emission and that they needed to fix something on it something about a censor and that we couldn't take it until thenThat's when the salesman Jorge A.M*** told me and my husband that we had to leave some type of deposit so they can start working on the truck and so it could be ready to pick up by Monday 04/24/and that if we didn't leave anything that it would take longer and that by leaving a deposit it would speed up the process.That was the only reason we deiced to leave the 1,deposit and the only thing we signed a paper that the salesman gaves us and told us it was jst for basic information like for income and credit checks and for referencesAlso Mr Orozco the General Manager wouldn't know if his salesman informed us before taking the 1,deposit that it wouldn't be refundable which the salesman didn't he told us until he took the money and handed us our receipt were it said not refundable that when I told my husband and that's when the salesman said oh yeah that 1,weren't refundableBecause the General Manager MrOrozco was never present.So when we went back that following Monday 04/24/to pick up the truck it wasn't ready the salesman informed us that it wasn't a censor after all that its something on the motor and that they needed to get a new one put inSo after that was said to us we went back inside to see the numbers again to make sure everything was good and the same like the salesman told us since day oneBut he went from telling us that our ending balance would be 18,600 on Saturday 04/22/to 31,on Monday 04/24/17.That's when we were in shock and just was told to come back on Thursday 04/27/that the truck will be ready by then so we left that day and we started overthinking and saying that how did our ending balance go from 18,to 31,we didn't understand why it went up so much if the salesman told us on Saturday 04/22/that our ending balance after the deposit and taxes would be 18,he never mentioned a number as low like 16,like MrOrozco mentioned if that was the case do you think he would be here complaining and trying to get our 1,no we would of took the deal if that was the case.Why doesn't MrOrozco mention the 31,that his salesman told us went up to from 18,to the 31,if the last day we went in he kept saying that amount of money was going to be our ending balance MrOrozco was there and he didn't say anything about thatLike the sales man said that the reason that it went up to 31,was because of fees and taxes and I don't believe that from 18,will go up to 31,for fees and taxes that's just a ridiculous amount of money.And if since day one the salesman Jorge AM*** would of said that the ending balance was going to be 31,since day one for a GMC Sieera 4xwith a good amount of miles on it you think that we would agreed on that price range and would of left the 1,deposit I don't think soSo we went back on Thursday 04/27/Like the salesman Jorge AM*** told us to so we went back in and that's when MrOrozco was present and himself informed us that after all it wasn't the motor that is was the transmission that all he said when we first stepped in and then later on he then mentioned again that is was hard to find a motor for that type of truck that when something wasn't right because they went from a censor to the motor and the the motor to the transmission and from the transmission back to the motor well which one is it after allThen when we were told that that's when we told the salesman Jorge AM*** that we wanted to step back from the truck because it was a lot of money that went up and that he never mentioned us that big number the only one he said was the 18,for our ending balanceThat we didn't understand why he jumped from 18,to the 31,all of a sudden and the only thing he said it's because the fees and taxes that's when we told him he never said that to us he told us it would be the 18,Also when we told him that we wanted to step back we told us right away the salesman Jorge AM*** that he would leave it at 18,with zero interest if we paid it in a year that our monthly payment would be 1,which is a ridiculous amount of money for us to pay every month and way out of our budget why didn't MrOrozco step in there if he knew that that was a very high amount of money that was being asked to pay each month we immediately said no to that offerThen we asked the salesman that we wanted our money back and his response was well talk to him now he referred to MrOrozco we told him no because we have never spoke with and the only person we spoke to was the salesman Jorge AM*** why did he want us to speak with someone else because he didn't mention that he was the General ManagerAlso MrOrozco mentioned that we were getting aggressive that that's why he stepped in if that was the case why didn't he call the cops.We never got aggressive at any point neither did we raise our voices.After MrOrozco stepped in the conversation when we started to ask for our money back he just kept saying no he didn't let us explain why we were trying to step away but he refused to listen to us.So we just said okay that we will see what we can do and stepped out.Because that's not fair what they did and what there doing first the salesman sweet talks you and paints everything all nice then he changes everything in a blink of an eye.I want the salesman Jorge AM*** to take responsibility for his actions and to realize and say the truth of what he really said to us the first day we went inWe've worked hard to get our money so they can just take our money like nothing just with telling us lies.This is the best I can do on explaining my situation with Orozcos Auto sales

The customer was fully aware the very first time the salesman showed the four square, which was provided and customer has the same identical version of itThe sales price of the vehicle is $which anywhere they will go will charge them taxes and documentation feesThe sum of that minus the down payment of $will be $From that price the customer will finance either to a term of 58, 50, 44, or monthsWhich the customer agreed on the term of payments of $a month which does add up $and the four square which the customer took home and was explained that day when he made the secure deposit of $It is very clear to know what is the total amount to pay by looking at how long the customer will pay by multiplying the terms to the monthly paymentAn attachment of how the deal will look is provided and as well the other termsWe did explain to the customer if he adds more towards the principle they will pay less interest in the long run and those terms are provided in the attachmentHere at Orozco Auto Sales we do not hide number nor lie to the customersWe explain to them more further into detail of how they will pay for a Buy Here Pay HereAt the end of the agreement, we made it clear that leaving the secure deposit, the deposit will not be returnedWhich the customer agreed with the salesman and left the secure depositAn attachment has been provided of the deal structure of the four monthly terms and the four square that has been mentioned

In response to her complain I, Jorge Orozco, was going to mention her choices to pay and arrange for her payments until we mention the customer has to pay a deductible of $the customer started to hesitate that she will not pay anything at allThat is when the customer started to demand her money back and taking us to court: which I mention to her, she is in all her right to do anything she wants*** *** *** in the warranty provider of the repair and the warranty has send a completion order to sign after repairs are doneAfter Easter Holiday the replacement motor for the Nissan Pathfinder has come in but we had a problem with the motor, therefore we had to reorder another motor from the warranty of where we got the motorWe tried get in contact with the customer with the number ending in *** and we had no response and email was fullOn 04/25/the other replacement motor came in and we started working the customer’s vehicleWe got the motor installed and running 04/28/for test runs and vehicle started to have a leak from the gasketsWe worked on sealing the old gasket with a new kit and repaired the leakAs of 05/02/the vehicle has been finished and ready for pick upOnce more again we tried to get in contact with the customer with the same ending number and no answer and left voicemailThe total repair of the vehicle is more than the warranty will cover but Orozco Auto Sales will pay for the remaining balance and cover the customer’s deductibleAll we ask is for the customer is to make her 1st payment on the 24th of this month of May and we will skip the payment towards the endCustomer will pay nothing and we will do a full detail wash of the vehicle tomorrow if customer agrees

They did not give me no good answers when I spoke to Jorge he was rude and said if I wanted to take them to court that was fine then he hung up the phone on me! No they did not call me back on Monday after Easter they had the truck since Tuesday but waited till Friday to tell me that the warranty people where gone for the weekend. They never called me I had to be calling them I have record they called me until the next Friday! If I just bought the Nissan not one payment yet but I need to pay for repairs on a motor that dint work. mr jorge never gave me no choice of what to do. I bought a car because I need it transportation to go to work I miss days of work and other days paid taxi at 2am. I don't take his excuses to me it's not acceptable because he never gave me choice he never cared.

Every statement made was false and they never mentioned that I had to put a down payment on the car for them to hold it while they fixed the vehicle before I received it supposedly fixed days later which a receipt was given for a partial and then full amount of the down payment. My sister was a witness to all events and has documented them for her own records. I will refute all of the statements made because they are all falsely derived and they need to show all receipts, communications, and work orders. To prove my complaint I will furnish my call records which will eliminate their time line and cripple their unjust rendering of false times and events.

Seven days later, the customer towed the vehicle in and the manager received the vehicle by the tow person. Also the manager called Mr. [redacted] and asked why the vehicle is being sent and a response of we need to fix the vehicle. We were kind enough to accept the vehicle and diagnose the problem and gave Mr. [redacted] a call to let him know the issue. We let Mr. [redacted] aware of the amount of $520.00 and Mr. [redacted] refused, yet the manager called him back to offer the repair without charging labor of $346: still Mr. [redacted] refuse the offer. The Vehicle stayed here since the customer brought the vehicle in tow and on May08, 2015 we send a 10 day letter notice to the address on the contract to let him know we will sell the vehicle without further notice. I was going to mention Orozco Auto Sales will cover the rest of the repair cost.
