I am in receipt of your letter of March , regarding the educational loans for Ms*** *** *** with Kentucky Higher Education Student Loan Corporation (KHESLC) that was delayed being delivered to our office due to the snow storm on March 5th & 6thKHESLC sent Ms*** a
recertification letter and application on October 7, as her Income Based Repayment Plan (IBR) would soon be ending asking that she return the application and required documentation within days(Enclosed is a copy of the cover letter for your records.) KHESLC never received the application back in December 2014, as Ms*** has assertedAs a result, Ms***s account automatically converted to the standard repayment beginning with her January 20, 2015, paymentA past due statement was sent to Ms*** on January 25, 2015, and a past due letter was sent on February , It was not until February , 2015, that KHESLC was able to speak with Ms*** regarding her account at which time her loans were days past dueDuring that conversation, Ms, *** stated that she would send in the recertification information for the IBR and she also requested an administrative forbearance for economic hardship until the forms arrivedKHESLC received Ms***s IBR application on February 23, 2015, and it was processed approved on February 24, A confirmation letter was sent to Ms*** on the same day approving a nopay” IBR payment plan for one (1) yearMs*** has Federal Stafford Subsidized Loans and Federal Stafford Unsubsidized Loans with KHESLCThe federal government pays the interest on the Stafford Subsidized portion only for the first three (3) years of the IBR payment plan; they do not pay any interest on the Stafford Unsubsidized portionThis is the last IBR year the interest will be paid by the government on Ms***s Stafford Subsidized loansThe Stafford Unsubsidized loans have always continued to accrue interest and can be paid by Ms*** at any timeRegarding Ms***s claim regarding the start date of her IBR, KHESLC did not receive her IBR request until after the previous IBR payment plan ended and her account became past dueOther lenders process late IBR documentation by adding administrative forbearances to an account in order to bring an account and does not capitalize the interestPlease review the
following guidelines:
1121.Deltnquency under IncomeBased Repayment (IBR) If the lender received the borrowcrs income information more than days after the specificd annual deadline and tho borrowcrs monthly
payment amount is recalculated to the permanentstandard amount, the lender may grant an administrative forbearance with respect to payments that are overdue or would be duc at the time the new calculated incomebased monthly payment amount is determincd only if the new incomebased monthly payment amount is zero or is less than the borrowers previously calculated incomebased monthly payment amountThe lender may not capitalize interest that accrues during the portion of this administrative forbearance period that covers payments due after the end of the prior annual payment period(Sce Subsection 10.8.for information on incomebased repayment plans.682.211f)16); 682.215c)9); 685,221c)9)]
As a one-time courtesy, KHESLC is back-dating the start date of Ms, ***s new IBR
payment plan, In the future, Ms*** should return any payment plan documentation to KHESLC within the allotted time and to follow up with each agency to make sure her documentation is receivedAny future late IBR documentation received by KHESLC will not be back-dated

I cannot accept this response as the delinquency they are alleging did not take place as I have no notification of such delinquency They have no proof that they notified me and I received any such delinquency as it is their responsibility to contact me for payment which they cannot prove they contacted me That being said there are delinquencies that are on my equifax and experian report from them that is not fair as I did not know back then that I owed them anything and they continue to report this to these credit bureaus when I knew nothing about this in If you can prove that you contacted me and told me I had this debt and I refused to pay I will accept your credit reporting but the fact is is that I moved overseas in and there is no way you contacted me about this debt therefore you have not done under the law to contact me therefore there should be no delinquency reporting for this and it is unlawful to do this without contacting me I can't even make an offer to fix the delinquency your company has on my credit report as you state too no longer have this account How am I supposed to fix this when you didn't contact me and now you don't have the account yet have been reporting this for YEARS! This can't be legal Please remove any Kentucky Education loans from experian and equifax reports as you can't even prove you told me they were delinquent

with the effective date of January 8, Paid in full letters are not sent to individuals whose defaulted loans are consolidatedOnly individuals whose loans are paid in full by the borrower will be sent a paid in full letterI have asked for the Guarantor Kentucky Higher Education Assistance Authority (KHEAA) to send Mr*** a paid in full letter even though his loan was consolidatedPlease see the attached copy of the letter that office mailed him today.As to the status letter, Mr*** should have waited days then called back to the default department and provided the name of the school along with the school’s fax number to have that department send a status letterThe school would also be able to access the National Student Loan Data Base (NSLDS) that reflects Mr***’s defaulted loan was consolidatedI have confirmed the website posted on January 27, the loan was consolidatedI have requested that the default department call Mr*** to get the name of the school along with the school’s fax number to send a status letter to them in addition. On August 10, 2013 KSA transferred Mr. [redacted]s loans to the [redacted] group for servicing. KSA notified the credit bureaus of the loans transfer and the bureaus should reflect the loans as transferred to another office. |

I am in receipt of your letter of October 12, 2015 regarding the educational loan for Ms. [redacted] with Kentucky Higher Education Student Loan Corporation (KHESLC).
I have reviewed Ms. [redacted]’ complaint that she submitted to your office along with her account information: The following...

background information demonstrates that the statements Ms. [redacted]’ statements provided in her complaint regarding her account history, are incorrect.
Ms. [redacted] account defaulted in 2013 for non-payment. Her loan was paid off by the Guarantor, Kentucky Higher Education Assistance Authority (KHEAA). She rehabilitated her defaulted loan and KHESLC was asked to repurchase the loan on July 24, 2014. KHESLC made a courtesy call to Ms. [redacted] on August 21, 2014 to remind her that her loan had been repurchased by KHESLC and her next payment would be due on September 15, 2014. This was in addition to the welcome email and disclosure statements sent to her on July 24, 2014. 
Ms. [redacted]’ account became delinquent on September 16, 2014. KHESLC sent letters (18) and attempted to make phone calls (27) to her and her references. It was not until April 27, 2015 that Ms. [redacted] returned our calls at which time her account was 224 days past due. Ms. [redacted] requested a nine (9) month forbearance due to economic hardship reasons. KHESLC placed the forbearance on her account that same day.
The next time KHESH Customer service spoke with Ms. [redacted] was on June 1, 2015. The phone call was recorded and I have reviewed the call. The customer service representative informed Ms. [redacted] that her account was current at present. Ms. [redacted] had been previously
reported delinquent from November 2014 – April 2015. The negative reporting stopped when KHESLC granted her a forbearance. Ms. [redacted] asked if she could pay an amount for the negative reporting to go away. She was informed the past due reporting could not be removed and would remain on her credit, given that the reporting was accurate. At no time was Ms. [redacted] told that the credit bureau information should not have been reported as she claims in her complaint. 
Ms. [redacted]’ statement regarding her school status was incorrect. Both of the school reporting agencies ([redacted] and the [redacted] System are agencies where
colleges and universities provide their student enrollment information) reflect that Ms. [redacted] withdrew from school in December 2008. Ms. [redacted] did not return to school until August 17, 2015 at [redacted].
In summary, the negative reporting that was previously sent to the credit bureaus will not be removed because it was accurate. Ms. [redacted] had not been in school since 2008 until she re enrolled in August, 2015.

The customer service representative who spoke with her removed Ms. [redacted]’s work number from our database and notated that Ms. [redacted] does not want to be contacted at her place of employment. It appears Ms. [redacted] filed her complaint with your office that same morning, according to the time stamped on the letter you sent to our office. Again, Ms. [redacted]’s work number was removed from our database on July 16, 2015.

 You keep saying check with [redacted] Group. I am doing that.  I received a letter from you recently stating that you will make sure any degratory reporting to Experian will be updated or deleted from my credit report but for some reason with the Revdex.com you are not confirming this. I want confirmation through this forum that you will immediately delete from Transunion Experian and Equifax any negative reporting.
