Prior to the start of the funeral
home auction in question, an inventory prepared by
Key Auctioneers (“Key”)
showed a total of green chairsThe complainant, Mr***, was the high
bidder on of the green chairsSee attached invoice # ***The high bidder
on the remaining green chairs was from Danville INSee attached invoice #

Like virtually all auction
companies, Key’s terms provide that the bidder becomes responsible for securing
his or her items immediately “upon the fall of the hammer.” Given the thousands
of items that are sold to hundreds of buyers in a very short period of time,
this is the only practical way an auction company can be assured that the buyer
obtains the merchandise purchasedThe invoice signed by Mr*** clearly
states: “I became responsible for the
security of the items immediately upon the fall the hammer.” See attached
signed invoice # ***Similarly, the Bidder Contract signed by Mr***
provides: “Once the Auctioneer says
‘SOLD’, the merchandise becomes the property and responsibility of Buyer and
Buyer assumes all risk of loss and damage to itNo refunds will be made for
lost or stolen itemsBuyer should safeguard his or her merchandise
accordingly.” See attached signed bidder contract
Mr*** states
that he thought he loaded all of his chairs, but upon getting back to his
office and re-counting the chairs, he believed he was short nine chairs
However, by the time Mr*** called to advise he was short nine chairs, the
chairs were no longer at the auction siteKey personnel advised Mr***
that either the purchaser of the chairs had knowingly or unknowingly removed
the additional chairs, or perhaps another attendee had taken the chairsEither
way, it was Mr***’s responsibility to safeguard his property until it was removed from the premises
Nonetheless, Key offered to attempt to contact the buyer of the chairs to see if he had inadvertently taken the additional chairs Key made several attempts to contact the buyer of the chairs, but has been unable to get a response from him'
while the terms of the auction clearly put the onus on Mr*** to safeguard the chairs once purchased, Key has sent Mr*** a check providing a fully refund in the amount of $for the missing nine chairs See photocopy of attached check Mr*** has indicated that he is satisfied with this resolution and will seek to withdraw his complaint
