***Policyholder: *** ***Storage Facility: *** *** *** Dear Ms***I am writing in response to your letter dated December 12, regarding the complaint filed by Mr*** ***. The claim arose from a Commercial Inland Marine Policy that was issued to *** *** which offered Leased Premises Property coverage to tenants that choose to enroll. Mr*** was a certificate holder under this policy and elected $2,of coverage on 03/14/2013. Bader received notice of the loss on November 7, at which time we obtained a statement of loss from Mr*** On the same day, Mr*** was emailed the Claim Kit letter, Loss Notification Form, and Personal Property Claim List. These forms were also mailed on November 8, 2014. On November 11, Bader received pages from Mr*** (forms and pictures) via fax. After reviewing the documents received on November 11, Bader requested additional information via letter on November 14, 2014. The additional information requested was for full color photos of the damaged property (the faxed photos of the damaged property were solid black prints), purchase year or age and original costs of the damaged property, and a copy of Mr***s photo ID as the Loss Notification form was not notarized On November 25, the purchase year and original costs of the damaged property were received along with a copy of Mr***’s photo ID, however no colored pictures were submitted. Therefore on November 12, a second request letter was sent to Mr***. Once the colored photos are received, his claim will be processed. In his complaint, Mr*** indicated that he was ‘required’ to take out coverage with Bader Company. While *** *** *** requires all tenants to have insurance coverage for the personal property stored in their facility, coverage with Bader Company is not mandatory. Individuals who already have coverage through a homeowners or renters policy or who have purchased coverage from another carrier only need to show proof of coverage to meet the lease requirement. Lastly, in Mr***’s complaint to the Bureau, he requests payment for the $he will incur to remove the damaged property from the unit. Under the Certificate of Insurance and Summary of Coverage that was provided to Mr***, payment of these type of fees are not included as part of his coverage. Therefore, Bader and *** cannot consider reimbursement for the disposal fees. We appreciate the assistance of the Revdex.com in resolving this matter. Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Yes I did state that but a representative advised me twice that I didn't need to provide any additional pictures because I had plenty of pictures. I did provide the picture of the white bag, that was opened up and told the respresentative that I realized that some of my clothes had holes in them but I didn't know what it could've happened until I realized that there was a rat inside of the tote that the box was in. Im extremely scared of rodents but I put a trap out to catch it and when I caught I asked if they needed more pictures. The representative also informed me that my adjuster would let me know if I needed to provide any additional pictures and when my adjuster called me he never asked me for anything regarding what was in the white bag so I assumed hw didn't need any more pictures. Instead he never addressed the bag and I didn't realize it until I got my letter in the mail showing that I was never reimbursed for the items that was in the bag.

ID#:    [redacted] Insured:                     [redacted]Policyholder:               [redacted]Storage Facility:          [redacted] Dear Ms. [redacted], We received your letter dated 11/11/2014 regarding the complaint filed by [redacted]. Ms. [redacted] was a certificate holder under a Commercial Inland Marine Policy that was issued to [redacted] which offers Leased Premises Property coverage to tenants that choose to enroll.     Bader received notice of the loss on August 20, 2014 at which time we obtained a statement of loss from Ms. [redacted].  On the same day, Ms. [redacted] was emailed the Claim Kit letter, Loss Notification Form, and Personal Property Claim List.  These forms were also mailed on August 21, 2014.  On September 3, 2014, Bader obtained a managers statement from [redacted] of Gambrills. On October 14, 2014 Bader received the completed Loss Notification Form and Personal Property Claim List, photos and other supporting documents from Ms. [redacted] and upon review of all information, the claim was denied on October 24, 2014.   Bader conducted a thorough investigation based on the information provided and determined the facts of the claim to be the following:     *Per Ms. [redacted]’s statement, Ms. [redacted] and her father entered her storage unit on August 19, 2014 to vacate her unit and discovered damage to her property.  Ms. [redacted] was last in her storage unit approximately 8-9 months prior and did not observe damage at that time.    *Per Ms. [redacted]’s statement, the Loss Notification Form, and the facility manager’s statement, the damage was caused by mildew on the property.  There were no signs of water in the unit.    *Per Ms. [redacted]’s and the facility manager’s statement, there was no physical damage to the storage unit.     *Per the Summary of Coverage that Ms. [redacted] was issued, please see the following exclusion:      What Is Not Covered:2.    We will not pay for loss or damage to personal property caused by or resulting from any of the following:K.    Mildew, fungus, bacteria, wet or dry rot, atmospheric conditions or changes in temperature, breakage of glass or similar fragile   articles, or decay. Bader must rely only on the provisions of the coverage to determine if a loss is payable.  Since the damage was caused by atmospheric conditions /mildew and not by a Covered Cause of Loss per the Summary of Coverage, Ms. [redacted]’s claim was correctly adjudicated as a denial of coverage.   In her complaint, Ms. [redacted] indicated that she was ‘required’ to take out coverage with Bader Company.  While [redacted] of Gambrills requires all tenants to have insurance coverage for the personal property stored in their facility, coverage with Bader Company is not mandatory.  Individuals who already have coverage through a homeowners or renters policy or who have purchased coverage from another carrier only need to show proof of coverage to meet the lease requirement. We do sympathize with Ms. [redacted]’s loss of property; however, based on the facts of the loss, we have no basis to reconsider this claim under the coverage.
