If no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: There are many things stated in this response that are not true. It is offensive that Liz is lying about what she said. I am a very quiet natured person and never raised my voice. I have been with this orthodontist for over two years and the dentist practice since I was a little girl. Any one who works there can attest to my kind and quiet nature. I spoke in a quiet and calm manner, but I was not able to finish any of my sentences due to being interrupted by Liz every time I tried to say something. Therefore, I collected my things and left the office because I was not able to talk to Liz without her interrupting me and she consistently told me in a loud manner to pay her money or write her a new check. At no time did I say the check in question had been cashed. I simply stated that I had written the check to them and it was in their error that the check had not been submitted to their bank. I never questioned the fact that they did not get their money. I simply made it known that it was not my fault that they didn't get the money. The fault lies on Liz for never depositing the check. The fact of the matter is I do not owe Dr. Mendez any money. I paid them a check that they did not submit. It is their fault that they do not have the money, because I provided it to them. Once they deposit the check, they will be able to balance their books, but the action lies in their court now.When I called back later that day, I was told that there was no one to speak to because the office was closed, but Dr. Mendez, who was still there working late, said to let me know that I could make payments. I do not need to make any payments because I have already provided payment. It seems this point is being overlooked. When I went back to the office recently, I spoke with Dr. Mendez directly. He personally apologized for the very rude and unprofessional behavior of Liz and said that he would speak with her. I accepted the apology because it was sincere and he understood my position and what was going on. If Liz had been professional, had not yelled at me, and had taken the time to understand the real issue instead of being irrational and only thinking of money, this whole situation would not exist. I never stated the funds were taken from my account. I wanted to get the point across that I have already paid by providing a check and it was their fault that they have not received the money to date. The issue was never about money being withdrawn from my account. The issue was the fact that Liz was stating that I had not paid, when in fact I provided payment in the form of a check. It seems that Liz still does not understand what the issue is for this case.I acknowledge the fact that I provide payment by check in 2013 and that Dr. Mendez's office has a copy of that check to deposit which they should have done initially. I have no desire to keep going back and forth on this but wish to make the record clear by the above response. Thank you. Regards, [redacted]

Thank you for forwarding this information to our officeSome of the information in the complaint was incorrectFirst, we informed the patient that one of her initial checks had NOT been cashedBoth she and her mother were informed of this factThe patient came into the office, arguing that the check HAD been cashed, and if it had not, that she owned us nothingThe patient initially claimed her bank could not go back in her account; we knew this was not true but did not argue with her, as she was understandably upset to discover that we showed a balance on her account when she thought it had been paidAt no time did I tell her she couldn't manage her money; I did state that if she had balanced her checkbook (which I also told her that I myself don't do with online access these days), she would have known the check had never clearedThe patient was the loud one, stormed out of the officeIt was NOT closing time as she claimed; in fact she called back later the same day, so it could not have been closing time
As a result of further investigation, the patient discovered that we had never received the initial funds, and she instructed us to deposit the check that had been lost, an admission that she still owed us the moneyIt is unfortunate this patient chose to be unreasonable in her demands, no one in this office was ever unprofessional with herIn fact, we offered to take payments to replace the $check rather than a one time payment to make it easier on herIn the end, she acknowledged the debt and hopefully the old check will clear and the matter will be closedFinal outcome: the patient acknowledged the debt and instructed us to deposit the check that
