Review: [redacted] has abandoned our project/work agreement. He refuses to return to our home to complete the job and fix what he did incorrectly.

[redacted] and his crew (=family members that may or may not be licensed to do floors and may or may not be in our country legally/as documented individuals/workers) did not communicate with me, he made decisions, independently, without ANY communication, discussion, consultation WHATSOEVER, that affect the appearance of my hardwood floors. Having hardwood floors throughout our home was a lifelong dream of ours. However, this has turned into a NIGHTMARE because of [redacted]'s failures as an installer, contractor, and businessman. Note, it is now the end of September 2013 and this project began in August 2012! You read that right, OVER A YEAR! We notified him on July 16, 2013 and notified him that we HAD to be in our home by September 1st. He did not resume work on the floors until September had begun. Hence, we were forced into an apartment and our belongings/furniture into storage. We have paid [redacted] in excess of $12,000.00 to date. That does not include the cost of the apartment we had to move our family into for the work to be completed and two storage units for all of our furniture/belongings. Additionally, we had our entire home professionally painted prior to the floor work. We spent over $2,000 on the labor and another $1,000 in the materials. [redacted]'s crew damaged paint and walls in nearly every room. We're not just talking a little scrape that could easily be touched up, we're talking significant dents into the drywall like chunks have been taken out of the walls. I was also quite upset to find the entire crew smoking in my newly painted home their first day on the job. Currently, my entire downstairs is unfinished/naked. The entire downstairs MUST be coated with polyurethane before anything is placed on it or our family exists on it. My stairs are visually unpleasing and unfinished (because he made a "contractor's decision about how they should look", as he says...never consulting with us or discussing it with us, this is hard to describe without seeing it first hand but, there is an unfinished, obtrusive edge to each stair where there SHOULD be a lip that continues it around the existing moulding and the risers should be flush with the existing moulding but ARE NOT...instead they are set back at varying distances for each stair as a blatant display of poor workmanship) and my upstairs floor has more uneven seams than even ones, whole carcasses of bugs and other debris stuck under the polyurethane, and planks of wood that obviously should have been discarded rather than installed due to imperfections and grooves in them that run half a feet or longer, are deep enough to get a long fingernail in, and wide enough to put several coins in. He has now proclaimed that he will not return to our home to finish the job! We have paid him in full and he's REFUSING to finish the job and to fix the problems. He is abandoning our project/sales agreement as he stated on Monday, September 23, 2013 that he would not return to our home and finish/complete the job nor would he fix his mistakes. We will now have to incur another month's apartment rental costs and storage costs because not only will it be impossible to find another flooring contractor in less than a week (the time before our 1 month of rent is up) and for said contractor to find the materials and time to finish the floor today or tomorrow but, we do not have the funds. We are out of money. [redacted] has taken every penny our family has and abandoned us with unfinished, incomplete floors. I believe in the greater good of society and the community and it is clear that this individual should not be in business or working in the flooring industry. I will effectively pursue making sure no one else ever suffers financially and emotionally as we have from doing business with this man or his company. I wish this nightmare on no one.Desired Settlement: First and foremost, I want a refund for EVER penny provided to this man/his company. We have paid him $12,725.00. And, we incurred the costs of two months of an apartment rental at approximately $2,000.00 per month (I will provide exact receipts) and storage rental at $400.00 (I will provide exact receipts). Neither of these costs should have been incurred by us had [redacted] completed the job as agreed upon. Additionally, we paid in excess of $2,000 for the entire interior of our home to be professionally painted (and, another $1,000 for the paint) prior to [redacted] and his crew's work in our home. Not only does much of it now need to be repainted, there is a significant amount of drywall repair that must be done prior to it being painted. Additionally, I have paid $400 for a NWFA Inspector to inspect the job. Finally, the cost I must now incur to hire another contractor to complete the floor and fix the problems [redacted] created. That amount is yet to be determined. Honestly, the emotional toll and financial burden this experience has placed on our family has created unreasonable hardship for us and I believe we're entitled to a significant amount of damages for what we've been put through. I also believe strongly that based on the workmanship, or lack thereof, and business practices of [redacted] and his company that this individual/company should not be conducting business at all, certainly not in the flooring industry.

Initial Business Response

Mr. [redacted] came to me in September of 2012 to contract our services for a house that had sat vacant for 3 years. This was supposed to be a week long job, and it has been going for over a year. The husband is fine with our services, however, Mrs. [redacted] is unhappy at every turn. We have been waiting for rescheduled appointment after rescheduled appointment. Then we had to wait for the issue with a medallion to be settled. We were accused of theft, and later proven innocent. This has not been an easy relationship from the start. However, we take customer satisfaction very seriously, and stuck with the job until the bitter end.

The total contract was for $14,500.00. They paid 10% down, and then paid $6,525.00, which is half of the remaining total of $13,050.00. They paid an extra $200.00 for additional work to include the medallion. We had only added $1,400.00 for stair work that was verbally agreed upon, and to date has not been paid. We completed everything that was contract in writing and verbally. At the final walk through, when the work had been completed to what we understood was satisfaction, we were paid $6,000.00. This left a balance of $1,925.00, which was signed off on by the consumer. To date this has not been paid. We do have a legal right to place a lien for the unpaid balance, but do not feel that is in anyone's best interest.

By this time, we were exhausted and had provided many extra additional services that were not charged for to accommodate the customer's changing schedule and preferences for aesthetics. We have dedicated many, many man hours to this job. We have exhausted our time and efforts for the last year in trying to satisfy a customer we still value, but cannot satisfy. I couldn't take the stress of the job continuing, and offered to waive the amount being charged for the stairs and remaining balance totaling $1925.00. Mrs. [redacted] walked off when I presented this offer. Our offer still stands.

At this time, we are going to exercise our right to refuse further service, as we feel this is in the best interest of all parties. We take customer service and the happiness of all our clients seriously, and feel it is very unfortunate we could not meet this customer's expectations. We will use this experience as a tool to fine tune our service in the future.

This is nonsense. I popped the documents (NWFA inspector's report and supporting pictures) that show, plain as day, Mr. [redacted]'s poor workmanship and breach of contract, into the mail today. You should receive them at your offices shortly. I don't know if this back and forth exchange between Mr. [redacted] and myself is part of the Revdex.com process but, it seems that it will not be fruitful. I have hard evidence and witnesses (third party witnesses) and his conduct has been more than just egrigious, it has been criminal. I have involved the District Attorney's office accordingly. I think that it is crucial that Mr. [redacted]'s conduct, illegal activity, as it relates to a clear break if the law in demanding more than 10% of the project prior to its completion, breach of contract, and poor workmanship need to be recorded appropriately with the Revdex.com. Any future, potential consumers must be warned of Mr. [redacted] and his business, [redacted]'s Floors. It would be nothing short of a tragedy for any other person/family to experience the financial and emotional hardship and burden caused by doing business with Mr. [redacted].

Final Business Response

We have worked with her and got her approval every step of the way up until the final walk through, and she didn't have a problem with it. Now that it's finished she can say anything.
