KEYSTONE SKIDLOADER SALES & SERVICE [redacted] Mr& Mrs [redacted] , [redacted] CC: Revdex.c [redacted] Dear Mr& Mrs***: I am in receipt of your several letters and the report that you submitted to the Revdex.comI would like to take this opportunity to tell my side of this story.My name is not Aaron M [redacted] it is Aaron M***I do not have a junk yard I as stated on my letter head and invoice I sell skid loaders and service skid loadersI spoke with both you and your wife on many occasions concerning your purchasing this machineI informed both of you that I would prefer that you visit my place of business and see the machine that we were talking aboutYou both did not show any interest in making the trip to Pennsylvania to look at this machine before you purchased itYou and your wife made the decision to purchase this machine from me I described this machine to both of you before you agreed to this purchase I have been in skid steer sales and service for over eleven years This is the first time I have ever had a complaint filed against meThis complaint is very derogatory and in no way was this machine described to you with any malicious intent to defraud you with your purchaseI clearly explained to both of you on the many occasions that that the machine was a $3,machine that ran and drove and needed some repairsThe trucker that picked up the machine lined up the ramps to his trailerI personally loaded the machine onto his trailer The driver guided me onto the trailer for safety purposesThe driver entered my building after the machine was loaded on his trailer to give me the bill of lading The machine went on the trailer under its own power without any assistance as stated in your letterWhen you asked me how many cylinders the gas engine had I stated to you that I thought it was a three cylinder engineYou told me on the phone that you both had researched the machine and you found that it was a two cyclinder engineI stated to you that the engine was what the factory put in it when it was manufacturedThis conversation occurred before you consented to purchase the machine and sent me the moneyAs to the statement that you made concerning the machine not being delivered immediately was due to waiting on that trucking company to pick it up at my place of businessFrom my understanding you were in contact with the the brokerage company to make payment for deliveryI would like to in closing reinforce to you that even though I unfortunately made an error and neglected to put the serial number on the invoice you will note that the invoice does state USED EQUIPMENT AS ISSincerelyAaron M [redacted] OwnerKeystone Skidloader Sales & Service

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below Regards, [redacted] ***December 8, 2015MrAaron M***Keystone Skidloader [redacted] ***[redacted] ***Dear MrM***:This is in answer to your letter regarding the sale to me of the [redacted] L [redacted] Skidloader machineRevdex.com has assigned this complaint with ID# [redacted] In this complaint I was requesting from you a full refund for both the machine ($3500.) plus the trucking charges ($800.) for a total of $4300.Since you spoke to both my wife and I a number of times, we will each separately give you our account of what happened[redacted] ’s account:The Revdex.com had informed me that this should be kept basically on the information that relates to the sale of that [redacted] skidloader that you sold us and that I should keep my words and comments based on only that and not use other language or words that I would love to use in describing youBut, I will say that you transported me back to the eighth grade, more than a half century ago where little boys tend to lie and steal and in their undeveloped minds, they believe that this is ok to doMost of the time these little boys grow up and they realize that it is not the right thing to do and they start to respect others especially elderly people like my wife and myself.So when it comes to your name (M***) my wife and I had no knowledge of your true last nameIt was not showing on your Bill of Sale and it's not stated on your business cardMy wife spent more than two hours on a borrowed cell phone making calls out there in Pennsylvania making calls to libraries, town halls, city halls and even spoke to Mayors and she had spoken to selectmen in trying to locate the town hall that handles your business there and someone along the line thought your last name was M***So you cannot blame us for that mistake, that is your mistakeIt's obvious that you do not want your name printed anywhere in the way you operate your business and the type of businessman that you areAnd according to finally finding out your actual town hall that you come under, we found someone to speak to there, and they said basically you are not required to have a business license because of your nationality so that's kind of odd, I've never heard of that beforeBut there are strange things and people can get away with things and especially with no business license, you do not have to abide by any laws, rules or regulations that would be set forth of that license and would be enforced.It's obvious what you did to my wife and myself is not new - you were very good at itYou must have done this many times in the past because you were well prepared when I called to use misrepresentation, claims and misleading information once you realized that you had OPPORTUNITY to sell a machine that was nothing more than a salvage machine, completely unrebuildable, unrepairable and unuseableYou obviously had MOTIVE because with the end of the year coming pretty quick, you probably aren't selling very many of your very expensive machines so you needed some quick cashAnd, you had MEANS, either you had some brokendown salvage machines on your property there or according to [redacted] , they told me that there are thousands out there in Pennsylvania which are abandoned so it would be easier for you to go down to a near salvage yard and grab one for a few hundred dollars and maybe that’s why it took you more than a week to try and get it trucked up here from the original date that you had told us.When you talk about the engine size, you claim that I had done research on it prior to sending you a check for it That is really a pretty good lie because I had no way to research it, I had nothing in hand until I received the machine and the next morning after it was delivered as I had mentioned in my letter to you, I took the serial number off the machine and called the [redacted] Coin [redacted] , Pennsylvania and that's when I was informed what engine was actually in that machine when it was builtAnd, I noticed when I looked at it that morning that I could see that it was only a 2-cylinder, not a 3-cylinder as you kept saying it was and I remember that I kept asking youWhen I asked you how often times there was any visible smoke you kept telling me "no" there wasn't any - what you forgot to tell me was that there was nothing visible once this machine was running because of how thick the smoke was coming out of the exhaust - you had it backwards.And, when you mentioned that it had a problem with moisture with the distributor cap and wires, you also didn't look at he machine to realize that the previous owner had put in new spark plugs, champions actually, new wires and a new distributor cap and also a new starter solenoid, some new battery cables and numerous other parts that I saw that had been replaced on it in their last-ditched effort - apparently they did this in order to try to make the engine continue to runWhen I pulled the two spark plugs out myself, I could not believe how cakthey wereIt was obvious that this engine was blownAnd when I took a swab and put it on the end of a straw and I wiped the inside of the cylinders and I saw how much oil that was in there as I stated in my first letter to you, there is nothing else you can ever do to repair this engine because it is so worn out on the upper part of the cylinder wallsAnd when I called [redacted] and explained this to them, they actually took the time to go on the WEBThey searched they said just in case someone had any engines or parts available - they even went on your WEBSITEBecause your claiming in your ad that you have rebuilt engines for skidloaders, they told me that you had nothing either and you knew thatIt's obvious that you had checked this machine out when it came in because you told me the other machine that you had advertised in the magazine that was sold that I originally called about had a 3-cylinder diesel [redacted] engine in there and you did rebuild that machine and you sold it, but you were fully aware of why you could not rebuild this one because there is no way to rebuild it and you knew that the parts had been discontinued in So right from the beginning you wanted to stick someone with itI was the person that called over miles away from Massachusetts and your claiming that you told me that I should come down there and look at it - WOWThere's another good lie and you claimed you even told my wife the same thing - you are really good but not good enough.So, I'm going to finish my part here by telling you, enough is enough Aaron, let's settle this because this is going to be going up on the WEB and it's going to stay up there and it will show everyone what kind of business you run, what kine of businessman you are and how you represent your machines.So if I were you, I would settle this - return my full $plus the $for the trucking and get this machine out of here before the first snowstorm comesBecause, that is the reason why I called you in the first place, to look for a machine that was in running and operating condition - that's what you claimed it wasYou told me that I could use it as it was, it was running and operating in good condition and that it just needed some tires and the issue with the problem with dampnessThe condition and operating of the machine is the exact opposite of what you had told me over the phoneIf I wanted a salvage machine like this one, I sure wouldn't have paid $for it Aaron and I would not have bought it and have it brought over milesI mentioned to you that I had three machines in the pastThere is another machine right around my area here at a local salvage yard and it's a [redacted] and it has a Wisconsin 4-cylinder gas engine in it and actually it runs very well but it needs a little bit of work and I don't have the time or the health right nowI did mention this to you before I agreed to purchase your machine and I had said I needed something immediately for this wintertime because like last year their again predicting that it will be heavy snowMy good friend, who was doing my driveway here which is more than feet long was using a [redacted] with a snowblower on it but he moved awayAnd, I mentioned to you also that I had things to do prior to the snowstorm coming, things I needed to move around and prepare for the snow - now I have nothingYou left myself and my wife completely abandoned here and we have no way to remove the snow and nothing we can doWe cannot find anyone that will come in and do it and we cannot plow my yard because it’s stone.It's obvious you spoke nothing but lies and the lies that you were using in your letter to try and wiggle your way out of it or I should say worm your way out of itIn the past, I had emergency surgery for a [redacted] , and with the damage that was done the doctor had told me to be very careful from now on, act my ageI was not suppose to now lift any more than a gallon of milk and with my ***, I'm not suppose to be out there doing any kind of exertion, especially when it's colder weather even in the wintertime - that is why I could not use a walk-behind snowblowerAnd after your machine was delivered, I spent a good part of two days to try and move this machine with come-a-longs and chains to get it out of the way where it had bean delivered in my back driveway and move it before the snow comesSo obviously, I believed the truck driver when he said he was not there when you loaded it because there was no way this machine had enough power to back itself onto the trailer as the trucker had all he could do to get it off the trailer here in my yard.No way to describe what you did but plain old robberyIf you did it with a gun or a knife, you would have been arrested but because you used a telephone and lies and deception, you figured that it was ok and you believe that you're going to get away with this because you keep insisting that the machine was sold "as is"Maybe you should look up the definition for "as is"That's not a GET OUT OF JAIL CARD, we're not playing a game of monopoly here, this is "real life" AaronWhen you sell something to someone, you have to describe it and give full details what it is and how it operates, if it does run and operate which you claimed this machine didAfter a person has all this knowledge, they can make a decision based on all that information if they want that item - and then from there, once they own it, knowing the truth about what they had purchased, if something happens to it later down the line, beyond the condition of what it was already in, that is called "as is"But you can't use that in this ***, you probably have done that in the past with other machines you have stuck people with.Because I had to try and move that machine out of the way, I did injure myself againI had to go to the doctor's and now I have another doctor's appointment coming upYou turned our lives upside downYou completely destroyed any plans we hadNow we are completely stuck, we have no way that we will be able to get through this winterThat apparently was your intentions in the first place when you rob somebody like you did to us, you wouldn't expect us to feel good about it after and you wanted to inflict as much pain and suffering that you could with your actions and you sure didYou hit the motherloadSo, I'm going to turn the rest of this letter over to my wife because she has a few things that she wants to say to you about the lies in your letter in your answer to us.After my wife had sent you the check, we waited a whole week of anxiety believing we were going to receive what you said that it was and when I walked out to meet the truck driver and when I saw what was sitting on the back of the trucker's trailer, I knew you had robbed meMy wife and I have been living in [redacted] wasting our valuable time before the snow comesIt only took you minutes to commit this crime but now we're serving the time.Now my wife [redacted] account:Eric, I will be responding directly to the wording in your letter.You state and I quote - "I informed both of you that I would prefer that you visit my place of business and see the machine that we were talking aboutYou both did not show any interest in making the trip to Pennsylvania to look at this machine before you purchased it."The above statement is a total lie - you NEVER, EVER said these words to us and I'll tell you why and I can prove itIt's like Judge Judy says "If it doesn't make sense, it's probably not true"You would never have asked us to come to your place over miles away because when we took a look at the machine and its condition - smoking and with a blown engine with only 2-cylinders where my husband wanted at least a 3-cylinder engine, we would have been quite upset having known these facts and seeing the true condition of this machineBut now after this machine has been delivered to us and paid for, you conveniently come up with this idea to mention that you asked us to make the trip and come and look at the machineI know everything that you and I discussed and this NEVER came up in our conversationsBut in making this statement in your letter you apparently want to make it look as if you have nothing to hide about the machine.Next - At several times in your letter you make the statement that you spoke about the machine and said in no way was this machine described with any malicious intent to defraud you with your purchaseFirst of all the only thing you ever said about the machine was that it had bald tires and that when it's damp out that the wires and distributor cap have to be dried out and then the machine runs goodI asked you more than once is there any other problems with the machine and you said "no", that after the wires and cap are dried out the machine runs fine, I notice nowhere in your letter do you even state what you told us about the condition of this machine, you just generalized that you told us that it drove and needed repairsAaron, a blown engine that smokes is not a repair its a needed replacementApparently, you told us just what you wanted us to hearI repeatedly asked you are there any other problems with the machine and you said "no" and this is especially what I wanted to know before I sent you the check for $3500.I quote another paragraph in your letter - "When you asked me how many cylinders the gas engine had I stated to you that I thought it was a three cylinder engineYou told me on the phone that you both had researched the machine and you found that it was a 2-cylinder engineI stated to you that the engine was what the factory put in it when it was manufacturedThis conversation occurred before you consented to purchase the machine and sent me the money." THIS IS ANOTHER LIE - this is not how it happenedPrior to as sending you the check we had no knowledge about the number of cylinders being anything other than what you told us - that is was a 3-cylinder engineWe had no serial number to go by to even check all this outAnd, after sending you the check and you received it, I asked if you had sent us the bill of sale yet and you said "no" that you still have it right there and I asked if you could please send it to usI couldn't understand why you were hesitating mailing it out to us right awayThe first time we knew of the true size of the engine having only 2-cylinders was when the machine was delivered and my husband found it out when he checked the machineIt was only then when we took the serial number off the machine that my husband called the [redacted] Coand they told us immediately that it was a 2-cylinder gas machineActually you NEVER EVEN STATED the serial number on the bill of sale that you sent usSo I again want to emphasize that we did not research the machine until after it was received when we finally had the serial number to do soI especially want to bring attention to the last sentence in the above quoted paragraph and I again quote - "This conversation occurred before you consented to purchase the machine and sent me the money." Apparently, you wanted to add that last sentence to cover the fact that you made an error or purposely told us that it was a 3-cylinder rather than a 2-cylinder because if my husband had known that, he would NEVER had bought this machine as he had mentioned to you that he has been a mechanic for over years and he knew a 2-cylinder machine would not hold up to what it was expected to do and this was reemphasized by the [redacted] Coto my husband when he later called and they told him that this 2-cylinder gas engine machine was discontinued not long after it was manufactured after customers complained that it had to be run at full throttle to get the j ob done and having to do that, the machine did not hold up and its engine would end up blowing.Next - Another paragraph I quote - "I would like to in closing reinforce to you that even though I unfortunately made an error and neglected to put the serial number on the invoice you will note that the invoice does state USED EQUIPMENT AS IS." Yes, your invoice does say "as is" and actually it's printed on the invoice and not written inApparently, regardless what you initially say to the customer and in our case by phone, you conveniently never mentioned to either of us that you are selling it "as is" because that would have put up a red flag indicating to us WATCH YOUR STEP WHAT'S HE HIDINGThe fact that we paid $should not make us believe that we are to understand that because of that price we should expect to consider it an "as is" saleMy husband thought that you asked your asking price because it is a gas engine and not a diesel which happens to be a more popular type machine.Aaron, in closing I would like to say this - you told my husband and I exactly what you wanted us to believe as to that machine's condition and it's operation and you knew if you told us the truth, we would have never purchased itMy husband and I are truthful people and we honestly believed that you were honest about everything you spoke to us about the machineWhen the machine was delivered and the trucker finally got it to start I was looking out the window at the time and when I saw all that smoke I said to myself "oh no" what did Aaron stick us with.I noticed that no where in your letter did you even mention that you would be refunding any part of the purchase price back to us and if you did decide to do so we would expect not only the $for the machine but also the $for the trucking charge because anything less than that would be rewarding you for your dishonesty about the whole sale of this machine to us and I'm speaking now for both my husband and myselfSo Aaron I ask you to consider very carefully how you will handle this because if you don't do the right thing it could come back on you and your businessAnd, who do you think the people are going to believe - you or us.Regards, [redacted] ***DISSATISFIED CUSTOMERS

You state and I quote - "I informed both of you that I would prefer that you visit my place of business and see the machine that we were talking about. You both did not show any interest in making the trip to Pennsylvania to look at this machine before you purchased it."
The above statement is a total lie - you NEVER, EVER said these words to us and I'll tell you why and I can prove it. It's like Judge Judy says "If it doesn't make sense, it's probably not true". You would never have asked us to come to your place over 450 miles away because when we took a look at the machine and its condition - smoking and with a blown engine with only 2-cylinders where my husband wanted at least a 3-cylinder engine, we would have been quite upset having known these facts and seeing the true condition of this machine. But now after this machine has been delivered to us and paid for, you conveniently come up with this idea to mention that you asked us to make the trip and come and look at the machine. I know everything that you and I discussed and this NEVER came up in our conversations. But in making this statement in your letter you apparently want to make it look as if you have nothing to hide about the machine.
Next - At several times in your letter you make the statement that you spoke about the machine and said in no way was this machine described with any malicious intent to defraud you with  your purchase. First of all the only thing you ever said about the machine was that it had bald tires and that when it's damp out that the wires and distributor cap have to be dried out and then the machine runs good. I asked you more than once is there any other problems with the machine and you said "no", that after the wires and cap are dried out the machine runs fine, I notice nowhere in your letter do you even state what you told us about the condition of this machine, you just generalized that you told us that it drove and needed repairs. Aaron, a blown engine that smokes is not a repair its a needed replacement. Apparently, you told us just what you wanted us to hear. I repeatedly asked you are there any other problems with the machine and you said "no" and this is especially what I wanted to know before I sent you the check for $3500.
I quote another paragraph in your letter - "When you asked me how many cylinders the gas engine had I stated to you that I thought it was a three cylinder engine. You told me on the phone that you both had researched the machine and you found that it was a 2-cylinder engine. I stated to you that the engine was what the factory put in it when it was manufactured. This conversation occurred before you consented to purchase the machine and sent me the money." THIS IS ANOTHER LIE - this is not how it happened. Prior to as sending you the check we had no knowledge about the number of cylinders being anything other than what you told us - that is was a 3-cylinder engine. We had no serial number to go by to even check all this out. And, after sending you the check and you received it, I asked if you had sent us the bill of sale yet and you said "no" that you still have it right there and I asked if you could please send it to us. I couldn't understand why you were hesitating mailing it out to us right away. The first time we knew of the true size of the engine having only 2-cylinders was when the machine was delivered and my husband found it out when he checked the machine. It was only then when we took the serial number off the machine that my husband called the [redacted] Co. and they told us immediately that it was a 2-cylinder gas machine. Actually you NEVER EVEN STATED the serial number on the bill of sale that you sent us. So I again want to emphasize that we did not research the machine until after it was received when we finally had the serial number to do so. I especially want to bring attention to the last sentence in the above quoted paragraph and I again quote - "This conversation occurred before you consented to purchase the machine and sent me the money." Apparently, you wanted to add that last sentence to cover the fact that you made an error or purposely told us that it was a 3-cylinder rather than a 2-cylinder because if my husband had known that, he would NEVER had bought this machine as he had mentioned to you that he has been a mechanic for over 45 years and he knew a 2-cylinder machine would not hold up to what it was expected to do and this was reemphasized by the [redacted] Co. to my husband when he later called and they told him that this 2-cylinder gas engine machine was discontinued not long after it was manufactured after customers complained that it had to be run at full throttle to get the j ob done and having to do that, the machine did not hold up and its engine would end up blowing.
Next - Another paragraph I quote - "I would like to in closing reinforce to you that even though I unfortunately made an error and neglected to put the serial number on the invoice you will note that the invoice does state USED EQUIPMENT AS IS." Yes, your invoice does say "as is" and actually it's printed on the invoice and not written in. Apparently, regardless what you initially say to the customer and in our case by phone, you conveniently never mentioned to either of us that you are selling it "as is" because that would have put up a red flag indicating to us WATCH YOUR STEP WHAT'S HE HIDING. The fact that we paid $3500 should not make us believe that we are to understand that because of that price we should expect to consider it an "as is" sale. My husband thought that you asked your asking price because it is a gas engine and not a diesel which happens to be a more popular type machine.
Aaron, in closing I would like to say this - you told my husband and I exactly what you wanted us to believe as to that machine's condition and it's operation and you knew if you told us the truth, we would have never purchased it. My husband and I are truthful people and we honestly believed that you were honest about everything you spoke to us about the machine. When the machine was delivered and the trucker finally got it to start I was looking out the window at the time and when I saw all that smoke I said to myself "oh no" what did Aaron stick us with.
I noticed that no where in your letter did you even mention that you would be refunding any part of the purchase price back to us and if you did decide to do so we would expect not only the $3500. for the machine but also the $800. for the trucking charge because anything less than that would be rewarding you for your dishonesty about the whole sale of this machine to us and I'm speaking now for both my husband and myself. So Aaron I ask you to consider very carefully how you will handle this because if you don't do the right thing it could come back on you and your business. And, who do you think the people are going to believe - you or us.

But, I will say that you transported me back to the eighth grade, more than a half century ago where little boys tend to lie and steal and in their undeveloped minds, they believe that this is ok to do. Most of the time these little boys grow up and they realize that it is not the right thing to do and they start to respect others especially elderly people like my wife and myself.So when it comes to your name (M[redacted]) my wife and I had no knowledge of your true last name. It was not showing on your Bill of Sale and it's not stated on your business card. My wife spent more than two hours on a borrowed cell phone making calls out there in Pennsylvania making calls to libraries, town halls, city halls and even spoke to Mayors and she had spoken to selectmen in trying to locate the town hall that handles your business there and someone along the line thought your last name was M[redacted]. So you cannot blame us for that mistake, that is your mistake. It's obvious that you do not want your name printed anywhere in the way you operate your business and the type of businessman that you are. And according to finally finding out your actual town hall that you come under, we found someone to speak to there, and they said basically you are not required to have a business license because of your nationality so that's kind of odd, I've never heard of that before. But there are strange things and people can get away with things and especially with no business license, you do not have to abide by any laws, rules or regulations that would be set forth of that license and would be enforced.It's obvious what you did to my wife and myself is not new - you were very good at it. You must have done this many times in the past because you were well prepared when I called to use misrepresentation, false claims and misleading information once you realized that you had OPPORTUNITY to sell a machine that was nothing more than a salvage machine, completely unrebuildable, unrepairable and unuseable. You obviously had MOTIVE because with the end of the year coming pretty quick, you probably aren't selling very many of your very expensive machines so you needed some quick cash. And, you had MEANS, either you had some brokendown salvage machines on your property there or according to [redacted], they told me that there are thousands out there in Pennsylvania which are abandoned so it would be easier for you to go down to a near salvage yard and grab one for a few hundred dollars and maybe that’s why it took you more than a week to try and get it trucked up here from the original date that you had told us.When you talk about the engine size, you claim that I had done research on it prior to sending you a check for it.  That is really a pretty good lie because I had no way to research it, I had nothing in hand until I received the machine and the next morning after it was delivered as I had mentioned in my letter to you, I took the serial number off the machine and called the [redacted] Co. in [redacted], Pennsylvania and that's when I was informed what engine was actually in that machine when it was built. And, I noticed when I looked at it that morning that I could see that it was only a 2-cylinder, not a 3-cylinder as you kept saying it was and I remember that I kept asking you. When I asked  you how often times there was any visible smoke you kept telling me "no" there wasn't any - what you forgot to tell me was that there was nothing visible once this machine was running because of how thick the smoke was coming out of the exhaust - you had it backwards.And, when you mentioned that it had a problem with moisture with the distributor cap and wires, you also didn't look at he machine to realize that the previous owner had put in new spark plugs, champions actually, new wires and a new distributor cap and also a new starter solenoid, some new battery cables and numerous other parts that I saw that had been replaced on it in their last-ditched effort - apparently they did this in order to try to make the engine continue to run. When I pulled the two spark plugs out myself, I could not believe how caked-up they were. It was obvious that this engine was blown. And when I took a swab and put it on the end of a straw and I wiped the inside of the cylinders and I saw how much oil that was in there as I stated in my first letter to you, there is nothing else you can ever do to repair this engine because it is so worn out on the upper part of the cylinder walls. And when I called [redacted] and explained this to them, they actually took the time to go on the WEB. They searched they said just in case someone had any engines or parts available - they even went on your WEBSITE. Because your claiming in your ad that you have rebuilt engines for skidloaders, they told me that you had nothing either and you knew that. It's obvious that you had checked this machine out when it came in because you told me the other machine that you had advertised in the magazine that was sold that I originally called about had a 3-cylinder diesel [redacted] engine in there and you did rebuild that machine and you sold it, but you were fully aware of why you could not rebuild this one because there is no way to rebuild it and you knew that the parts had been discontinued in 1992. So right from the beginning you wanted to stick someone with it. I was the person that called over 450 miles away from Massachusetts and your claiming that you told me that I should come down there and look at it - WOW. There's another good lie and you claimed you even told my wife the same thing - you are really good but not good enough.So, I'm going to finish my part here by telling you, enough is enough Aaron, let's settle this because this is going to be going up on the WEB and it's going to stay up there and it will show everyone what kind of business you run, what kine of businessman you are and how you represent your machines.So if I were you, I would settle this - return my full $3500. plus the $800. for the trucking and get this machine out of here before the first snowstorm comes. Because, that is the reason why I called you in the first place, to look for a machine that was in running and operating condition - that's what you claimed it was. You told me that I could use it as it was, it was running and operating in good condition and that it just needed some tires and the issue with the problem with dampness. The condition and operating of the machine is the exact opposite of what you had told me over the phone. If I wanted a salvage machine like this one, I sure wouldn't have paid $4300. for it Aaron and I would not have bought it and have it brought over 450 miles. I mentioned to you that I had three machines in the past. There is another machine right around my area here at a local salvage yard and it's a [redacted] 510 and it has a Wisconsin 4-cylinder gas engine in it and actually it runs very well but it needs a little bit of work and I don't have the time or the health right now. I did mention this to you before I agreed to purchase your machine and I had said I needed something immediately for this wintertime because like last year their again predicting that it will be heavy snow. My good friend, who was doing my driveway here which is more than 300 feet long was using a [redacted] with a snowblower on it but he moved away. And, I mentioned to you also that I had things to do prior to the snowstorm coming, things I needed to move around and prepare for the snow - now I have nothing. You left myself and my wife completely abandoned here and we have no way to remove the snow and nothing we can do. We cannot find anyone that will come in and do it and we cannot plow my yard because it’s stone.It's obvious you spoke nothing but lies and the lies that you were using in your letter to try and wiggle your way out of it or I should say worm your way out of it. And after your machine was delivered, I spent a good part of two days to try and move this machine with come-a-longs and chains to get it out of the way where it had bean delivered in my back driveway and move it before the snow comes. So obviously, I believed the truck driver when he said he was not there when you loaded it because there was no way this machine had enough power to back itself onto the trailer as the trucker had all he could do to get it off the trailer here in my yard.No way to describe what you did but plain old robbery. If you did it with a gun or a knife, you would have been arrested but because you used a telephone and lies and deception, you figured that it was ok and you believe that you're going to get away with this because you keep insisting that the machine was sold "as is". Maybe you should look up the definition for "as is". That's not a GET OUT OF JAIL CARD, we're not playing a game of monopoly here, this is "real life" Aaron. When you sell something to someone, you have to describe it and give full details what it is and how it operates, if it does run and operate which you claimed this machine did. After a person has all this knowledge, they can make a decision based on all that information if they want that item - and then from there, once they own it, knowing the truth about what they had purchased, if something happens to it later down the line, beyond the condition of what it was already in, that is called "as is". Review: see Attached documentRe: L-[redacted] Skidloader RefundTO WHOM IT MAY CONCERN:You will find enclosed with this cover sheet a copy of the letter that I had sent "certified" to the dealer requesting a full refund and explaining to him the reason why. Also you'll find a copy of the bill of sale as well as my check to him of $3500. in payment of the purchase of this machine.This is nothing but a clear case of larceny. This dealer had MOTIVE, obviously he needed quick money because of the end of the year and probably has a lot of bills like we all do and probably because of the holidays coming up and probably he hasn't been doing too well on his sales of the actual machines that he has advertised which are between $15,000 and $20,000 each. He also had MEANS, he runs a junkyard there and does have plenty of these salvage machine skidloaders around. And, of course, he had OPPORTUNITY being a customer as I was living more than 450 miles away and being out of state, that he could lie to me, use false statements, misrepresentation and basically tell me anything and everything I wanted to hear. I believed what he was saying and I had no other choice because I could not see this machine and this is exactly what this dealer did.My wife and I have been looking for a machine like this. I had three in the past thoughout the years, I'm not in the business but I do have a small piece of propery here in [redacted] and I do have a 300 ft. driveway up to my barn and the machine would be handy for the wintertime and other projects that I need to do and things I need to move around. But because of my age and my health issues, I decided to purchase another skidloader to use especially now because winter is right around the corner and they are predicting another heavy winter like we had last year - we were completely snowed in last year. And, being seniors ourselves with all we have to do, it's been very difficult. So I started looking this past January and called many dealers in the book that this Keystone Skidloader Co. advertises in which is [redacted]. So when I came across this dealer - Keystone Skidloader in Roaring Spring, PA, he was advertising one for less money than the other machines that he usually advertises in that [redacted] magazine which were between $15,000. and $20,000.. He said that he had sold that machine but that he had a duplicate just like it but rather than being a 3-cylinder diesel engine, he said this other one had a 3-cylinder gas engine in it. Being a mechanic myself for more than 45 years, I proceeded to ask any questions that I could think of about the engine, how the machine operates, the condition of the machine overall and anything else that came to mind. And he kept answering me "yes" that everyting was fine and that the machine runs good and operates well and could be used the way it is. He did say the only thing was that it needs some tires and that when it rains out or has dampness in the air and the engine gets damp, it would be hard to start and it was probably to do with the plug wires and the distributor cap but that when these things are dried out the machine works good. He lied, it has new wires and cap.I placed at least three calls before my wife and I decided to purchase this machine. His asking price was $3500. and he said trucking on this to deliver it would be somewhere between $800. and $900. and he could find a local trucker out there that could bring it up here which is about 450 miles one way.Before we sent this dealer (Keystone Skidloader) a check, my wife placed a call and spoke to the same person I had spoken to (Aaron M[redacted] - Owner of Co.) and also asked him about this machine and he gave her the same answers that he gave me. So my wife and I decided at that time that it sounded like a very good deal so we told him that we would be sending him a check for $3500. as soon as possible and when he received the check to call and let us know when the machine could be delivered here. He did in a few days and he scheduled a time that the machine would be picked up from his place of business and delivered to our home in [redacted]. But this did not happen, we waited an additional five days. Apparently, there was something wrong but we could not figure out what it was. We placed calls to his business but could not get a straight answer. He just said the machine would be coming as soon as possible. It did finally arrive a week later on a Wednesday evening just around 6:00PM and when the truck pulled up in front of my property here, I went out and could not believe what I saw. The machine was so rusted and beaten up, literally it was nothing more than a salvage machine, clearly not what he had described it to be on the numerous phone calls we had placed to his business.When the driver tried to unload it, it took him about 10 to 15 minutes to try and get it started and when it did start, the noise was so loud coming out of the engine and the transmission and the smoke was so heavy that I had to move away from the area as soon as possible because of my health issues. The driver continued to try and move this machine off his trailer with great difficulty and took quite a bit of time because it just would not move. Finally he did get it off and shut it off immediately and I walked up to talk to him and he told me did I know what I was purchasing and I said this is not what the dealer had described to me. And, I asked the driver was he there when this dealer loaded this machine onto his trailer and he said "no" that he was inside the dealer's office and he believed that this dealer had loaded this with another machine, apparently because it does not run and that it's nothing more than a salvage machine. I asked the trucker did this dealer have other machines like this and he said that's all he has and said he is a junkyard and that is all he does is sell parts. The next day after I had checked this machine out, my wife called this business and told him what had happened and that we wanted our money back and he told my wife simply that we had bought it "as is" and that there were no refunds and my wife said to him it's not as you described it to my husband - but that it smokes and it's a 2-cylinder and not a 3-cylinder and that it is in very poor condition and appears to have a blown engine. The dealer said nothing else so my wife said you'll be hearing from us.My wife and I did not realize we could possibly be a victim of a scam because of the way the dealer handled everything. This is the information of course that you would have. But in our [redacted], my wife and I are not going to take this lying down so I decided to find out any information I could about this particular machine which is a [redacted] Skidloader. I called the [redacted] dealer there in [redacted] PA after looking in the machine and found an operation manual and I took the serial number and when I placed the call to [redacted], the representative there told me that this machine was built in March 1988 and he said that they had previous machines in the past years before that worked out pretty good. And these machines were specifically made for farmers which is more under Agriculture compared to [redacted] or [redacted] skidloaders so they decided in 1985 to come out with this type design -the L-[redacted] which was the 3-cylinder diesel engine and then came out with a [redacted] which is the one that I have and its only a 2-cylinder gas engine. He said they never made a 3-cylinder gas engine as Keystone had described. He had to be aware of this. According to [redacted], they know of Keystone very well. This [redacted] Corporation said that this machine was discontinued in 1992 because it had serious manufacturing engineering defects in it and not just the engine itself which would not hold up because it was so underpowered, it had to be run at full throttle all the time and there were numerous complaints soon after this machine was introduced to customers. And, there were thousands of machines out there in PA that are abandoned and said there are no parts, no way to rebuild them because there are no original manufactured or aftermarket parts anywhere. And, he said clearly that is all this machine is, its unusable, unrebuildable that I was stuck with from this dealer and this dealer clearly had to know this.My wife and I want a full refund of the $3500. plus the $800. that we had to pay for trucking to get the machine here. And, I am aware according to my local Revdex.com that sometimes the businesses do not refund the full amount but this is due to people that decide to return something because they don't like it after they get it or their disappointed in it. But in this case it's clear cut deception, selling me something unusable and cannot be rebuilt in any way whatsoever.Also I want to bring to your attention on the Bill of Sale that the dealer did not put down the serial number. We bought this machine in good faith and trusted the dealer to tell us the truth about this machine. He told us it's a 3--cylinder engine and it's a 2-cylinder, he said it doesn't smoke and it does, he said only problem was bald tires and that wires and cap had to be dried out when damp and then machine runs good, that was also untrue - it runs terrible. Also he did not tell us that engine is blown and it is. Also, apparently dealer feels if he has "as is" on Bill of Sale" which is actually printed right on the form, that he is covered on anything wrong with the machine whether he told us or not. My wife and I both asked the dealer repeatedly is there anything else wrong with the machine and he said no I told you everything.Anything less than the full refund for the machine and shipping, ($4300) would be rewarding the dealer for his misrepresentation and mistruths.
