The added details from the [redacted] 's are factually incorrect But as mentioned we have agreed to make the repair that [redacted] and DB mutually determined would be an appropriate solution Regardless of some dry weather it has been difficult to complete the repair due to the rain DB will make every effort to complete the repair of the sagging pavers on the face of the firepit step the week of July 31st, This is obviously weather permittingAs for the drainage line we will not provide reimbursement for this Per our contract, we were never made aware of any buried lines in this area by either homeowner nor was the line itself visible during construction

DB Lawn & Landscape, Incwas hired by the ***'s over two years ago At the beginning of construction we experienced excessive amounts of rain prior to and during the installation of their new outdoor space No excuses were ever given to the ***'s other than previous projects have been delayed due to the weather and that we were running behind on starting theirs The Ohio river even flooded this year We have a policy that prevents us from excavating, installing gravel/pavers if the ground is saturated The grounded swells with moisture and therefore will cause settling once it dries out.When we first met with DB, we discussed on multiple occasions that time was of the essence with our patio constructionDB gave us his word that he would begin the project by the end of April and supply a full crew on our jobOur very first delay was not even weather-dependentRather, in an email sent to us on April 25, David delayed the start of our project because he was taking a week-long vacationHe promised to do his best to have the project completed by Memorial Day, since we had a scheduled party on our new patio based on our prior discussions with DavidNot only was the patio not done for Memorial Day, it wasn’t even complete for the 4th of JulyIn fact, our final payment was not even requested until July 28, which we promptly paid on July Very rarely were more than two crewman working on our jobWhen we questioned David about the full crew he promised, he always had a reason as to why the men were not there.No promise was made that a project of this size would only take weeks All of our projects are custom and ever changing Clients frequently make changes and add to the scope mid project This too was the case with the ***'s*** added several items once we started his project which in return delayed completion A larger drainage pipe/culvert extension was added, regrading and sod of this entire area, additional landscaping near the existing garage, skirting of the existing deck, and finally the installation of additional lights. We understand we added some smaller enhancements to the project, but we were never told it would have a significant delay on the completion of the patioWe do not dispute adding the culvert extension; however the landscaping near the existing garage and deck skirting was a part of the original agreementAdditionally, we hired an outside electrician to finish the installation of the outdoor lighting because DB stopped showing up on the project.The delivery of the custom paving stones they selected were delayed due to manufacturing issues outside of our control It took an additional weeks from time of ordering for delivery Once they arrived several bundles had bad efflorescence coming through the face of the pavers These needed to be removed, sent back, and new ones delivered.At no time were we notified that the delivery of the custom paving stones was delayed because of manufacturing issues.DB Lawn & Landscape, Incprides themselves on standing behind everything we do If there is an issue we are the first to stand behind our work There are times when some things are not covered under warranty and we still provide remedies at no cost to the client This is the case with the *** project Our contract firmly states we are only required to fix any patio that settles more than a 1/4" Any settling less than that is settling and not covered under warrantyWe raised pavers that were barely out of level on several different occasions for the ***'sWe even resanded several areas on their patio too At no time has DB refused to make any required remedies that we are responsible for DB was notified on February 23, of vertical pavers surrounding the fire pit that have sagged considerably more than 1/4"Additionally, one of the lights that DB installed came unglued because of the excessive saggingDB acknowledged via text on February 24, and said “I can probably get that completed next week.” Photos were sent to himThree months later, on June 1, 2017, a crew came out and leveled a few horizontal pavers and threw down some sand (mentioned above)However, DB did NOT fix the problem for which we contacted himThe two crewmen that showed up claimed to know nothing about the excessive sagging, and despite being on site, said they would have to talk to David before they could help us*** sent an additional text on June 1, with pictures of the unresolved issuesDavid replied that it was too wet to fix it that day, but sent another text on June 2, that stated, "***, Axel will be there first thing tomorrow morning to raise the pavers on the face of the stepI apologize for saying we will get by today and not being able to make itWe had some unexpected personnel issues this morningBut we will 100% be there tomorrow morningThanks." While the crew showed up the next day, they did not raise the pavers appropriatelyIn the meantime, we contacted ***, the paver company who recommended DB as an authorized contractorThe *** rep, David Roscoe, spoke to DB and gave him four weeks to fix the fallen paversRoscoe visited the property with his regional manager on June 5, Both *** reps on site acknowledged that our request was reasonableThe rep sent a text to David and us requesting the work be completed by July 7, We were never contacted by DB, nor did he fix our patio in the four-week time spanIn fact, he has not returned to the property to fix the issue to date.There are pavers installed on the face of step treads that slightly sag over timeThis is due to the weight of the paver and size At the time of installation these areas were only supposed to have a stucco finish on them.This is simply untrueWe never agreed to stucco on any aspect of our project.But I agreed, in good faith, to include facing the areas with the matching pavers at no additional cost There was no additional cost because this was part of the original design.I even told *** at the time of installation that settling will most likely occur due to the weight of the pavers This is untrueWe never had these conversations with DBThe vertical pavers are glued to the foundation, so they don't settle, they simply separate and fall.In order to prevent future settling we have determined a fix that will hopefully eliminate it An appropriate fix was discussed with the *** reps that includes putting down a mortar base and setting the pavers on top, so the weight of the paver would not be an issue, and thus prevent sagging.For this fix to take place the conditions need to be 100% dry before and after. We are waiting on favorable conditions to complete this repair Since DB was notified of our issue in February, there have been many stretches of dry conditions, confirmed by the *** rep, where this work could have been completed.As far as "screening" calls that is the furthest thing from the truth and DB would never intentionally not answer a clients callThere is a full call/text log to further prove we do not screen calls We have many text messages and voicemails that went unansweredWe also have a text log to show his lack of communication and unanswered texts.I have had communications with *** both over the phone and through text after hours on several occasions. The only call I ignored was on May 3rd when I was on the way to the hospital with my wife who was in labor with our first child*** proceeded to call back from a blocked number in which I answered thinking it may be the hospital/doctor calling.This is untrueWe have a call log showing DB answered this particular phone call from ***'s cell phoneFurther, this proves our point that we were still trying to have our problem resolved months after we first notified DB.The buried downspout line is not the responsibility of DB Lawn & Landscape, Incthis is an issue that was just brought to our attention years from installation.DB was notified less than years from installation of the problemWhen we determined that the blocked downspout was the source of mulch washing onto our patio, we contacted our plumber to take a lookOur plumber found that the end of the pipe connecting to the downspout was buried by DB's culvert workWe then had a specialist use a tracking device to find the end of our pipeIt was then dug up and reroutedAfter discussing this issue with our lawyer, we know the contractor has responsibility because the pipe was exposed, not buried.Our contract firmly states we are not responsible for underground utilities installed by homeowners, invisible dog fence lines, downspouts, etcthat are not brought to our attention prior to installationThe line in reference was not visible and if it was we would have redirected it.The downspout to which we are referring was clearly visibleIt is a large white PVC pipe that was not buried underground or overgrown with weeds, as it was installed just a year priorIt was also obvious that the pipe terminated in the culvert that DB reconfigured.*** Ohio never told DB or myself that we MUST provide specific remediesDB and *** mutually agreed to a possible long term solution that we thought might work*** Ohio would be more than happy to provide their account of this as well.The text to David and *** on June 9, at 4:11pm from *** rep, David Roscoe states, "Gentleman- I wanted to send this text out to make sure we are all on the same page***- I spoke with David yesterday and he has agreed to fix areas of your patio#1: The vertical paver that has visible glue will be cleaned and refastened#2: The vertical pavers on the riser of the fire pit area will be removed, raised up with a mortar footer and refastenedDavid has agreed to complete these two tasks within weeks of today, which gives us a deadline of July 7th." David did not respond to this text nor complete either issue to date

*** ***Because *** has been involved in this situation, the *** rep was aware of our additional concerns and he stated that he had conveyed these concerns to DB DB has had no communication with us regarding these remedies The light that needs to be glued was glued prior to DB's staff coming out to our house They dislodged it while they were trying to fix the vertical pavers The extra glue that was left on the side paver is an example of poor quality workmanship and needs to be cleaned off.In regards to the pattern that was replaced incorrectly, I have photos to prove that they were not replaced the way that they originally were placed The pattern is wrong and the pavers need to be moved DB still has not addressed or taken responsibility for the drainage problem that they created That needs to be addressed

DB Lawn & Landscape has made all appropriate repairs per manufacturers suggestions and in accordance to all applicable building codes.  As far as a light not being secured we were unaware of this and it is a very easy fix to add a small amount of glue.  The pattern on the step riser is a running bond pattern.  After the pavers were secured we reinstalled the pavers in the same running bond pattern.  In regards to the sand we typically do not include polymeric sand under any warranty.  However, we resanded all pavers in the repair area upon completion.  The new polymeric sand was installed per the manufacturers specifications.  Lastly, in regards to a little excess glue DB will gladly send someone out to remove this.  It must have been a very small area that was not easily visible.

they knocked off a light that needs to be reglued.  They did not correctly sand in the pavers that they set and they incorrectly replaced the pattern on the pavers that they removed.  The paver that they glued on the side of the steps is now glued but they didn't clean off the old yellow glue so it is affixed but looks terrible.

The added details from the [redacted]'s are factually incorrect.  But as mentioned we have agreed to make the repair that [redacted] and DB mutually determined would be an appropriate solution.  Regardless of some dry weather it has been difficult to complete the repair due to the rain.  DB will make every effort to complete the repair of the sagging pavers on the face of the firepit step the week of July 31st, 2017.  This is obviously weather permitting. As for the drainage line we will not provide reimbursement for this.  Per our contract, we were never made aware of any buried lines in this area by either homeowner nor was the line itself visible during construction.
