As previously noted in our last response, we will not be commenting further on this issue. We have severed all past, present and future relations with Ms. [redacted] and Mr. [redacted] . Additionally, we have offered a fair and reasonable settlement to them twice, which they have declined.We are declining the invitation to perform an inspection. Ms. [redacted] and Mr. [redacted] have made it very clear that they do not want to do business with KGL Construction, and KGL Construction has reciprocated those same feelings. Seeing as the relationship is irreparable we are no longer comfortable entering their property.

This email is in response to Complaint ID [redacted] made by [redacted] and [redacted] , located at [redacted] ***.According to the complaint, Mr [redacted] and Ms [redacted] have stated that their new floor tile was installed incorrectly causing the grout around the floor tile to crack throughout their kitchen and bathroomThe complaint also states that they are no longer interested in doing business with us, and that they are requesting a full refund for material and labor costs.Attached are copies of our signed agreements with Mr [redacted] and Ms [redacted] Please note that the installation of the kitchen and bathroom floors were not included in the original contract, which was signed August 23, The installation of the flooring was added onto an additional contract, aptly referred to as EXTRAS, which was signed October 9, 2014.As indicated in our contract, Mr [redacted] and Ms [redacted] supplied all materials (tile, glue and grout) KGL Construction only supplied labor Please note that the new flooring that was installed is a Luxury Vinyl Tile (LVT), NOT a ceramic tile.Prior to new flooring installation, it was noted that the existing floor consisted of one (possibly two) layers of sheet vinyl KGL Construction had a verbal conversation with Mr [redacted] and Ms [redacted] informing them it was KGL Construction's recommendation, as well as Manufacturer recommendation, to remove the existing layers of flooring down to the original sub-floor and to properly install new underlayment for the best results To do this, all existing base cabinets and fixtures would need to be removed, and re-installed after the new flooring installation KGL Construction indicated that this extra work could be provided at a rate of $per man hour (as indicated on the contract), estimating it would take approximately man hours Mr [redacted] and Ms [redacted] indicated that they were not interested in having the additional work performed and requested that the new flooring be installed over the existing floor KGL Construction informed Mr [redacted] and Ms [redacted] that this work could not be warranted as the Manufacturer recommended installation procedures were not being followed They acknowledged and accepted the void in warranty from both KGL Construction and the Manufacturer.Most recently, Mr [redacted] contacted KGL Construction via text message with regards to this issue Below is the text message conversation KGL Construction had with Mr [redacted] We apologize that we do not have the text messaging file to send to you at this time and are working on retrieving it in a shareable file format.September 20, 2015:Mr [redacted] : Hi [redacted] my kitchen floors grout is cracking all over the place From what I have read the tiles are moving because the thin set wasn't thick enough We can't keep up with repairing it.KGL Construction: We didn't use thin set They got applied over your existing vinyl It is probably cracking because your whole house is shifting with the weather changes I can stop and take a look but ***'t know exactly what we are going to do.Mr [redacted] : My issue is the tiles should have been put down on a sub floor after the vinyl floor was removed It seems the tiles are moving because of the vinyl floor under them I realize there is no recourse but I am very disappointed.September 29, 2015Mr [redacted] : Hey [redacted] I talked to a gentle man that dose tile for a living He said that you never lay tile over lanoleum Cause when we step on the tiles they move thus the grout cracks We payed $dollars for the flooring not counting labor I would hope you back up your work and in some way repair this problem.KGL Construction: What would you like me to do I told you guys when we did the job that the floor should be torn up but you didn't want to at that time I have installed over vinyl before and not had an issue Most of the problem probably is that there is multiple layers of flooring on there.KGL Construction feels that the work and service provided was in alignment with our contractual obligations It is unfortunate that Mr [redacted] and Ms [redacted] felt the need to pursue this issue in this manner, as we were willing to work toward a resolution As you can see in the conversation above, when asked what they would like to see KGL Construction do for them, there was no response KGL Construction prides themselves on providing superior customer service with honesty and integrity.KGL Construction denies any wrongdoing in this matter and does not feel that Mr [redacted] and Ms [redacted] are entitled to a refund for materials or labor costs They were fully informed of the potential risk with not following Manufacturer or Contractor recommendations.Thank you for your time in this matter Please feel free to contact us with any further questions or concerns.Respectfully, [redacted] KGL Construction, LLC###-###-####

Construction LLC is incorrect in my view and only used to bolster his position
Certain discrepancies in KGL’s response letter are as follows in quotation marks:“KGL Construction had a verbal conversation with Mr*** and Ms*** informing them it was KGL Construction's recommendation, as well as Manufacturer recommendation, to remove the existing layers of flooring down to the original sub-floor and to properly install new underlayment for the best results”The conversation KGL claims above is
incorrectThe conversation between KGL and me was that I asked if he could
install new tile in our kitchen and bathroomWe informed him that there was
two existing layers of vinyl linoleum and asked if by installing the new tile
over the linoleum would cause problemsHe stated that he had ***e it before
and hasn’t had any problemsKGL also stated this in a future text message, “I
have installed over vinyl before and not had an issue.” I had taken his
recommendations in respects to other areas of the houseWhy wouldn’t have I
taken his recommendation for the floor?“KGL Construction indicated that this extra work could be provided at a rate of $per man hour (as indicated on the contract), estimating it would take approximately man hours.”At no point in our conversations did he
mention the flooring would have taken man hoursIf I was aware the subfloor/linoleum
would have caused future problems I would have torn up the floor myself, along
with my husband and nephew to save approximately $900.“KGL Construction informed Mr*** and Ms*** that this work could not be warranted as the Manufacturer recommended installation procedures were not being followed. They acknowledged and accepted the void in warranty from both KGL Construction and the Manufacturer.”At no point in time did I agree to void
any type of warranty implicitly or explicitlyWe were not even aware KGL had a
separate warrantyWith the cost of the tile, glue, grout, and labor, no
rational person would void the warranty willinglyI was never informed either
of the warranties was being voidedWhen KGL was installing the new tile over
existing linoleum, another sub-contractor told him not to put new tile over the
existing linoleumKGL told the sub-contractor that he has ***e it before
without any problems.“I told you guys when we did the job that the floor should be torn up but you didn't want to at that time. I have installed over vinyl before and not had an issue. Most of the problem probably is that there is multiple layers of flooring on there.”We were not told that the existing
linoleum should have been torn up before the new tile was to be installedThe
first time we questioned KGL about the cracks in the floor he stated it was
from the house shifting, now, in this text message, he states the problem stems
from multiple layers of linoleumIn this text message KGL contradicts himself
by stating he recommended that we tear up the existing linoleum, but the next
sentence he states that he has installed over vinyl before and not had an
issueThe latter is what we were told.“KGL Construction: What would you like me to doAs you can see in the conversation above, when asked what they would like to see KGL Construction do for them, there was no response.”After Mr*** texted KGL about the
grout cracking and asking if KGL could back up their work and repair this
problem, the response was the text aboveAs a professional, KGL should not be
asking the consumer how to fix the flooringThis is the reason I did not
respond, and I do not want any further work performed by this contractor“It is unfortunate that Mr*** and Ms*** felt the need to pursue this issue in this manner, as we were willing to work toward a resolution.”At the time the resolution should have
been fixing the floor as we requested, but now believe a fair resolution should
a partial refundWhen my husband and I decided to remodel
our home, we hired KGL by recommendation from our nephewOur nephew worked
with the owner of KGL at a previous businessWe are satisfied with the
majority of work performed by this contactor, but the main issue is the floor
During the remodeling, we had taken KGL’s recommendations on other repairs,
which we believe was in our best interestIt was never recommended that we
tear up the existing layers of linoleum or that we would be voiding any
warranty, if he recommended tearing up the linoleum we would have complied as
we did with other recommendationsIn conclusion, the floor is going to
have to be replaced because the grout is constantly cracking and the tile is
lifting upAs stated above, we feel that we deserve a partial refund of the
