Review: Real estate agent [redacted] of Kian Realty was hired to sell my apartment at [redacted] in Manhattan. Based on my observations and research of the current real estate market. I find that [redacted] is not marketing my apartment sufficiently, has made poor recommendations, does not provide status updates, and caught him in lies and irresponsible behaviors in regards to how he represents my apartment.

I have E-mailed and spoken to [redacted] and the [redacted] of Kian Realty, [redacted] regarding this disappointing performance and desire to end our relationship. Unfortunately, there are no service level commitments in the contract and I am now a slave to their company until December **, 2014 to pay a commission fee, even if I sell on my own or with another agent. I feel I was oversold by [redacted] on the service levels and ethic standards he committed and was duped into signing the agreements as [redacted] verbally assured me that if he was not performing as expected, we could terminate the agreement.

Kian Realty has offered to replace [redacted] with another agent of their choice, however, this is not a fair solution and was coerced upon me due to lack of other options.

Issues of service include:

1. Promotes himself to potential buyers and his services instead of promoting my apartment

2. Poor follow-up on results of open houses as verbally promised; does not provide names of visitors or sources of how each visitor found the apartment; constantly chasing [redacted] for answers

3. Lost keys and reluctancy to take responsibility to replace; all three apartment locks need to be replaced at the expense of Kian Realty / [redacted] as there is now a security breach in my apartment.

4. Poor pricing strategy resulting in over-pricing the apartment; suggests a series of price cuts over time instead of pricing correctly the first time.

5. Poor marketing strategy details; uses open ended statements of how he promotes on tons of websites and shares with tons of colleagues but has no evidence to support claims with the exception of the MLS listings and NY Times, which is clearly not an acceptable. I spoke with several other real estate agents in the neighborhood and none of them were aware of my apartment sale or of [redacted], a lie from [redacted] about promoting in the neighborhood. Visited local college message boards including [redacted] College and [redacted] college to verify marketing as promised by [redacted] and none existed.Desired Settlement: Termination of the contracts in association with the sale of [redacted] without penalty. Remove all marketing materials and documentation associated between [redacted] and Kian Realty / [redacted] to appear as the relationships never existed.

Kian Realty has agreed to cancel my contract and it is effectively cancelled today.

Review: On Monday February **, 2014, my husband and I gave [redacted] a money order for $100.00 to have an application processed. We were applying for an apartment at [redacted]. The money order was made out to Beach Lane Management, Inc. [redacted]. Neither [redacted] or his boss, [redacted] are returning our calls or emails and we have not been refunded our $100.00. This is my second response to this complaint. Here is the first response.

I received a phone call from [redacted] in the third week of February regarding this complaint about my agent [redacted]. Our company policy is to hear both sides of a story before taking action.

[redacted]’s complaint suggests that Kian Realty was ignoring this situation which couldn’t be further from the truth. Our company has a zero tolerance policy for unethical behavior. We have never had a complaint filed with the Revdex.com. Kian Realty has over 170 agents. In any large company situations arise that are unfortunate and unforeseen.

After my first conversation with [redacted], I tried through e-mails, phone calls and text messages to communicate with [redacted], a Kian Realty agent and the subject of the complaint filed by [redacted]. [redacted] did not respond to my attempts to communicate. The second day [redacted] called again looking for answers which unfortunately I was not able to provide at that time. I assured [redacted] that Kian Realty would be responsible for the $100 refund and that I only needed to hear from [redacted] before doing so.

[redacted] called back for the third day in a row which I believe was a Friday. I expressed to [redacted] that it was strange that [redacted] did not reply. I also apologized for this situation and lack of a response from [redacted]. I asked [redacted] to please contact me Monday and hopefully I will have more information to put closure to this issue.

The weekend came and went and we never heard from [redacted]. All the while I had been calling him and finally that Wednesday February [redacted] I sent [redacted] a final e-mail with an ultimatum and terminated his association with our firm the next day. We terminated this agent long before receiving this complaint on March [redacted]. As mentioned above, Kian Realty has a zero tolerance policy for behavior that is not in line with our high standards. This demonstrates that Kian Realty does not take kindly to any misconduct . The $100 was not an issue and was never the focus of our concerns. As I promised [redacted] from the very beginning we fully intended to replace the $100.

The agent, [redacted] till this day 3/** has never responded or communicated with Kian Realty NYC regarding this matter. We are happy that we terminated him and unhappy that [redacted] had a bad experience with our firm.

I would like to know if I should communicate directly with [redacted] to arrange the refund or wait for instructions from The Revdex.com. I will mail the $100 check to [redacted] on Tuesday 3/** If I do not get instructions from The Revdex.com by Monday 3/**.
