It has been over two months and they have not removed the playset that we had agreed to remove and have not returned phone calls.Started to build a playset on 3/21/2014. They worked for about 6 hours that day. Our playset could not be completed due to neighbor complaints on that same day and not having HOA approval. After I had researched this through our town, we were not in compliance with town zoning setback regulations. Although we are exempt from the requirement of a zoning permit, we are still in violation. This company was not aware of this. But I feel that they should have advised me of this. They agreed to come and remove the half built structure and keep the lumber for the cost of the orinial deposit $1000, but it has been two months and we have had no returned phone calls or any follow up plans to remove this structure. I have called repeatedly twice a week for the last several weeks and have only received 3 threatening emails calling my complaints "slander and defamation." I stated I was dissatisfied with not having any phone calls returned and that too much time had passed without completion of our agreement. I told this business [redacted] that I would write a negative review on line stating exactly what my complaints were. And she accused me of slander. I will hold off on any online reviews or legal action for now and hope the Revdex.com can resolve this issue. Desired SettlementWe would like them to remove the structure or refund us half of our deposit $500. We would prefer that they refund us $500 at this point.Business Response I was contacted by [redacted] on February 18 2014 to discuss renovating an existing freestanding deck structure on her property into a playset for her kids. We arrived in late March 2014 to begin renovation of her existing structure. All work was done on top of the existing structure. We arrived with 2 additional sub- contractors giving us a crew of 4 & worked 7.5 hours which included picking up materials. After completing over 50% of the job we were told by Mrs. [redacted] to stop work due to a neighbor complaint which was heated between Mrs. [redacted] & the neighbor (she slammed the door in his face). Mrs. [redacted] told us she did not get the required HOA approval & would follow up with that. She found out all that was required from her HOA was for her neighbors to sign off which she planned to work on however the one neighbor refused. She then said she was going to continue to work on it to try to keep the structure & alter the design to see if the neighbor would agree to it. This process took quite awhile for Mrs. [redacted]. I told Mrs. [redacted] I was willing to call the work we had done & what she had paid even & she could figure out what she wanted to do. She eventually asked if we would come back & take the structure down & I told her I still had to pay my workers so we agreed to keep the wood which Mrs. [redacted] agreed to in order to offset our costs for her mistake. She then sent me a message that she wanted us to take it down & she wanted to keep the wood. I messaged her back that was not our agreement & did she want me to take it down & keep the wood as we agreed & she said yes. I told her we would get to it asap but that we were extremely busy. She then emailed that she was going to write negative online reviews & was planning to state them as well to her landscaper and there was nothing I could do about it, I told her I would advise against her slander & defamation or I would take legal action. I have never sent her a threatening email or message however I advised her I was tired of her threats. (I have all of the emails, texts, & voice mails for you to review if needed as well as pictures of the existing structure prior to work beginning & where work stopped). On 5/20/14 @ 8:42am I messaged her we would come take it down & keep the wood as we had agreed. 4 hours later at 12:46pm on 5/20/14 she messaged me that since she had not heard back from me she had filed a complaint with Revdex.com. Permits are not required for playsets as Mrs. [redacted] was told by the Town of [redacted] & is stated on their website & through her phone calls to other playset companies that she contacted. I explained to Mrs. [redacted] at the time & on multiple text messages this is my busy season, that we are working 70-80 hours per week & we do run 2-3 months behind as does most playset companies in this area during this time of year. It was Mrs. [redacted]'s responsibility to obtain her HOA approval which was all that was required for this project, she did not do it. We did not place a new structure in her yard - we were renovating a structure she already had in her yard & never moved placement of that structure. We could have finished the job we started the same day we were there & was owed an additional $1000.00 at completion & was stopped by Mrs. [redacted] without finishing the job or any further pay. I have already went in the hole with this job with labor costs at $25.00 per hour per person plus the cost of the materials from work that was completed. I originally told Mrs. [redacted] I would call the job even, she later asked if we would remove it & I agreed we would do it & keep the wood to help offset our costs, she agreed yet later stated she would keep the wood. I have received threats from her & have been harassed by her & at this point I am considering taking legal action. This was her mistake & while I sympathize for what she is going through this is not our fault and is no longer our problem. She hired us to renovate her existing structure which we were doing & it is my suggestion she hire another person to renovate it again by taking it down. Our original order & agreement consisted of 50% down and the remaining 50% was to be paid when the job was completed. Although we would be removing the structure we have already began building we would still be completing her job as she instructed us to do to her satisfaction. If we agree to come back out to remove the structure we will only do so instead of the final balance of $1000.00 as we originally agreed at the start of this project we will do so at an hourly rate of of $25.00 per hour per person working and we will leave the wood for Mrs. [redacted] to do with as she sees fit. We have an A+ rating with Revdex.com which we are proud of & do not want that tarnished however we are not expected to loose money on a job due to a customers mistake. By the way I have not received anything by mail regarding this complaint - please contact me if you feel you do not have my correct mailing address.Consumer Response I did not " slam the door" on my neighbor. My children closed the door. This is petty and inaccurate. We have come to a settlement with our neighbor and have hired another company to build a new playset and take down our old one. This new company can do this in 2 weeks. Unlike kids kornerplay sets who never returned my calls or told me that it would take 2-3 months, this company responded right away. If [redacted] had told me the length of the wait and we had agreed, why would I be writing this complaint. She has resorted to threatening me a customer with a complaint about her experience. This company is unprofessional and unreliable in my experience. Final Business Response Mrs. [redacted] was personally seen slamming the door in her neighbors face and the neighbor then turned to one of my guys and shrugged, it is sad she wants to blame this on her young children. I specifically told Mrs. [redacted] in our first email that we book quickly and run behind. I also on at least 2 occasions told her we were working 70-80 hours per week and that we were running 2 months behind and will be happy to provide this documentation for Revdex.com. It is apparent that a resolution has been made as Mrs. [redacted] says she has retained another person to take down the structure and build a new one, that is our desired resolution - we have not been paid any further compensation for services and have not received any excess money for services that were not performed. If this company can do her work in 2 weeks that is great and they obviously do not have the workload that we have. On 2 separate occasions Mrs. [redacted] on voicemail and in a written message reneged on our agreement, failed to get her required HOA approval, was hostile towards her neighbor in front of my workers, was asked again in writing if she wanted to again keep our agreement to take down the structure with us keeping the wood to which she agreed only to 4 hours later file a complaint with Revdex.com has proved herself as an unreliable customer. Again I have never threatened Mrs. [redacted] and consider her continued accusations slanderous and a defamation to my character and business. I demand Mrs. [redacted] show proof of threats to myself and the Revdex.com immediately and to cease her unfounded accusations.
