Initial Business Response / [redacted] (1000, 7, 2014/05/12) */ 05/12/ To whom it may concern, I am responding to a complaint made by a Mr [redacted] case # [redacted] The [redacted] was purchased by Mr [redacted] on April 29, from Kihei Auto Sales with the lienholder being [redacted] The vehicle was traded in by the previous owner on April 22, which is one week from the purchase dateDespite our many efforts on pleading with Mr [redacted] to let us look at the vehicle first, he insisted on purchasing the vehicle the way it was with the promise in writing that we would fix the 4-wheel drive free of chargeHe was told that he would need to be patient by both the owner and me since we did not know the root of the problem We had a specialist come in to take a look at the issues and fix the 4-wheel driveThere were many different reasons on why the 4-wheel drive would not engageFrom the transfer case actuator and to the internal shaft from the front end to the drive line, all of these problems along with the ordering of all the parts lead to the vehicle being repaired for quite some timeHowever, while the vehicle was being repaired we provided Mr [redacted] with a free rental vehicle for him to use in his everyday lifeThe truck was never on an unsecured lot while it was in the possession of the specialist with the lot being locked and secured every night at time of closing At no point in time was Mr [redacted] 's job ever threatened due to not selling the vehicle backWith all the mechanical issues along with the length of time to repair the vehicle, the owner gave Mr [redacted] the option to sell the vehicle back to the company and the owner would return all the money Mr [redacted] had paid for up in to that pointMr [redacted] still wanted the truck and agreed to wait for it to be repaired When the 4-wheel drive was finally fixed, it was brought to Mr [redacted] and his mom's attention what was done to the vehicle from step one all the way to the endThe 4-wheel drive was able to engage but the specialist informed them that the lift on the truck due to lack of care from the previous owner, was eventually going to cause these problems to returnWe have documentation stating all of thisShortly after receiving the truck back Mr [redacted] and Kihei Auto Sales parted ways on August 2, and due to legal matters, we cannot comment on his parting at this time In order for Mr [redacted] 's financial institution, [redacted] , to finance him, there had to be an "addendum to Master Dealer Agreement" signed by our finance manager to agree to buy the vehicle back just in case Mr [redacted] became delinquent on his payments and the truck fell in to repossession statusAccording to [redacted] , this agreement was needed to be put in to place due to the fact that Mr [redacted] was an employee of Kihei Auto Sales at time of purchaseIn January of Mr [redacted] allegedly fell behind on his payments and due to the nature of the "addendum to Master Dealer Agreement" Kihei Auto Sales was left with no choice but to buy the vehicle back from [redacted] due to the terms of that agreementA check was cut on February 10, for $15,that was electronically wired to [redacted] At this point the truck became property of Kihei Auto Sales and the contract between Mr [redacted] and [redacted] was voidAlso at time of purchase Mr [redacted] needed $8,for a down a payment in order for [redacted] to agree to finance the vehicle for himOf that $8,000, Mr [redacted] paid $4,up front and Kihei Auto Sales paid $3,of that which Mr [redacted] promised in writing to pay backAs of this moment Mr [redacted] has paid $in which $is still owed to us at this moment in time After I took possession of the truck on approximately February 25, 2014, it did not come back in the same shape it was soldThe original tires and rims that were on the vehicle when the truck was sold were replaced by a cheaper set of tires and rimsAfter sending it to a specialized shop, it was brought to our attention that it would need new wheel bearings, ball joints, tie rods, a rack and pinion, and a new exhaustAll of this along with labor will cost us over $5,that we need to Indore to get the truck to sellable condition In closing we feel that we went above and beyond to help Mr [redacted] with the issues of the vehicleAt no point is it our fault that he could not make his payments to his financial institutionWhen it comes to having his truck repossessed his issues lay solely with [redacted] in which it was their decision to stop financing Mr [redacted] Not only do we maintain that we owe him no type of monetary reimbursement but we also intend on collecting any money that is owed to us do to an unpaid down payment, as well as any repairs that needs to be done May 14, To whom it may concern, Mr [redacted] stated in paragraph #that "Despite our many efforts on pleading with Mr [redacted] to let us look at the vehicle first, he insisted on purchasing the vehicle the way it was with the promise in writing that we would fix the 4-wheel drive free of charge." Note: Kihei Auto agrees to fix the 4-wheel drive, I would think that they already knew what was wrong with the truckI don't ever remember them trying to persuade not to purchase the truckIn fact it does appear that Kihei Auto went to great lengths to secure the financingAccording to Mr [redacted] in paragraph #5, he states there had to be an "Addendum to the Master Dealer Agreement" that was signed by their finance manager (Mr [redacted] ?)As to the addendum, I was not aware of any addendum nor do I have any copies of this addendumI thought that there was to be full disclosure of anything pertaining to the auto, or auto financingI am now finding out this was not the caseI have to question if this is a legal procedure and in fact may seek legal advice now that I am aware of the addendumAlso, I am requesting a copy of this document, refusal to supply me with a copy may be construed that there is in fact something to hide Let's talk about this addendum to the sales agreementAccording to Mr [redacted] , Kihei Auto Sales entered into this agreement with [redacted] Mr [redacted] states that this agreement had to be in place in order for [redacted] to finance my loanMr [redacted] goes on to state that this agreement was in place in case I became delinquent on my payments and the truck fell into repossessionHe also states that according to [redacted] this agreement was needed because I was an employee of Kihei Auto SalesI fail to understand what me being an employee of this company has to do with this addendum or for that matter the purchase of this vehicleHowever, this "Secret Addendum" does give the appearance that Kihei Auto Sales had the advantage in this sales agreementIt also makes sense as to why Mr [redacted] could threaten to terminate me if I didn't sale back the truck to him on July 3, I lose my job can't make the payments the truck goes back to Kihei Auto SalesThis does not sound legal!! I must state that at NO time was I ever informed by [redacted] that I was now looking at having my truck repossessedNor did [redacted] inform me of this Addendum to my loan In paragraph #Mr [redacted] talks about the 4-wheel driveHe states that the company had a "Specialist" come in to take a look at the issues and fix the 4-wheel driveMy truck was turned over to the company in May, I am not sure of the exact dateThey had the truck on a lot until late JulyDuring this period I never saw any invoices for parts, or any broken partsMr [redacted] talks about the many reasons as to why the 4-wheel would not work however he never states what the problem with the 4-wheel drive was or what the fixedHe does mention the transfer case actuator and the internal shaft from the front endWhere those the problem? Was that what was fixed? In the later part of July when I received the truck back the first thing I did was to try and engage the 4-wheel driveNow mind you this is not a get out and lock the hubs and then move the shifter into high or lowThis is push a button and then everything from there is electronic 4-wheel driveWhen I engaged the 4-wheel drive it showed that it engaged, but from that point on there was a loud bang, and the entire truck would violently shakeI informed Mr [redacted] about what happened and just as I was doing this the owner of the company Mr [redacted] comes inBoth I and Mr [redacted] took the truck for a driveMr [redacted] in fact drives the truck this time, he engages the 4-wheel drive and immediately says "Oh that's not right." Mr [redacted] then states that he will see to it that it gets looked at by someone elseIt never does and within two weeks I am terminated As for their "specialists" I spoke with him prior to getting my truck backIt's apparent that he didn't fix the 4-wheel driveAlso if Kihei Auto Sales is going to refer to him as a specialist can they prove that he is a specialist in repairing electronic 4-wheel drives such as what was on this truck and can he provide proof of his knowledge of high performance lifts such as what was on the truck? Also, can they provide copies of his credentials and nameI am requesting information on their specialist because I know that he is not an employee of Kihei Auto SalesWhat is his business name and does he have a licenseWhere exactly does he operate said business? I believe that in the State of Hawaii a license to operate a business is required In paragraph #Mr [redacted] talks about how my job wasn't threatenedFirst of all Mr [redacted] was not present when me and Mr [redacted] the owner of the company arguedWe had argued because I wanted to know when my truck was going to be done and when would I get it back (They had already had the truck for about a month and a half)The argument became heated and Mr [redacted] at that point threatened to terminate me if I didn't sell him back the truckMr [redacted] makes reference to this selling back of the truck in this same paragraphRemember now they have the hidden addendum that I am not aware ofBecause of the heated argument I left work that day which was July 3, about I then called my mother [redacted] and explained to her what had just happenedIn turn she called Kihei Auto Sales to speak with Mr [redacted] and was told that he had leftOver the next several hours Mr [redacted] and my mother exchanged several phone calls about what he had threatened to doActually, Mr [redacted] called my mother several times she didn't call himMr [redacted] as I stated was not present he hadn't come to work yet that day I found out about them purchasing the truck on February 11, when I went to make the late payment and the current paymentI was told by [redacted] that I would have to contact Kihei Auto SalesI called that day and I spoke with Mr [redacted] He informed me that they now owned the truck I told him that I was going to make the paymentsHe told me that was not possibleIf I wanted to keep the truck I would have to come up with the entire amount of $15, They knew I couldn't do that so in the end they get to keep the truck which is what they always wanted, I lose out on all of my money Later this day a lady came to my house and told me she had a repossession order for the truckWe talked for several minutes but she didn't take the truck and then leftMind you this is on February 11thAccording to Mr [redacted] they only became the owners of the truck as of February 10thSo I have to ask how is it that they have a repossession order for a vehicle that fast and [redacted] didn't communicate to me anything about repossessing the truckTherefore I am requesting all documentation on this purchase of the truck from [redacted] and the documentation pertaining to the repossession orderIf Kihei Auto Sales fails to supply such documents I believe that shows again they have something to hide In paragraph #Mr [redacted] states that the truck was not in the same shape as when it was soldI am not aware of any contract that says that I can't change the tires and rims seeing as how I and [redacted] were the owners*ihei Auto Sales chose to purchase the loan / truck sight unseenAs far as the wheel bearings, ball joints, tie rods, a rack and pinion and new exhaustI drove that truck for 6-months those mechanical things do not wear out in that time frame*ind of sounds like that was some of the other undisclosed mechanical issues the truck had when I purchased itThere again can they provide prove of all the items that need to be repaired and maybe we should have their "Specialist" have some input on thisLike maybe the specialist can say just how all of these parts can go bad in 6-months One of the last things Mr [redacted] states that they "Intend on collecting any money that is owed to us for the unpaid down payment, as well as any repairs." This is my response to that if you're planning legal action or collections I welcome it because then it will definitely go to litigationThen the truth will come outKihei Auto Sales has much more to lose than I do I fully expect to receive copies of all of the requested documentationI am hoping we can resolve this without going to court [redacted] * [redacted]

Complaint: [redacted] I am rejecting this response because: The tire was damaged when I picked up the vehicle I had to point this out when I initially picked it up and the staff took the vehicle around back, inflated the tire and told me it was fine It is not my fault that their vehicle had a damaged tire when I took possession of the vehicle This was clearly the case since the tire was low and needed air - filled by [redacted] - when I picked it up And as I said, their staff assured me the tire was fine Regarding the gas, it should be obvious that I could not replace the gas in a vehicle that was stuck on the side of the road due to their improper maintenance? The gas is no longer my responsibility - especially not at the ridiculously high feeIt is [redacted] 's responsibility as a result of their poor vehicle maintenanceIn relation to the replacement vehicle's gas, I drove miles from [redacted] to the airport Is [redacted] suggesting that their replacement vehicle gets miles on a full tank of gas? So either [redacted] did not provide a car with a full tank of gas or a [redacted] gets mpg I dispute their claim that I used 1/8th of a tank of gas And regardless, we no longer had time to get gas as we needed to rush to the airport to make our flights - again, due to the negligent maintenance of the original rental vehicle from [redacted] I haven't even mentioned the rust frozen jack in the back of the [redacted] that kept us from changing the tire ourselves Or that fact that the [redacted] could not have been "All out of gas" when the tire went out Sincerely, [redacted] ***

Regarding the complaint, filed by [redacted] * [redacted] We sold a Mazda Bto [redacted] D [redacted] on 3/31/ This is a touchy subject since [redacted] is Lance V***’s Ex Girl Friend [redacted] came to us with no money, bad credit and no one in her family willing to co-signSo Lance V [redacted] paid her down payment, so as to help [redacted] so she could continue going to workAs far as fair purchase price and interestFair Dealer Retail on that particular truck at the time of sale is over $dollars, and Carfax suggests its worth mid $for our areaRegarding the interest rate 23.99% is what she qualified for.We received the truck 1/31/and ran it through our shopRepair by our certified mechanics came to $2913.91c to get truck up to parAs all used cars are in Hawaii sold are as is, we feel that putting our best product possible on the line to continue our stellar reputation and receive repeat customers are of the utmost importanceOn 5/3/ [redacted] brought the vehicle to our service centerThe road test revealed a minor noise from front tires and a slight exhaust leak from drivers sideCustomer declined repairsOn 5/18/ [redacted] called Lance V [redacted] and asked for help with the truckHe approached me and we got it into the shop at our earliest openingAfter it arrived my service writer informed me that the vehicle had already been in there a few weeks prior for the same thingHe explained that the issues found were very minor and did not need to be addressed at this time, and that is what we passed on to [redacted] , along with us comping the diagnostics When you purchase a vehicle in Hawaii it is AS ISIts stated, and signed next to in several areasUnforeseen circumstances are always a possibilityThe complainant obviously agreed with that when they purchased the vehicle We believe that we have gone above and beyond for the customerIf you look at our reviews we are famous for helping our customers, and going above and beyond what is required from a car dealership.What I can do Please have our Client give us a call and we will try and remedy the situation

To whom it may concern, I am responding to a customer complaint from a [redacted] on a door [redacted] rental from 02/24/16-02/27/The [redacted] was completely empty when we recovered the [redacted] with a flat tireThe tire was deemed to have gone flat because of a nail in the tire that could not be repaired by Goodyear Tire Center in KiheiIn retrospect Mr [redacted] is technically responsible for the damaged tire but we decided to meet him half way being that the tire and the labor would be around the same amount as the gas chargeThe [redacted] has a gallon tank and when you multiply that by a gallon it comes out to $not including taxAlso the second vehicle that we exchanged Mr [redacted] in to he brought that back at 7/full which subsequently meant that we needed to charge him $plus taxAlthough the amount seems stern, by taking care of the tire replacement for the customer we saved him roughly $out of his own pocketI believe we went above and beyond what we needed to to for Mr***Aloha

Complaint: [redacted] I am rejecting this response because: we did not purchase a [redacted] tacoma we purchased a [redacted] pick up also it was paid in full on 4/16/we have the receipt from kihei auto sales reference number [redacted] Frank was our sales person that we worked with both me and my girlfriend we asked about the tires and where told it was in great condition we also asked about any other issues that we need to be aware of any thing damaged or broken or missing? because we need to take this into consideration because of the cost to replace or fix we understood their was minor rust which was fine but we where told no the truck runs great only to find out that once it was shipped to us the day we got it off the barge it overheated that SAME day and the tires where horrible!!!! like javin just stated in his message tires in poor conditionwe called and spoke to javin who didnt want to help us at 1st and then decided too which we greatly appreciated but since getting the truck we have had non stop problems because the tires are bad we cant really drive the truck because its unsafe then a tire fell off and we took it into [redacted] tires here in kona Brian the person working on the car told us we where sold a car with incorrect rims and lugnutsthe tires are not even being held on and that all of them are not being held down and needs to be corrected immediately this is a death trap waiting to happen and he can prove it and said feel free to contact himwe where sold a lemon and kehei auto sales knows thatwhen this incident happened we called him and informed him on what had happened and he said to me what would you want us to do? I stated the lease he could do was to take care of the lug nuts and he said he will crunch numbers and get back to us and he never did we had to call and leave messages asking when he will be getting back to us only to be treated from a manager with complete rudenesshow as a business can you sell a customer a car that Javin said he dose not need to inspect cars years and older????? so my truck is years old and was never inspected???? yet you still sell something that you have no idea the issues???? what manager just hangs up on his customers?????? all we asked was to make this wrong right if not we want our money back and cant believe a DEALERSHIP sold us a lemonwe are not the every day onlookers and we ask questions because those little things do matter we where never offered nor recommended to have a mechanic or a family friend take a look at the vehicle they where not honest with us and just wanted to make the sale which truly saddens me, we specifically went to a dealership to get the truck to avoid problems like these but we where wrongfrank was our sales person who we really relied on to be honest with us about the sale of the truck and to tell us the whole truth not just part of it and we called only because of the problem and to be able to work with them on getting the problem fixedcurrently the truck isnt even running because their is problems with the enginethe whole time we have had this truck it has been down or in the shop or trying to find a way to get it to onethis is a big issue and problem that I truly believe can be made rightbut from day this truck has not worked the way is shouldif this happened to someone you know how would you feel? we may be upset and thats to be understandable, who wouldnt be? but we do believe any wrong can be made right if not we just want our money back Sincerely, [redacted]

Complaint: [redacted] I am rejecting this response because: I do not have documentation but would have to rely on testimony from employees I brought the car back in immediately after picking it up and hey looked at the tire and filled it up with air and sent me on my wayAny statement from the dealer that the tire was fine when I get the vehicle or that he damage occurred while I had the car is a bald faced lieAll I can tell you is that this company is lying about what happened and changing their story as they go when necessaryFirst they said the charge as to pay for he fireThen they said it was for gas, and now say the previously damaged tire was my fault This is a dishonest, poorly run, charlatan of a company I would warn all against doing business with them Sincerely, [redacted] ***

To whom it may concern: ID # [redacted] Regarding the complaint,filed from [redacted] .They purchased a [redacted] from us 4/08/2015.They purchased the vehicle off Island sight unseenThe Customers were well informed that the vehicle is old, and in poor condition.The vehicle was running at the time,the four wheel drive worked,and that's itNo a/c,tires inpoor condition, rust,along with other minor issues.Due to the popularity of this vehicle,it did not seem to matter too many onlookersWe always recommend people to fly over,have a friend or mechanic,to look at the vehiclebefore purchaseThe complainant did not opt to do this Uponpicking up the vehicle,they called with reports of overheatingAfter Listening to their issue,we reminded them that the vehicleis As ISWe made it clear that the Vehicleis as isHowever we decided to help, and purchased them a radiator, and thermostatWe even paid for a mechanicto install itAfter assuming we did a good deed, and thought we would no longer receivephone calls,they kept cominginWe explained once more that the vehicle is as IsThat'swhat they signed during the purchase process.They were given the opportunity tohave it inspected beforepurchaseVehicles are in need of constantupkeep especially when they are that old.We believe that we have gone above and beyond,with this customer.SincerelyKihei Auto Sales
