[redacted] is no longer with the company and unless there is proof in writing that this was agreed upon we unfortunately cannot reimburse you

The above named customer has submitted a complaint to you regarding guarantee of warranty issues Mr [redacted] has ordered numerous ATV's from us over the course of months With every issue that came up with any of these orders a warranty claim was filed and the warranty was honored with parts or replacement units being offered or sent Mr [redacted] refused to comply with our requests when asked to send pictures of some of the damaged and/or defective units We accepted two units back that was initially supposed to be an exchange, however he decided he wanted a refund on these two units - which we honored When we received the units back it was discovered that he had taken the exhaust pipe off one of the ATVs and attempted to weld it to the head of the engine Warranties are voided if the machine is altered or modified in any way He was confronted about this, however we still issued a full refund At that time Mr [redacted] started sending email messages with statements that were regarded by our legal department to be threatening in nature He also began leaving voice mail messages using foul and explicit language It was at this time he was notified that we would no longer be able to assist him with any issues or sales in the future Mr [redacted] notified us that he had a new dealer that he was working with and he was instructed that perhaps the new dealer would get him in contact with the manufacturer of the Coolster ATV that he was having problems with and they could help him with the warranty that way He responded with fine Since that time, Mr [redacted] has called for price quotes on the same machine on two separate occasions, not identifying himself of course He also issued a chargeback with his credit card company that was disputed by us on 12/26/ This chargeback is still in the review process as of 2/16/ The funds have been taken out of our account and placed in a holding account until this dispute has been reviewed and decided upon So, currently the ATV is not paid for We have the right to refuse to do business with customers especially when we have documented proof that they have proven to be obscene and belligerentHowever, despite that fact, we would never warranty an ATV that is currently in chargeback status If you should need any further information, please do not hesitate to contact me directly We have copies of all of the correspondence as well as the voice messages that Mr [redacted] has left us and would be happy to forward them to you in the event that you should need them

Motor Sports has made reasonable attempts to describe its exterior and mechanical condition as best as possibleWhen purchasing said units, the Buyer acknowledges that the vehicle is being sold “as is,” without warranty, whether express or implied, about the condition of the VehicleThe Buyer must satisfy himself or herself as to what is offered for sale, and by purchasing will be held to have satisfied himself or herself that the vehicle is satisfactory in all respectsAll defects and repairs are the sole responsibility of the BuyerThe Seller neither assumes, nor authorizes any other person or entity to assume on his or her behalf, any liability in connection with the sale of the vehicleKiller Motor Sports disclaimers of warranty do not affect the terms or applicability of any warranty from the vehicle’s manufacturer that may be applicable to the vehicleFurthermore, vehicles sold as Refurbished or on Clearance do not quality for any additional discounts, promotions, or free products. *** *** placed his order with Killer Motorsports on May 14th, for a TaoTao 50cc GTGas Scooter Moped - Black (2nd choice: Grey)On May 20th, the 4th business day, the vehicle was prepared to ship. Tracking information was not available to us to give to the customer
until the carrier picked up the vehicle and was on the truck. Tracking information is usually sent by email automatically. If the customer has not received the email, it may have went to his spam folder or there was an error with our system, as we have changed ownership and working with a new software systemThe carrier picked up the package on May 21st from our warehouseOn May 22nd, the customer's tracking number was sent via email directly from one of our customer service representatives. We did not receive a response back from the customer until later that evening over the phoneHe may have left a message requesting a refund firstOur representative then called back to confirm if he would still want to continue with the refund despite the order already being shipped He disconnected the call when he was told he was told there may be return fees appliedThe package continued to ship and according to the tracking information, the package was delivered on May 26th He received his product in business days (not counting Memorial Day) from the day that it shipped We've tried contacting *** *** twice by phone and left voice messages on 5/26/and 5/27/ We also emailed him on 5/28/and we have not received any response

[redacted] is the former owner of Killer Motorsports and he sold the business in May 2015 so unfortunately contacting him regarding this issue would not do much help, if any at all. Please enter your reason(s) for rejecting the business response below.Whether there is a warranty or not, and whether the bike was sold "as is" a moot issue because it was damaged in shipping and the damage was not shown in the photos of the bike online. That damage was presumably submitted to the shipping company for compensation.   I spoke with Erik Alvarez and the parts were from [redacted]. I can produce a reciept if you confirm you will reimburse me for the parts.  Thank you.
