Complaint: [redacted] I am rejecting this response because: on the back side of the proposal provided from The Killers is the following limited warranty word for word"Killers expressly warrants for a period of (1) one year from the date of initial treatment, that if it's treatment does not eliminate the listed pest(s) The Killers will reinspect and treat the property as deemed necessary by The Killers during the one year periodThe Killers obligation does not extend past one (1) year of original treatment date unless contract is renewed with The Killers consent.The REINSPECTION and retreatment during the one (1) year period after initial treatment is The Killers only responsibility under this limited warrantyExcept for the except for the expressed limited warranty contained herein, The Killers makes no warranties of any kind or nature, either expressed or impliedINCLUDING NO IMPLIED WARRANTY OF MERCHANTABILITY AND IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE The Killers only warrants against infestations of the listed pests There is no warranty against structural damage or damage to contents caused by the listed pest(s)Owner/Agent assumes the risk and liability that products used by The Killers could cause damage, in no event will the killers be responsible for consequential damages which result from any treatment or from pest(s) missed in any inspectionThe Killers make no expressed or implied warranties beyond the terms and conditions of the Unlimited Service Warranty PlanReinspection and pretreatment are owner's sole remedy under the agreement and limited warranty."The words in all caps are that way on the limited warranty.No where on the proposal or work order does it clearly state this warranty does not apply to one-time services or that the warranties only apply to year contractsIf a one time service is not warranted it should CLEARLY state that on the proposalIt does not Sincerely, [redacted] ***

To Whom It May Concern, Thank you for bringing the clients concerns to our attentionI've attached a copy of the contract that Mr*** signed with our company showing the service he requested and paid forWe have a few different services available to our clients that range from a premium
service with a warranty in the crawlspace for termites with exterior quarterly treatments to annually guaranteed general pest services with quarterly follow up treatments and lastly the most basic of services which is a one time application for a specific area or pestMr *** contracted with us on 11/03/to provide him with the most basic service which was a one time application of the crawlspace onlyThe cost quoted was $at which time Mr*** used a discount coupon for $off making the total $for his serviceThe service tech for this application was Leo Fernandez who has 6+ years in the pest control industry and over years with our companyHe's very professional at what we do and the services he providesMr*** called and requested another service in May of and our inspector Matt Eberle went out on 5/18/to see what issues Mr*** was having and how we could be of helpAt that time the inspector recommended that Mrburn's upgrade his service to a annually guaranteed service with quarterly treatmentsThe total cost for the annual service is $and the inspector said we would credit Mr*** for the $he'd already paidIn addition to the credit the service year would start from May of After being in this business for years I see that offer as being more than fare on both sides and even more beneficial to Mr***Mr*** receives not only the one time service in November that he originally contracted for but he'd also receives a greatly discounted annual service with quarterly treatmentsWith over active clients our goal is to provide the best service we can and that's why 99% of our clients choose the annually guaranteed services we offer over the one time applications because pests problems are so prevalent in OregonWe always recommend to the client the annually guaranteed service because in most cases the pest problems we have in Oregon require follow up services which are included in the annual service agreementsWith one time applications it's pretty straight forward and self explanatory that a one time applications is just that, a one time application with no follow up treatmentsOur offer still stands if Mr*** would like to upgrade to the annual service and get his pest problems taken care of otherwise we wish him well in taking care of his pest problems. If a one time service is not warranted it should CLEARLY state that on the proposal. It does not.
