I have never received payment due me from items I consigned to auction in January 2014. I have called them 8 times about this matter.I consigned items for sale at Kimballs auction & Estate services, 169 Meadow st. Amherst, Ma. 01059, back in [redacted] of [redacted] for sale at the [redacted] auction. I attended the auction. The items sold in 3 lots ; $80.00, $40.00, & $45.00. The auction house told me I would receive payment in 1 week, I called after 2 weeks, and was told it takes up to 30 days, I called again after 45 days, I was told they would look into it and send me a check. I called again after 3 months, was told they would look into it. I have called 8 times, the last call I made the owner made like there was little he could do because so much time had passed. He asked me to for my new address, but to this day I have never received a phone call or a check from this business.Desired SettlementI am owed $123.00 from this business. I checked the bank statement for this time period and the check has still not cleared, so I can only imagine that it went lost in the mail. The consigner contract that Mr. [redacted] filled out himself has the above address written on it and that is where we sent the check. Since the check has not been cashed I am certain that we could reissue this payment and send it to the appropriate address. Please let me know how to proceed.Thank you,[redacted]

Contract is for auction of items. Contract specifies that payment for auction items will be made within 28 calendar days of auction. Auction items were delivered to auctioneer on 8/18/14. Auction was held within two weeks of delivery. On 10/24/14 confirmed by telephone that items had sold at $650.00. Verbal agreement was reached for payment no later than 12/31/14. Subsequent to 12/31/14 four telephone calls have been made requesting payment. The last of these calls a voice message relayed the warning that if payment was not received in five business days a complaint would be filed with Revdex.com. After one week a return call was placed saying that the check was already in the mail. That was on 3/5/15. As of 3/15/15, nearly seven months after date of delivery of items for auction and approximately five months after the contractual date for delivery of funds, no payment has been received.Product_Or_Service: Auctioneering servicesAccount_Number: Seller number [redacted]Desired SettlementPayment of funds owed immediately and refund of auctioneers commission for failure to honor contract.Business Response HI [redacted],After our phone call on Tuesday we looked though our records and saw that we had sent Ms. [redacted] a check several months ago with the reconciliation statement. Upon learning that she claimed that she did not receive it we did some research with our bank and found that indeed the check was never cashed. We reissued this check and a final statement of reconciliation Tuesday afternoon. I feel once she receives this we should be in good standing with her.Please keep us posted as to the results,[redacted]
