Review: I bought a [redacted] rifle a few months ago and from the first time I shot the rifle, it was defective. The firearm starts building gas pressure on the second shot, resulting in an over-pressure condition. This condition blows the primer cap out of the rear of the shell casing and in one incident, split the rear of the shell casing drawing minimal blood on my cheek. It also expands the shell casing abnormally, generally on the third or fourth shot. I've mailed the defective firearm, with damaged shell casings, back to [redacted] twice, and mailed it back to them again, today. The second time I mailed the defective firearm back to them they said they couldn't replicate the over-pressuring problems and mailed the rifle back to me. After contacting [redacted] again this morning, I was informed, once again, that they need bench test replication in order to repair the firearm. I stated for the second time, the fact that I no longer want this rifle and would require a refund, as the rifle is not safe. Included with this latest returning of the defective firearm, has been two spent damaged shell casings, proof of top of the line ammunition via empty box, along with two videos of myself bench testing the defective rifle as it fails. I have been given every excuse from [redacted], short of a refund/repair. Earlier today I was given an email address with the promise of my email to said address, being forwarded to [redacted]'s CEO. Upon providing said email address my list of problems, the address got sent back to me as invalid. I need help. This rifle is dangerous and [redacted] is refusing everything.Desired Settlement: I have requested repairs from [redacted] the first time, and a refund two more times. I would like my money refunded for the defective rifle.

Dear Sir or Madam,

Please allow this letter to formally respond to your letter dated October **, 2013 regarding the above-referenced matter.

[redacted] Mfg., Inc. ("[redacted]") understm1ds the concerns expressed by Mr. [redacted]. Kindly be advised that [redacted] has again examined

the rifle in question, [redacted]: [redacted]., Serial Number [redacted](the "Rifle"). After reviewing the complaint lodged by

Mr. [redacted], our records, and inspecting the Rifle again, [redacted] still maintains that the Rifle is not defective and [redacted] has no liability

of any kind to Mr. [redacted].

Upon receipt of the Rifle, [redacted] inspected and tested the Rifle with various types of ammunition. The Rifle functioned properly and Kimber

could not replicate the issue experienced By Mr. [redacted]. Additionally it is worth nothing that Mr. [redacted] indicated to a Kimber

customer service representative that he was loading the rifle in a certain manner that is contrary to instructions. The [redacted] customer service

representative also advised Mr. [redacted] that the loading technique he described was inappropriate mid could cause issue, and Mr. [redacted] indicated that he

believed he should be able to load the firea1m as he chooses. Kimber believes that improper loading technique and/or issues with ammunition

utilized by Mr. [redacted] caused the issues complained of in this matter, and that such issues were not caused by the Rifle itself

and/or malfunction of fue Rifle. Please also note that the Rifk was purchased from an independent dealer,

and not directly from Kimber. Kimber expressly denies any culpability and liability in this matter.

Notwithstanding the foregoing, in light of the disagreement between Mr. [redacted] and [redacted], as a gesture of goodwill and in order to maintain

good customer relations and reach an amicable solution quickly, kindly be advised that [redacted] and Mr. [redacted] have agreed

to the following final and complete resolution of this matter: Mr. [redacted] has agreed to surrender the disputed and complained about Rifle to [redacted] ".

with the understanding that it will not be returned to him, and will execute 11 confidentiality mid release agreement provided by [redacted] to Mr. [redacted]

evidencing the resolution of this matter. Upon execution and return to [redacted] of the aforementioned confidentiality and rdease agreemeilt

(unmodified), [redacted] will issue a refund within fourteen (14) days to Mr. [redacted] for the fireman in the amount of $1199.99 (or such lesser amount as

was actually paid by Mr.[redacted] for the firearms in question. We believe that both parties are satisfied with this resolution and we consider this matter

resolved.
